Recreation Reserve 20.7ha GAZ83-2092 RES 2598 BLK IV WAIPARA SD, BLK IV WAIKARI SD Hurunui Racecourse Reserve Committee Background The Hurunui Racecourse Reserve was historically used as a racecourse for 1884, serving the population of the Medbury, Hurunui and Peaks Districts. The last race meeting of that period was held in 1938. In more recent times there has been renewed interest in the reserve for horse related recreational activities. The Hawarden Waikari Pony Club lease a portion of the Reserve, this lease was renewed in April 2006 for a further 10 years. The balance of this land comprising of 20.7ha is leased for grazing purposes. The Reserve is a recreation reserve within the meaning of the Reserves Act 1977. A lease of a Recreation Reserve can be issued under Section 73(3) of the Reserves Act. Lease information The lease agreement is for the grazing purposes and will run for a term of 3 years with a right of renewal for a further 3 years, in accordance with the Council leasing policy. Annual rates are payable by the lessee. The current annual rates are $1006.50. Pursuant to the Reserves Act the Council s intention to lease the reserve and to who needs to be publicly notified giving one month for submissions or objections to be received. The Tender process The advertisement calling for tenders of the lease commences on 5 th October 2013. Tenders close on Thursday 24 th October 2013 at 4pm. The Hurunui Racecourse Reserve Committee considers the tenders received. Contact is made with the successful tender and all other tenders are notified. Public notification of the Council s intention to lease the Hurunui Racecourse Reserve and to who is advertised giving one month for submissions or objections. Provided no objections received the lease will commence on 1 st December 2013. PLEASE NOTE: THE HIGHEST TENDER MAY NOT NECESSARILY BE ACCEPTED. LO101 HURUNUI DISTRICT COUNCIL LEASE OF RECREATION RESERVE Whereas the Mayor Councillors and Inhabitants of Hurunui (hereinafter referred to as the Lessor) have under the provisions of the Reserves Act 1977 authorised a lease to be issued to NAME (hereinafter referred to as the Lessee) over part of that Reserve 2598 situated in Block IV Waipara Survey District and Block IV Waikari Survey District and being 20.7 hectares more or less and as per highlighted on attached map. NOW THEREFORE the Lessor doth hereby lease and authorise the Lessee to occupy the said land for a term of three (3) years commencing 1 st December 2013 with a right of renewal at a revised rental for a further three (3) years. SUBJECT TO the payment of an annual rental of $------ inclusive of GST due on the 1 st December 2013 and thereafter as invoiced. AND SUBJECT ALSO : to the following conditions, viz 1. THAT the Lessee will at all times pay punctually the rent as hereinbefore provided. 2. THAT the Lessee will pay all rates and other charges that may lawfully be imposed on him. 3. THAT the Lessee will use manage and maintain the said land in a good and tidy state of repair to the satisfaction of the Lessor and any agent thereof. 4. THAT the Lessee will at no time use the reserve for the purpose of grazing any stock other than sheep. 5. THE lessee will allow public to have access on foot at all times over land that is not in crops or new grass. 6. THE Lessee shall not erect any buildings on said land without prior written consent of the Lessor. 7. THE Lessee shall keep the said land free from gorse broom noxious weeds rabbits and other vermin. 8. THE Lessee shall keep all fences gates drains and other improvements now or hereafter upon the said land in good order condition and repair. 9. THE Lessee shall not assign, sublet, transfer, mortgage or part with possession of the said land without the prior consent in writing of the Lessor.

10.THAT the Lessee shall have no right to any mineral on or under the said land and shall not work or use any such mineral without the prior written consent of the Lessee. 11.THE Lessor reserves the right to enter upon the said land for the purposes of inspection. AND it is hereby agreed and declared as follows : 1. THE Lessee and the Lessor shall not be liable for any accident or injury or damage suffered by or caused to any person or property arising out of or by reason of the use of the said land by any members of the public or during the course of any specific events or the erection of any buildings or the use of any equipment on the said land. 2. THE Reserve is to be used predominantly for grazing. Cropping may be carried out on up to 6 hectares per year and to be at such times so as not to unduly restrict public use. The race track will not be cultivated nor the area around the buildings. A minimum of 1.5 tonnes of phosphate based fertiliser per annum is to be applied to the 6 hectare area. 3. IN terms of the Reserve Management Plan recreational user groups may stage specific events for up to ten (10) individual days per annum. Any user group wishing to use the Reserve for a particular activity or event shall in the first instance make application to The Hurunui Racecourse Reserve Committee who shall consult with the Lessee. 4. A current Lease to the Hawarden Waikari Pony Club is in existence for the area as defined by approximately 2.8 ha. The use of the balance of the Reserve by the Club for extended events must be by arrangement with the Lessor. 5. THE Lease may be terminated by either party upon thirty (30) days written notice, either for breach of any conditions herein or if the said land is required for recreational purposes. Upon termination the Lessee shall have no right to compensation for any improvements upon the land and all areas to be left re-pastured. AND it is hereby declared this lease is intended to take effect as a Lease under the Reserves Act 1977 and that provisions of that Act applicable to such Leases shall apply to these presents.
