Preference is for a darker color, e.g. Polished Ebony. Setup to include tuning and ready for play delivery. Company must be able to service, adjust and maintain piano on site, when needed, including any warranty work required within reasonable time frame. 5 year parts and labor onsite warranty. PREPARATION OF BIDS a) All bids must be submitted on the forms on the USD 204 Bonner Springs / Edwardsville School District website http://bonnerspringsusd.cyberschool.com/district/1341 Untitled.html b) All bids must indicate a firm name and the cover sheet must be signed by a responsible person. c) Specifications used are intended to be open and non restrictive. Any reference to brand name or number shall not be construed as restricting to that manufacturer, but used as a minimum standard of quality. Bids on equal items will be considered but must be clearly marked. d) If bidding on other than the make, model, or brand specified, all technical information, specifications, manufacturer s name and catalog number of the equal must be clearly stated on the bid proposal. Any deviation must be clearly indicated. A descriptive catalog must accompany the bid. e) Standard of quality is extremely important to USD 204. The School District shall be the sole judge in making a determination as to the quality. f) Bid on each item separately. Bidders must insert unit prices and the total cost in the exact quantities and units as listed. The bid award will be based upon unit prices. However, USD 204 reserves the right to accept or reject any or all bids in whole or in part when bidding is in other than the unit/quantities as specified and to award the bid in the best interest of the school district. 2. 3. TAXES The School District is exempt from all State Sales and Federal Excise Taxes. 4. DELIVERY AND RECEIVING HOURS a) All shipments shall be delivered to the specified destination b) The outside of each package and/or receiving document must be marked to show the items in the package. c) All packages/deliveries are to be marked as indicated by purchase order. AWARD a) The bid awards shall be made to the lowest responsible bidders complying with all requirements of the specifications and bidding materials. b) Unless the bidder specified otherwise in their bid, the District may accept any item or group of items of any bid whichever is to the best interest of the School District. c) CONTRACT: The Request for Bid, the Bidder s response and a Purchase Order and its attachments when received by the successful bidder shall constitute (1) a binding contract on the terms set forth therein and (2) the entire contract is to be interpreted, construed and given effect in all respects according to the laws of the State of Kansas. d) The bid must remain in force for at least 90 days after the date designated for receiving bids and may be accepted or rejected by the School Board, in whole or in part, at any time prior to the expiration of that period. The School District may waive any irregularities or technicalities, and to award the bid in the best interest of the School District. The judgment of the School District on such matters shall be final. 6. INVOICING/BILLING a) Invoices must be rendered for each individual Purchase Order and should be submitted to the Bonner Springs / Edwardsville School District, Attention: Accounts Payable, 2200 South 138 th Street, P.O. Box 435, Bonner Springs, KS 66012.
7. COMPLIANCE WITH LAWS a) The property or services furnished must comply with all applicable Federal, State and Local Laws, codes and regulations. 8. DEFAULT In the event any property or service furnished by the bidder under a contract or purchase order should for any reason not confirm to the specifications contained herein or to the sample submitted by the bidder, the School District may reject such property or service. In such event, the School District shall instruct the bidder to remove any rejected property without expense to the School District and replace it with such property as conforms to the specifications and samples and/or provide additional or alternative services that conform to the specifications. Should the bidder default in the performance of the foregoing paragraph, the School District may procure such property or services from other sources in any manner provided by law and shall have the absolute right to deduct from any monies due to the bidder or that may thereafter become due to the bidder, the difference between the contract price and the actual cost of the property or services to be replaced or substituted. 9. SAMPLES Samples, when required, must be furnished free of expense and must be tagged with the bidder s name and bid identification. Samples not used or destroyed in testing will be returned to the bidder at his request and expense. 10. RIGHTS AND REMEDIES The rights and remedies of the School District provided above shall not be exclusive and are in addition to any other rights and remedies provided by law or under contract. 11. COMPLIANCE WITH BID REQUIREMENTS Any inability to comply with the conditions and specifications as outlined must be clearly stated in the bid. 12. BIDDERS EVIDENCE OF RESPONSIBILITIES Bidders may be required to furnish evidence in writing that they maintain permanent places of business and have adequate equipment, finances and personnel to furnish the items offered satisfactorily and expeditiously and to extend proper warranties for items.
