TERMS AND CONDITIONS 1. The Provisional Allotment of the Said Premises on the basis of an application is entirely at the discretion of the Company and the Company has a right to reject any application without assigning any reason and notice thereof. 2. The Earnest money constitutes 15% of the total payment of the said premises and the same is not refundable. 3. Timely payments assure the execution of the Memorandum of Understanding. Any default in paying regular monies to the developer as per the plan so opted, shall delay the execution and performance of MOU. 4. All payments are required to be paid by the Applicant(s) through Cheques and Demand Drafts in favour of Concept Horizon Infra Pvt. Ltd. payable at New Delhi. All payments are subject to realization. 5. The Said Premises shall be used only for the purpose sanctioned by NOIDA/Greater Noida and other government authorities and for no other purpose. 6. The said premises are governed by the laws applicable and in force for the time being and any other laws which may come into effect. 7. That the detailed terms and conditions in regard to the said unit are contained in the Memorandum of Understanding to be entered between the parties and the same shall be binding on both the parties thereto. 8. Any and all disputes arising out of or in connection with or in relation hereto shall so far as possible, in the first instance, be amicably settled between the Company and the Applicant. In the event of disputes, claim and/or differences not being amicably resolved such disputes shall be referred to arbitration by a sole arbitrator to be appointed by the Company. The proceedings of the Arbitration shall be conducted in accordance with the provisions of the Arbitration & Conciliation Act, 1996, as amended from time to time, or any rules made there under. The venue of the arbitration shall be New Delhi, India. Courts in New Delhi alone will have the exclusive jurisdiction to the exclusion of all other courts in accordance with the laws of India.
