BACKGROUND/RELATED STRATEGIC GOAL: On December 10, 2002, the School Board of Martin County and Martin County entered into a Lease Agreement with an Option to Purchase regarding the joint development of the Jensen Beach High School and expansion of the County s Pineapple Park. Under the terms of the Option Agreement, Martin County contributed $900,000 to the School Board towards the purchase of the property and the School Board agreed to lease a portion of the property for 99 years, with an option to purchase the Pineapple Park Expansion property for $1.00. Paragraph 9 of the attached Interlocal Agreement sets forth the terms of the Option. Title reports have confirmed ownership is with the School Board of Martin County and that there are no mortgages on the property. A Phase 1 Environmental Site Assessment was completed on July 22, 2004 stating There were not any Recognized Environmental Conditions. ISSUES: Martin County standard procedures are to conduct an Environmental Site Assessment prior to acquisition. In this case, because the County has occupied the site since the assessment conducted on July 22, 2004, staffs opinion is to not conduct a new Environmental Site Assessment. Sec. 139.31 and 139.32, General Ordinances, Martin County Code require that any conveyance of an interest in land to Martin County for any public purpose shall be accepted and approved by resolution by the Board of County Commissioners of Martin County. RECOMMENDED ACTION: RECOMMENDATION That the Board adopts a resolution accepting the Special Warranty Deed from the School Board of Martin County for additional land at Pineapple Park on Jensen Beach Blvd. ALTERNATIVE RECOMMENDATIONS None FISCAL IMPACT: RECOMMENDATION Recording costs not to exceed $30.00 and $1.00 option money. BEFORE THE BOARD OF COUNTY COMMISSIONERS MARTIN COUNTY, FLORIDA RESOLUTION NO.: WHEREAS, the Martin County Board of County Commissioners has approved accepting a Special Warranty Deed for Pineapple Park in Jensen Beach, from The School Board of Martin County, Florida for a public purpose; and WHEREAS, it is required that the Board adopt a resolution accepting the deed at the time of closing. NOW, THEREFORE, BE IT RESOLVED BY THE MARTIN COUNTY BOARD OF COUNTY COMMISSIONERS, THAT: The Martin County Board of County Commissioners hereby accepts the Special Warranty Deed from The School Board of Martin County, Florida to Martin County.
