ACTION REQUIRED: Adoption by Council RECOMMENDATION: Staff recommends adoption of the ordinance. FISCAL IMPACT/BUI)GET IMPLICATIONS: None. Sewer is availa'ble in S. Maple Grove Road. The property is serviced by Fire Station #6, and the children will attend Horizon Elementary School on N. Mitchell Street, north of W. Emerald Road. BACKGROUND: The property is located at 550 S. Maple Grove Road. The Planning and Zoning Commission recommended approval of the rezone from A-L (Open Space) to R-2D (Combined Residential with Design Review), and approved a 219 unit planned residential development at a public hearing on December 3,2007. MAPLE GROVE ROAD) AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION ONE OF THIS ORDINANCE FROM A-1 (OPEN LAND) TO R-2D (COMBINED RESIDENTIAL WITH DESIGN REVIEW); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. Pursuant to the procedures and requirements of Chapter 65, Title 67, Idaho Code, the Boise City Comprehensive Plan, and pursuant to the reasoned statement of the City Council that existing zoning classifications for the property hereinafter described be, as a result of changed circumstances, amended and reclassified to promote the public health, safety and welfare, the land use zoning classification of the following described lands within the City of Boise City, Idaho, as set forth in Exhibit A are hereby changed from A-1 (Open Land) to R-2D (Combined Residential with Design Review) to wit: Section 2. Said reclassification is necessary for the following reasons: Reasoned Statement The rezone to R-2D (Combined Residential with Design Review) is consistent with the Boise City Comprehensive Plan. The Boise City Comprehensive Plan Land Use Map designates this parcel as Medium Density Residential (15 DU/acre). The Land Use/Zoning Consistency Matrix lists R-2 as a permissible zone for this land use designation and would allow for a maximum density of 14.5 DU/acre. The requested zone will facilitate development that is consistent with existing subdivisions in the area. Objective 10.1 promotes growth that is planned and directed in a way that minimizes sprawl and creates a functional and pleasing community. The proposed development helps in achieving this objective by making use of existing infrastructure and services. O-14-08

The rezone of the property will not adversely affect public services or place an undue burden on the transportation system in the vicinity. All necessary infrastructure is available to the site, with water and sewer available at Maple Grove Rd. The local, collector, and arterial streets in the vicinity of the site will continue to function at acceptable levels of service. Goal 7.1 encourages the development of an adequate supply of safe, sanitary housing at price and rent levels appropriate to the varied financial capabilities of City residents, and to provide for diversity in type, density and location of housing with special emphasis on maintaining neighborhood stability. Objective 7.1.1 establishes the need for additional attached single-family dwellings, and multi-family units to accommodate the needs of a growing population. The proposed zone change will support the growth demand in a manner that is compatible to surrounding development. (Policy 8.1.13.6) Section 3. The zoning maps of the City of Boise City, Idaho are hereby changed, altered and amended to include and insert the real property described in Section 1 hereof in the land use classification therein described.
