July is REALTOR Freedom Month RPAC, in conjunction with Local, State, and National Legislative Committees has helped keep banks out of real estate, has kept a tax on services from being implemented, and has helped build positive relationships with elected officials. RPAC is the REALTORS Political Action Committee. RPAC is the only political organization in the country solely dedicated to the protection of REALTOR interests. RPAC is nonpartisan in its selection of candidates. A contribution to RPAC is an investment in YOUR business and a commitment to preserving the future of our industry. Think of RPAC as insurance against bad legislation that could be catastrophic to your real estate business. Your investment helps support elected officials who support the free enterprise system and private property rights. The following example is for illustration purposes only. REALTOR RPAC closed five transactions last year with an average home price of $145,000. Her income for 2006 was $36,250. Now, imagine Oklahoma has a sales tax on services; REALTOR RPAC would pay an extra $2,500 of her income BACK to the Tax Commission because of the sales tax on service. Past RPAC contributions have kept a tax on services from happening. We are asking for you help in keeping RPAC strong and ready to assist candidates that support real estate interests. A small contribution of $25 helps ensure that the individuals who pass the laws that affect our livelihood believe in private property rights and the free enterprise system. Isn t a daily investment of seven cents worth the additional money in your pocket that results from an investment in RPAC?! Tulsa Public Schools (TPS) Boundary Changes TPS modified its intra-district boundaries for elementary, middle, and high schools in May, which affects about 30,000 properties on the tax rolls. The changes will take affect when school begins this August. TPS is opening Jones Elementary, located at 1515 South 71 st East Avenue, while closing Monroe Middle School; former Monroe students will now attend Gilcrease Middle School. It is recommended that associates immediately verify all their listings located in the TPS district for the correct grade, middle, and high school. The TPS Web site, http://ssearch.tulsaschools.org/tpslookup/lookup.aspx allows searching an address with a ZIP code to retrieve the individual schools for that property. Call TPS at (918) 746-6214, if you cannot locate the individual schools for your property. TPS posted a map on their Web site showing the location of all its schools; you can access it using the following link: http://www.tulsaschools.org/schools1/maps/boundaries.pdf. 4 July 2007

SSUES & By Janie Bays NSWERS There are SO Many Forms...Help! Q: What Listing Agreement should I use? A: You need to check with your broker to verify which Listing Agreement they want you to use. When using ZipForm, the Listing Agreements recommended by the GTAR Board of Directors, are found under the GTAR Libraries (GTARRES Greater Tulsa Association Residential and GTARCOM Greater Tulsa Association Commercial). Under the GTAR Residential Library, A502 MLS Listing Agreement Exclusive Right to Sell is recommended as it includes the language used in the Oklahoma Uniform Contract. Q: What residential contract should I use when writing an offer for a buyer? A: While you may use any contract your broker chooses, the one recommended by the GTAR Board of Directors is the Oklahoma Uniform Contract of Sale of Real Estate; there are two versions a small print, four-page and large print, sixpage. It is recommended that the large print version be used whenever possible since it remains readable after faxing multiple times. If you choose to use the Oklahoma Uniform Contract of Sale of Real Estate, you need to use the state forms designed to go with this document. Your broker should let you know which Broker Relationship forms you should use. Q: Why do I need to use the other state forms when using the Oklahoma Uniform Contract of Sale of Real Estate? A: The state forms should be used because they are written with the same terminology as the Oklahoma Uniform Contract. By using this terminology, there is less confusion and a clearer understanding of what is being referred to. As always, seek guidance from your broker. July 2007 5

Directors Actions This is a monthly feature which will report GTAR and NORES Directors actions from the previous month s Board of Directors meeting. GTAR Directors Directors approved the following changes to be made after further research has been completed. Paragraph 20 on the Single Family Residence or Condominium Lease. CONDOMINIUMS. It is recommended that The Tenant agrees to read the Condominium Rules and Regulations. Residential Property Management & Exclusive Right to Lease Agreement. That a paragraph entitled Other Conditions, with blank lines be added as appropriate. Directors also approved monies to be used for renovation of the Green Room so more staff may be added. NORES Directors Directors approved fines for a pending violation and for failure to respond. The following NAR Mandated Rule changes were reviewed and approved. Article 1 Section 15.0 Ownership of NORES MLS Electronic Data Compilations (hereinafter referred to as Data) and Copyrights. By the act of submittingssion of any property listing content data and photographs (regardless of who takes and/or submits the photograph) to the NORES MLS, the Participant represents that he/she has been authorized to grant and also thereby does grant authority for GTAR NORES to include the property listing data content in its copyrighted NORES MLS compilation database and also in any statistical report on comparables utilizing the NORES MLS Database. Listing content includes, but is not limited to photographs, images, graphics, audio and video recordings, virtual tours, drawings, descriptions, remarks, narratives, pricing information, and other details or information related to listed property. Article 1 Section 17.2e. Participants may exclude select the listings they choose to from display on their IDX sites based only on objective criteria including, but not limited to, factors such as geography ( uptown, downtown, etc.), list price, type of property, (e.g., condominiums, cooperatives, single-family detached, multi-family), or cooperative compensation offered by listing brokers, type of listing (e.g., exclusive rightto-sell, exclusive agency, or open listing), or the level of service being provided by the listing firm. Selection of listings displayed on any IDX site must be independently made by each participant. Examples include property type ( condos, single family detached, multi-family, etc.) price or location ( downtown ). The following changes to Article 1, Section 3.12 of the Rules and Regulations were approved by the Directors. Article 1 Section 3.12 Square Footage. Square footage can only be quoted in the Square Footage field or House Size (Range) fields or in the Media fields. The square footage listed in Media must match the square footage in the Square Footage field of the listing. Participants and Users shall not report square footage in any other field (including square footage of a room addition, etc.) The following revisions to the Property Data Form were approved by the Directors. Add missing lakes to Lakes/Rivers field + Claremore Lake + Oologah Lake + Etc. Add to Lakes/Rivers field Distance from Lake or River ; this will be required if a Lake/River is selected. Distance choices will be as follows: + Frontage + Less than 1 mile + Less than 5 miles + Less than 10 miles Industry professionals pronounce it correctly. Directors Actions continued from page 6. The following Policy was approved by the Directors. DKey Loaner Key Policy If an associate with an Ekey needs repair of their device, the associate may obtain a loaner Dkey and cradle for two weeks upon payment of a $100 deposit (the $30 processing fee will be waived) from the associate and completion of a key agreement by them without the broker. If the Dkey is needed for longer than two weeks, the user must notify the NORES office for an extension. If, after two weeks, an extension has not been requested, a broker s signature will be required for reactivation of the Dkey. The Ekey capabilities will be turned off and will not be turned on until the return of the Dkey and cradle; upon return of the Dkey and cradle the deposit will be returned. NORES will be responsible for keeping track of the time and date the DKey is loaned and returned. Directors approved the Sales Concession Task Force s recommendation that when a property is entered as Pending status on MLS, the closing costs, yes or no field will be a required field. A concession is defined as an expense paid by the seller that is normally paid at the time of closing by the buyer. ASSOCIATION BULLETIN BOARD GTAR/NORES Office Closed Tuesday, July 10 and 31 The GTAR/NORES office will be closed from 8:30 a.m. to 12:00 p.m. on Tuesday, July 10 and 31 for staff training. IDX Listings Brokers/Managers: Please remind your associates that they must select on the Property Data Form Internet list = yes as well as address public = yes to have their listings displayed on IDX sites with addresses. Selecting no for the address public field will still result in the listing being displayed on IDX sites; however, there will be no address. Selecting no for Internet list will result in their listing NOT being sent to IDX. GTAR/NORES Policy on Reporting the Death of a Member When GTAR/NORES staff is notified of the death of a member, active or inactive, the member s name is published in the upcoming GTAR World newsletter under a heading entitled In Memoriam. If funeral service information is provided to staff, a broadcast notice is immediately posted on IMS to share the information with all members. Effective June 2007, an email will also be sent to all GTAR brokers and managers to notify them. July 2007 7

Other Important Changes Coming to MarketLinx Another change that will be occurring is to the Home Page of the MarketLinx system. Your current Home Page looks like this: Your new Home Page will look like this: The top section will display information that NORES adds. You can customize your desktop to display one of four ways, as shown below: Layout Options 1: NORES Home Page only 1-2: NORES Home Page and another category of your choice 1-3: NORES Home Page and 2 additional categories of your choice 1-4: NORES Home Page and 3 additional categories of your choice (As displayed in the example of the new Home Page above.) MarketLinx Changes continued from page 8. Photos Photo max is changing. You will have the ability to add 12 photos to each listing (rather than 8)! New Report MarketLinx will add a new report button to the bottom of your search results page titled Combo Report. Select/check the properties you are interested in and click the Combo Report Button. The Combo Report will appear: Upper Left Properties display in a one-line format. Move from one to another using the arrows: Upper Right Displays the photos of the property currently selected in the Upper Left. Browse through photos by using the arrows: Lower Left Displays MLS property information OR tax information for the property currently selected in the Upper Left. Change display by clicking the pull-down menu in the upper left of this section: Lower Right Displays a map and indicates the location of the property currently selected in the Upper Left.
