Glades County Instructions and Application Procedures Plan Amendments Small Scale Plan Amendments are changes to the Future Land Use Map designation of properties 10 acres or less in size, or, in some situations, of properties 20 acres or less in size. Amendments to properties between 10 and 20 acres in size may be considered Small Scale if the change is to allow development of a use identified as a Qualified Target Industry. Please check with the Community Development Department (Department) prior to completing the application if you are proposing to change the designation of a property between 10 and 20 acres. Large Scale Plan Amendments are those that involve changes to property greater than 10 acres if not for development of a Qualified Target Industry or 20 acres if for a Qualified Target Industry. The process of approval differs between the amendments. Small Scale amendments go through a local approval only and Large Scale amendments go through local and State review. Please note that it is the applicant s responsibility to make the case. The applicant must provide a complete and accurate application, address the standards relevant for the type of land use change requested, and provide sufficient information and reasons based on the County s Comprehensive Plan and Land Development Regulations to indicate why the requested action should be granted. STEP 1. The Applicant (person requesting the land use changes) must submit all of the items listed in the Required Items List to the Department. You will be notified when the application has been deemed complete and staff sufficiency review has begun. STEP 2. After review and approval of the submitted items, the Department shall set the public hearing dates for the P&Z Board and BCC. The Department shall send the Notice of Public Hearing to the newspaper, the applicant, and the property owner, as applicable, at least 2 weeks prior to the P&Z Board hearing date. The Notice will identify the dates and times of both hearings. STEP 3. Upon receipt of the Notice of Public Hearing, the applicant shall immediately mail a copy, by Certified Mail, Return Receipt Requested, to all property owners within 300 feet of the boundary of the Parcel, and shall submit the signed receipts to the Department. The County will post a sign advertising the hearing dates on the property. Plan Amendment 1
STEP 4. A public hearing will be held before the P&Z Board to consider the petition. Typically, the public hearing before the BCC will be held a month after the P&Z Board hearing. For Small Scale amendments, the P&Z Board will make a recommendation of approval or denial of the application to the BCC. The BCC will either approve or deny the application. For Large Scale amendments, the P&Z Board will make a recommendation to the BCC for the approval or denial of the transmittal of the application to the State. The BCC will then approve or deny the transmittal of the application to the State. The applicant, or their agent, is required to attend these public hearings. The Boards will not accept lengthy technical reports or other written materials the day of the meeting. Submit all supporting documentation with your application otherwise your hearing date may be continued and you will be required to pay a re-advertisement fee. STEP 5. After the Board of County Commissioners public hearing of a Small Scale amendment, the Community Development Department will mail the applicant a notice stating whether that the application was denied or approved. If approved, a copy of the Ordinance, as filed with the Clerk of the Circuit Court, will also be enclosed. At this point, the Small Scale process is complete. For a Large Scale amendment, if approved for transmittal, the Department will mail the application to the various State departments for review within 10 days of the public hearing. If transmittal is denied, a letter indicating the denial will be mailed to the applicant. STEP 6 Large Scale amendments. After the State s review period of the application is complete, the application will be placed on a BCC daytime agenda for the adoption hearing. A new Notice of Public Hearing will be placed in the paper by staff and mailed to the adjacent property owners by the applicant. The public hearing before the BCC is for approval or denial of the application. Notice of the decision will be mailed to applicant. The process to challenge a Small Scale plan amendment is outlined in State Statutes, 163.3187(5)(a). The process to challenge a Large Scale plan amendment is outlined is State Statute, Chapter 163.3184(5). Plan Amendment 2
Submittal and Hearing Schedule A completed application, supporting documents and appropriate filing fee must be submitted by the application deadline in order for the application to be scheduled for the next available hearing date. Incomplete applications will not be scheduled until they are complete. Applications received after the deadline will be held until the next month so that legal notice requirements can be met and sufficient time is allowed for review and report preparation. Required Items List Please submit only one copy of each for the initial staff review. After staff review is complete, and prior to the first public hearing (and third for Large Scale amendments), the applicant will be contacted and will be required to supply further copies of the information. For applications involving Small Scale amendments, twelve (12) copies. For application involving Large Scale amendments, twelve (12) copies prior to the first public hearing and then three (3) copies are required prior to the third (adoption) public hearing. BE ADVISED THAT YOU MAY BE REQUIRED TO SUBMIT AN ELECTRONIC COPY OF ALL INFORMATION. All map exhibits shall be provided on 11 X 17 sheets, drawn legibly at an appropriate Plan Amendment Application (form attached). Traffic Generation Report. A legal description and survey sketch by a Florida Licensed Engineer or Surveyor of the property that is the subject of the application (Subject Site). If the Subject Site is only a portion of the property, also submit a legal description and survey sketch for the parent tract and any easements to the Subject Site. Legal descriptions shall also be emailed to jallen@myglades.com. Aerial photograph or tax map overlay of affected area, highlighting the area of the Plan Amendment. A copy of a recorded deed indicating current ownership of the subject property. Title search, opinion on title, or title insurance policy for the property. Proof that all County taxes have been paid. List of names and addresses of all property owners within 300 feet of the property taken from the latest Glades County ad valorem tax records. If the subject property is adjacent to a street, canal or the like, the 300 feet distance begins from the opposite side of the street or canal.
