Since 1985, approximately 41 R-1 to R-4 zoning change request have been approved in Rainbow Springs Heights subdivision. Request The applicant requests a rezoning from R-1 to R-4 as specifically described in the Land Development Code (LDC) Article 2, Division 7 Zoning Change. The applicant is requesting this rezoning to allow for manufactured home placement, which is allowed in the R-4 zoning category. Analysis In reaching its decision, the Planning & Zoning Commission shall find that the following exist: a. Granting the rezoning will not adversely affect the public interest. The subject property is surrounded by vacant and improved R-1 and R-4 zoned lots, rezoning the subject property for the intended use of manufacture home will not adversely affect the public interest. b. The proposed zoning change is consistent with the current Comprehensive Plan. The subject property is located in the Rainbow Springs Heights Subdivision which is eligible for continued development at its 'urban density' as a Subdivision of Record under the provisions of FLUE Appendix A-4. The requested R-4 (Residential Mixed Use) zoning is consistent with the site's recognized subdivision density and consistent with the Comprehensive Plan. Therefore, the proposed zoning change is consistent with the Comprehensive Plan. c. The proposed zoning change is compatible with land uses in the surrounding area. The subject property is surrounded by vacant and improved R-1 and R-4 lots with Rural land use. The R-1 zoning classification restricts residential dwellings to site-built single family homes and manufactured buildings (State of Florida DEO-certified) but does not permit standard manufactured homes (Federal HUD-certified). Granting the R-4 zoning classification will be compatible with land uses in the surrounding area. 2
