On June 29, 2017 MSO Kate Novia attended 2625 Keele Stied to conduct an inspection at the request ol Tony Maute (the bui ding owner s son) with regards to an Exterior Order that was issued on May 16, 2017, as a result of a building audit that was conducted on May 9, 2017. I)uri ng the inspection, MSO Novia noted that the steel lintel above the garage doors located at the ear of the building was bending. MSO Novia noted that approximately 6 rows of brick/mortar above the lintel was breaking and deteriorating, the brick wall above the lintel appeared to he saggi 1g. MSO Novia advised Mr. Mauti that she would be forwarding her concern to the City s building department, as well as issuing an Order as she was concerned about the structure. On June 30, 2017 MSO Novia sent an email to a senior building inspector for l3lobicoke/york District, Dino Coletti. On.1 uly 5, 2017 an Order was issued to the property owners reqtnring they address the concerns MSO Novia noted from her Jtiiie 29, 2017 inspection. On July 27, 2017 alter the Order expired, MSO Novia conducted a c-inspection of the property. rvrso Novia noted that the wall above the garages had not been addressed. Novia observed a large crack in the column of bricks located between the garages. In acldi toil, at this tine M SO On August 2, 2017 MSO Novia teeeivecl tn email from Di no Coletti, senior btn Idi ng inspector for Etobicoke/York District, advising that the building was not unsafe but that the sepa irs shoti Id he cormcted immccl iately. - In response to Tony Mauti s appeal letter: I ) Officer Novia is a property standards officer for the City of Toronto and under the 0111 ario l3tti cling code section 15.2 has the authority to issue a Property Standards Order. 2) The Order to which Tony Matui is referring to that previously addresses these issues, was closed a year ago, that Order has no weight on the matters before the comini t tee today. B nt Idi ngs deteriorate over time and it is entirely possible that this conch lion has worsened since the last City inspection. 3) The argument of es judicata and the doctrine of issue esptoppel does not apply ii this Situation. The Order before the committee today addresses a ci ifferen t concl tion I han the previously issued Order. Previously issued Orders are irrelevant. 4) MSO Novia is not aware of any abuse of process.
MUNICIPAL LICENSING & STANDARDS PROPERTY STANDARDS COMMITTEE STAFF REPORT 5) This Order was issued under section 15.2(2) which states an Officer who linds a properly that does not conform with any of the standards prescribed in the by law may issue an O der. 6) On June 29, 2017 Tony Mawi advised MSO Novia that he was not going to acklress her concern, as lie believed that the issue had already been fixed. MSO Novia issued a 4 day Order to the property owner as she believed that the condition appeared serious. Upon receipt of MSO Novias request to have a building inspector attend the building 10 inspect her concern, bu Idi ig nspector Di no Colelti advised that the bui Icling was not unsafe but that the matter should be corrected immediately (see copy of email attached). Pictures from June 29, 2017 (original inspection), as well as photos from last inspection conducted on Monday, September 25, 2017, attached for your reference RECOMMENDATION: Order confirmed as written.

A few weeks ago I requested a building file be created for 2625 Keele Street, as I had some concerns regarding the rear wall o( the building above the garages. I attended the property yesterday and observed that thus far the owner has done nothing to try and remedy the wall. You can see from the pictures attached to the BMS file (17 191516) the lintels above the garage doors are bending and the brick work is deteriorating. Yesterday, during my inspection it appeared to me that the brick column between the garages has also started to shift and is cracking/separating. I have issued a Part ill charge as the Owner has failed to comply with my Property Standards Order which expired on July 24/2017. C)
Due to my concerned that this structure will continue to deteriorate as time goes on and the Owner does not appear to be addressing it, I have copied Dino Coletti as I can see that you are on vacation.
