For $75.00 party, you get the key for 4 hours, maximum of 5 hours. If your party is from 7:00 p.m. to 10:00 p.m., you can have the key from 3:00 p.m. to midnight. *(You can also get the key the day before to do initial set up. Contact Joe Zimmerman. The $150.00 fee is for people who have to set up and want typically to leave the ending time of the party open. Fees subject to change at the discretion of Wexford Club management. WEXFORD CLUB, INC. RENTAL AGREEMENT 1. The Clubhouse is for the exclusive use of Wexford Homeowners who are residents and their guests. Maximum occupancy of the Clubhouse is 99 people. The renter must be a homeowner and resident in Wexford. To reserve the Clubhouse, the homeowner/resident must be in good standing with the Wexford Homeowners Association, also known as Wexford Club, Inc. The homeowner status will be verified by the Clubhouse Committee Chairperson in conjunction with the Management Company. The Clubhouse Committee and the Wexford Board of Directors retain sole discretion in approval of events and usage of the Clubhouse. The Clubhouse Committee will appoint, and the Board of Directors will approve, an Activities Coordinator for a term of 1 year. The Activities Coordinator will be responsible for scheduling rentals, coordinating a master calendar, collecting fees, deposits, rental forms, and performing initial walkthroughs and inspecting premises after events. The Clubhouse Committee Chairperson and/or Clubhouse Committee Board Liaison may also perform these duties. In the event of damages, thefts, or fines levied, the Management Company will assess the cost of repairs in the event of damage, the cost of replacement if theft, and the amount of the fine in the event of a fine (See Closing Procedures). Any fee charged by the Management Company to coordinate this procedure will be the responsibility of the renter. 2. The resident/homeowner responsible for scheduling the use of the Clubhouse must be present at all times while the scheduled function is in progress. The resident/homeowner is also responsible for supervising anyone under the age of 21; a ratio of 1 adult for every 8 people under the age of 21 is required. 3. Rental of the Clubhouse must be scheduled through the Clubhouse Activities Coordinator or the Committee Chairperson. Scheduling of events should be made at least three weeks prior to the event. Cancellation of a rental agreement will result in the following assessment: a. Three weeks (21 days) of more prior to a party: Contract voided and checks returned. b. Seven to thirteen days prior to a party: Contract voided, rental check returned, and one-third of the rental fee being assessed against the damages/fines deposit. c. Fourteen to twenty days prior to a party: Contract voided, rental check returned, and $25.00 fee assessed against the damages/fines deposit. d. Less than 7 days prior to a party: Contract voided, rental check returned, and one-half of the rental fee being assessed against the damages/fines deposit up to $200.00. Assessed against the damages/fines deposit means that the damages/fines check will be deposited and then once the check clears, a check will be issued for the amount of the difference. The difference is the damages/fines deposits minus the cancellation fee assessed. The Activities Coordinator or Clubhouse Committee Chairperson will have the discretion to waive the fee if the event is cancelled due to unforeseen circumstances. A reservation request form along with the Clubhouse Rules, Regulations, and Closing Procedures will be forwarded to the resident requesting the rental. The Reservation form must be filled out and returned with 2 separate checks: A refundable damages/fines check and another check which is in the amount of the rental fee plus the cleaning fee. Wexford Club, Inc. will determine the cleaning service to be used. Also, Wexford Club,
Inc. is charging only what we are charged by the cleaning service. All fees are printed on the reservation form. No reservation will be confirmed until the checks are received. WEXFORD CLUB, INC. RENTAL AGREEMENT 4. The damages/fines check will be returned after the Clubhouse has been inspected by the Activities Coordinator or Chairperson or Board Liaison. Inspection will be within 24 hours of the function and before the cleaning service arrives. In the event of any damages or missing property, the Management Company will be contacted and will be responsible for assessing the value of damages and/or theft. Fines/Fees can be assessed by the Clubhouse Committee according to the schedule and lack of compliance with the closing procedures. Any expenses, damages, or fees/fines incurred as a result of the event will be deducted from the damages/fines deposit check. Any of these same expenses or damages or fees/fines that exceed the damages/fees deposit will be assessed directly against the homeowner and will be treated as an assessment. 5. Hours for the Clubhouse rental are from 9:00 a.m. through 11:00 p.m. Sunday through Thursday and 9:00 a.m. through 12:00 a.m. Friday and Saturday. These hours are subject to the contract rental type. Example: If the party is a four-hour type party, then that must be adhered to as well. Extension of these hours for any reason other than a Homeowners Association function requires written approval of the Clubhouse Committee. The renter must abide by all state and local laws and/or ordinances including, but not limited to, the city noise ordinance, Code 10-1. Failure to abide by these rules may result in a penalty of up to the deposit fee. The Activities Coordinator and/or the Clubhouse Chairperson and the renter, will conduct a walk-through of the Clubhouse prior to the event to insure proper usage of appliances, temperature controls, locks, the alarm and other items as stated in the Closing Procedures. 6. Neighborhood functions have first priority on the Clubhouse Calendar. 7. Animals are not ALLOWED in the Clubhouse and in the pool area. 8. Do not use thumbtacks, nails, staples, glue, or any device to attach anything to the walls, doors, furniture, trim, etc. The renter must use clear tape. Furnishings are not to be taken outside. If damage occurs through this type of use, repairs will be made and deducted from the damages/fees deposit check. 9. Absolutely no smoking in the clubhouse, no fires in the fireplaces including Dura logs, no firearms, and no fireworks. Votive candles only are permitted. 10. Keep music and noise at an acceptable level so as not to disturb the Clubhouse neighbors as referenced in #5 above. 11. Alcohol may only be consumed by those residents and their guests who would otherwise be a lawful consumer under applicable city, county, and state laws. The present minimum age is 21. By allowing
private consumption of alcoholic beverages at Clubhouse functions by homeowners and their guests, Wexford Club, Inc. does not assume liability in any form, implied or otherwise, that may arise as a result of said consumption. Any damage done to the Clubhouse or Clubhouse grounds caused by any behavior of any guest of an event will be deducted from the damages/fines check and when exceeded, further assessed to homeowner.
WEXFORD CLUB, INC. RENTAL AGREEMENT 12. NO GAMBLING of any design or type is allowed on/in the property of the Wexford Club Homeowners Association ever due to the Georgia State laws. 13. No public event shall be held in the Clubhouse for monetary gain or benefit to any individual whether or not that individual is at the function. No fee can be charged for entrance to the function, event, or party. In the event it is determined by the Clubhouse Committee that such a fee was charged, a penalty in the amount of $500.00 will be assessed against the resident and Clubhouse privileges will be revoked. Such a fine will be treated as an assessment, as said term is used and defined in the Covenants and By Laws. 14. The Clubhouse key may be picked up from the Clubhouse Coordinator on the day of the event at a time agreed upon and written on the rental agreement. The key must be returned immediately following the party. In the event the key is lost by the resident, the cost of re-keying all the locks will be deducted from the deposit and further assessed against the homeowner. In addition to the cost of re-keying, there will be a cost of $55.00 per lost key. 15. The Clubhouse Closing Procedure Checklist will be given to the resident renting the Clubhouse to help insure proper cleanup and closing of the Clubhouse. 16. Rental of the Clubhouse does not include the pool, pool area, or the surrounding common grounds. The patio can be use if rented for the fee shown on the Fees Page. 17. Rental of the Clubhouse does not guarantee a working stereo. If it is functional then it may be used but the rental fee does not guarantee the operation of the stereo. The rental key opens the stereo closet. This closet must be locked when the Clubhouse is vacated. 18. Homeowner/resident agrees to indemnify and hold harmless the Association, its officers and directors, agents including all committee members, and employees from and against any and all claims, liabilities, losses, damages, actions, costs, expenses and demands of any party made against the Association, its officers and directors, agents including all committee members, and employees arising out of or in connection with any party or event held in the Clubhouse by a homeowner pursuant to the Reservation Agreement or otherwise. I understand and agree to all the above conditions in renting the Wexford Clubhouse.
