Jim, That sounds good. I agree we should complete the review and make needed changes all together. Since this is new to me maybe I jumped the gun opening the discussions before I completed my review. Then again, the discussions help me to better understand what we are doing. And I think I have a way to go in understanding the work that was done to establish the borrow pit boundaries and calculation of the amount of soils available. I was looking at the Title Information and Legal Description page (Figure 1 of Attachment D of the RAI response) which is titled Restricted Property Boundary (Parcels 1 and 2). The description for Parcel 1 includes all of Parcel 1 (which is located in both Okeechobee and St. Lucie Counties). But Figure 2 indicates that the restricted area will only be the Okeechobee County portion of Parcel 1. Can you clarify that for me? Thanks. from Toni S below, I reviewed the O&E reports that we provided you in more detail. Here is what I gathered from my review: We provided O&E reports for FOUR parcels: o 1-12-36-36-0A00-00001-A000 o 1-12-36-36-0A00-00003-0000 o 1-12-36-36-0A00-00004-0000 o 1-13-36-36-0A00-00001-0000 These four parcel numbers correspond to the four parcels shown on the attached query from the appraisers office. The first three parcel numbers correspond to the North Borrow Pit, which we want to restrict. The last one, 1-13-36-36-0A00-00001-0000 (that I lined out) is for the landfill itself and should not have been included. It can be ignored. The North Borrow Pit is divided into two primary areas. The east side is Parcel 1. The west side is Parcel 2. On the appraisers page, Parcel 2 is further subdivided into two smaller parcels, which I ll call Parcel 2 North and Parcel 2 South. So per the appraisers page, there are three parcels we need to restrict as follows: o 1-12-36-36-0A00-00001-A000 (Parcel 1 East side of North Borrow Pit) o 1-12-36-36-0A00-00003-0000 (Parcel 2 North NW Side of North Borrow Pit) o 1-12-36-36-0A00-00004-0000 (Parcel 2 South SW Side of North Borrow Pit) There is an error in the legal description on the O&E Report for Parcel 2 North. I think you were correct in what you described in our recent call: there is a typo that reads 172.62 feet, which seems like it should read 1726.2 feet or something similar. I will alert our paralegal of this. Other than that error, those three O&E reports seem to be correct and the legal descriptions therein correspond to the three parcels that need to be restricted. If there are still questions, I think it would be best if we could get our paralegal (Christa Johnson) in touch with the person(s) that will be reviewing that information in detail on your end. Let me know how you would like to proceed on this issue. Thanks. The language below is from our attorney Toni Sturtevant. Also (if you know differently please let me know), I think we will need to finalize the deed restriction and WM/DEP agreement before we can issue the permit. In the meantime I will send out a draft permit

(hopefully next week) for everyone to review so we can be ready to issue it as soon as possible. Merry Christmas to you and your family. There is actually something confusing going on with this title work. They ve given us O&Es for both pieces of the legal description of Parcel 2 of the Restricted Property, but none that match the legal description for Parcel 1 of the Restricted Property. From the work indicated on the survey, it appears that they must have had title work for Parcel 1 at some point. I am wondering if perhaps they just sent us the wrong O&Es. The ones that don t appear to match are 1-12-36-36-0A00-00001-A000 and 1-12-36-36-0A00-00001-0000. Can you reach out to them for an explanation of that discrepancy?
