VEHICLE AND EQUIPMENT SALE INSTRUCTIONS TO BIDDERS: The City of Whitehorse is offering for sale, on a sealed bid basis, Surplus City Vehicles and Miscellaneous items identified on the attached Bid Sheets. Bidders may view the equipment at the designated times as identified below. Interested bidders may direct their questions by email to procurement@whitehorse.ca Hard copy of Bids can be dropped off in a sealed envelope clearly labeled with the Title: Bid Submission for RFT 2017-OPS0019 Vehicle and Equipment Sale along with the name and address of the person/company submitting the bid, at City Hall at 2121 2 nd Avenue, Whitehorse YT prior to 3:00:00 PM PDT on Friday August 11, 2017. Bids received after the closing date and time will not be accepted and will be returned unopened to the address on the envelope. The following listed units are being sold as is where is no warranty expressed or implied. Terms of the sale will be cash or certified cheque to the highest acceptable bid. The Freightliner Truck may be viewed on Thursday August 3, 2017 1:00 PM to 4:30 PM at 9030 Quartz Road. Items located at the Transit Yard (Buses) can be viewed by calling Mack Smith at 668-8355. Note that items 3-1 and 3-2 will be sold as one lot. The Weigh Scale can be viewed at the Landfill (Item 4) site by appointment by contacting Water and Waste Services at 668-8357. The City will provide a knowledgeable representative to provide basic information to the bidder and to answer questions. Pick-Up: The successful Bidder will be required to remove the equipment from the respective City of Whitehorse property on or before August 30, 2017 at 4:30 PM PDT upon presentation of official receipt signed by a City of Whitehorse representative as proof of payment. Advertising: All advertising is done in good faith; however, it is strongly recommended that each Bidder carefully inspect the item prior to bidding. The City of Whitehorse is not responsible for the bidders not to understand the condition of the vehicle(s) when bidding for a unit. Bids: The City of Whitehorse reserves the right to reject any or all bids or accept the bid that is deemed the most favourable to its interests. Note: Vehicles are subject to being withdrawn from sale and return to the City of Whitehorse s fleet at any time during the bid process up until the sale is approved by the City of Whitehorse. RFT 2017-OPS0019 GENERAL TERMS AND CONDITIONS Definitions: Seller means City of Whitehorse and Buyer/Bidder is the individual, firm or corporation who is purchasing Seller s property. Entire agreement: All sales will be subject to the provisions of this Agreement, including all attached Bid Sheets identifying prices, taxes or other terms specifically incorporated by reference and no others. This Agreement is the entire agreement between Buyer and Seller and supersedes all prior or concurrent oral or written representations and agreements relating to this sale. No modification of this Agreement shall be binding on Seller unless agreed to in a writing signed by an authorized representative of the Seller. Condition, Warranty and Location: Unless otherwise specifically provided, all property is offered for sale AS IS and WHERE IS. The description of property for sale is based on the best available information: however, no warranties or representations, express or implied, whether promissory or imposed by law, are made by seller as to the quantity, kind, character, merchantability or fitness for any use of purpose, except that Seller does warrant validity of title. Payment: Prior to removal, payment must be made in full in cash, certified cheque or bank draft, to the City of Whitehorse, and paid at City Hall located at 2121 2 nd Avenue in Whitehorse and must include GST. Payment must be received before August 23, 2017 or sale will be considered cancelled and the City will contact the next highest bidder for the item. Removal of Equipment: Upon completion of payment, winning bidders will have until 4:30 PDT August 31, 2017 to remove the equipment from the applicable City of Whitehorse site. Upon presentation of award letter with the payment receipt, the City Representative will provide a Bill of Sale to the winning bidder and release the equipment between the hours of 8:00 am 11:45am and 3:00 pm 4:30 pm, Monday through Friday. Title: Title to the items of property sold hereunder shall vest in the Buyer as and when full and final payment is made. Risk of Loss: All risk of loss, damage, or destruction from any cause, whatsoever, shall be borne by the Buyer. Use of Seller s Name: Buyer agrees not to advertise in any manner the property hereby sold as being, Seller s surplus property or to use in any other manner. Release of Liability: Buyer hereby indemnifies and holds harmless the Seller, its Council members, officers, agents and employees from and against any claim or liability, whatsoever, for loss of, damage to disposal, removal, resale of loss of use of any property whether purchased from Seller or owned or controlled by Buyer or for on account of any personal injury, including death, arising out of or in any manner connected with the sale, disposal, removal, resale or use of said property and further any acts or omissions of Seller, its officers, Council members, agents and employees.
