POLICY RESOLUTION No. 99-01 INSPECTION OF PELLET OR WOOD BURNING STOVES WHEREAS, Article V, Section 10 of the By-Laws states that "The Board of Trustees shall have and exercise all lawful powers and duties necessary for the proper conduct and administration of the affairs of the Association and the operation and maintenance of a residential Condominium project and may do or cause to be done all such other lawful acts and things as are not by law, by these By-Laws or otherwise, directed orrequired to be done -or exercised by members of the Association or owners of units, or by others." WHEREAS-, the - By-Laws requires each- member to- comply qtrictly with the By-Laws and the administrative rules and regulations adopted pursuant thereto as either may be amended lawfully from time to time; and WHEREAS, some units at Rolling Hills Condominiums have pellet or wood burning stoves with chimneys which are under the sole and exclusive control of the unit owner; and WHEREAS, the maintenance, repair and replacement of pellet or wood burning stoves with chimneys is the unit owner's responsibility according to governing documents of the condominium; and WHEREAS, it would be in the best interest of the unit owner of each unit in which a pellet or wood burning stove with chimney is installed, as well as the entire community, if the pellet or wood burning stove were inspected on a regular basis; and WHEREAS, the Board has determined that in order to promote safety and general welfare of the entire community, unit owners shall be required to have their pellet or wood burning stove with chimney inspected every year. NOW, THEREFORE, BE IT RESOLVED that the Board of Trustees hereby adopts the following requirement to enhance the safety of the members of the Association due to fire hazards and for the general welfare of the members of the Association: Prepared by: Alan Y. An annual inspection will be required as follows: (a) The owner(s) of each unit in the Association that is equipped with a pellet or wood burning stove with chimney shall be required to have the pellet or wood burning stave with chimney inspected by - October 31 of each year. (171 The- pellet or woad burning- stove-with a chimney shall be inspected by a qualified inspector. "Qualified inspector" means someone-regularly engaged in the cleaning and inspection of pellet or wood burning stoves and their chimneys, e.g. a chimney sweep. The owner(s) shall submit to the Association a certification of the inspection stating that their pellet or wood burning stove and chimney are properly functioning. Said certificate shall be submitted prior to October 31 of that year. (c) Should the pellet or wood burning stove or chimney be in need of maintenance, repair or replacement, such maintenance, repair or replacement shall occur prior to October 31 of that year. (d) The owner(s) shall also submit written documentation that the owner(s) obtained a permit from the municipal code enforcement officer authorizing installation of the pellet or wood burning stove and chimney. 2. If any owner fails to act in accordance with this Resolution, the owner shall be fined $25.00 per day thatthe - owner- does not provīcre- written proot of compliance with this Resolution. 3. Each 24 hour period in which the owner is in violation of this Resolution shall constitute a separate violation. Cumulative fines shall not exceed $1,000.00. 4. The Board of Trustees directs that this Resolution shall
