KENDALL OVERLOOK CONDOMINIUM, INC. PROCEDURES FOR REQUESTING ARCHITECTURAL CHANGES UNIT OWNERS WILL: Exhibit A 1. Check the attached Kendall Overlook Condominium Inc. Architectural Rules and Regulations (Exhibit A ) 2. Obtain the architectural change application and the waiver (Exhibit B ) from the clubhouse as well as the Long Reach application as instructed in Exhibit C. 3. Complete applications, the waiver and any additional information required by the Rules and Regulations. This may include a plat showing the location of the change. 4. Forward copies of the completed application and necessary documentation to the community association manager. THE COMMUNITY ASSOCIATION MANAGER WILL: 1. Review, date and assign numbers to the application and all accompanying documents. If not complete, the application will be returned to the Unit Owner. This begins the 30-day period for review and decision. 2. The community association manager will notify the Architectural Advisory Committee that an application has been completed and is ready for your review. They will call Leon Thomas at 410-953-6085 or email to leontor@comcast.net. 3. The community association manager should send a letter to Unit Owners advising them of the decision after all steps are completed. A copy will also be sent to the Architectural Advisory Committee. 4. Keep a record of all decisions. ARCHITECTURAL ADVISORY COMMITTEE WILL: 1. Receive the application from the community association manager. 2. Visit the site for all structural change applications. 3. Provide a recommendation to the Kendall Board of Directors. 4. Check for compliance after the owner makes the approved changes. BOARD OF DIRECTORS WILL: 1. Review and vote on Architectural Advisory Committee s recommendation. 2. Send approvals or denials to the community association management company.

KENDALL OVERLOOK CONDOMINIUM, INC. ARCHITECTURAL RULES AND REGULATIONS The Kendall Board of Directors is responsible for upholding the character and use of their community. With that comes the responsibility to uphold and enforce the covenants, conditions, and restrictions in our condominium declarations and bylaws. In so doing, they are protecting our properties from deteriorating physically, sustaining/increasing property values, and maintaining an essential harmony and attractiveness for both the economic and personal well being of all owners. As homeowners, we are depending upon the Board to maintain the integrity of our investment. For those of who have never resided in a restricted community, living with these conditions is new; for those who have, it should be somewhat familiar. When we purchased our respective homes, we signed a Homeowners Association Rider to the Agreement of Sale, acknowledging that we received the declaration of covenants, conditions, and restrictions governing our condominiums. Thus, we made a commitment to abide by the requirements and restrictions spelled out in these governing documents. The following rules and regulations encompass the rules in the condominium covenants and bylaws as well as those of the Village of Long Reach Architectural Guidelines. They are meant to assist homeowners when asking for any exterior changes to their individual units. The Kendall Board will use this document to review homeowner s application for changes to the exterior of their homes. Each application will be reviewed individually with a written decision sent to the requesting homeowner. Our goal is to ensure that the original architectural character of each unit in Kendall Overlook shall remain consistent with itself and others around it. To maintain the original continuity of the community, no portion should be changed or added to that would conflict with or alter the character of the structures. There are certain changes that can be made without submitting an application and they are spelled out in the rules and regulations. However, some changes may be found to be unsuitable, based on the general purpose and criteria previously stated. Such cases are expected to be rare, but may require Unit Owners to alter or remove such changes. Other changes will need an application. In addition, some modifications are not permitted at all. When the Board approves a change, the responsibility for maintenance, repair, or replacement of any alteration or addition belongs with the Unit Owner. In addition, the unit owner shall be responsible for any damage to the common elements resulting from the construction, installation, or use of the approved change. 2

The following is a summary of the definitions found in Article I of the Kendall Overlook Condominium Declaration and throughout the Kendall Bylaws that will be referred to in this document: UNIT: Each Unit is bound by the outer surfaces of the home and the middle of any wall shared with another unit. It also includes any deck constructed by the developer, any areaways, heating/air condition units, driveways, stoops/lead walks, and any adjacent railing. These features must be maintained, repaired, and replaced by unit owners. REFERENCE: Kendall Overlook Condominium Declaration, Article I (af); and Kendall Overlook Condominium, inc. Bylaws, Article XIII COMMON ELEMENTS: All the outside elements are owned jointly by the unit owners of the condominium. These include streets, sidewalks, designated green areas, streetlights, etc., most, of which the condominium is responsible for maintaining, repairing, and replacing. REFERENCE: Kendall Overlook Condominium Declaration, Article I (b); and Kendall Overlook Condominium, Inc. Bylaws, Article XIII, Section 2 LIMITED COMMON ELEMENTS: Unit owners DO NOT OWN individual yard areas, front, back or side. For any permanent improvements to the front, back and side yards, unit owners must complete an application and follow the approval process. 3

RULES AND REGULATIONS MODIFICATIONS NOT ALLOWED Swimming Pools Fences Basketball apparatus Hot tubs Decks (other than contractor installed) Window air conditioning units Clothes lines Animal runs/houses/doors Children s play equipment on porches, patios, decks and limited common areas Sheds/large storage units/greenhouses Painting of exterior surfaces/windows/window frames Painting of builder-installed front door Replacement of builder-installed exterior front door with something different from original color Roofed or enclosed Additions to a Unit (e.g., sunroom, porch, screened-in porch) Signs in the common elements: Candidate signs/questions submitted to the voters yes/no vote can be displayed by individual homeowners 30 days before and 7 days after an election. NO other signs can be displayed by homeowners (except for security system warning). Lampposts New deck construction on patio homes (inside ring) or modifications to the physical structure of the contractor-built decks (outside ring). MODIFICATIONS REQUIRING APPROVAL STORM DOORS (PRIOR APPROVAL REQUIRED) Storm doors must meet all of the following: Full View Aluminum Color: White Brass Trim (Handle/Kick Plate) Clear Glass Some screen inserts that come with storm doors have a bar across the center for reinforcement. These are acceptable provided the bar is attached to the screen insert only. Storm doors with half glass and half screen with the narrow strip for easy changing are also acceptable. PATIOS (PRIOR APPROVAL REQUIRED) Applications are required for all patios including any alteration to existing patios. Patios must be constructed entirely within the defined rear yard (limited common elements) of the unit. Patios may be extended across the back of the unit. It is limited in width to the boundaries established by the location of the privacy fences. No privacy fences shall be moved. Applications should include the following information in duplicate: Drawings showing dimensions of the patio. Materials to be used. 4

Site plan-showing relationship with measurements to the unit, any existing privacy fences, and the relationships of the neighboring units. DECKS (Prior Approval Required): Decks must be repaired with materials that may include Trex or other manmade materials but must be approved in advance by the Architectural Advisory Committee as to make and color. The Architectural Advisory Committee must approve any other changes. AWNINGS Awnings may be used over the rear deck/patio only. Awnings shall be retractable and made of approved cloth material. Fabric sample must be submitted with application. Color: Approved colors, fabrics and design available at the clubhouse. OUTSIDE RAMPS/LIFTS (Prior Approval Required) Plans for any handicapped ramps or lifts must be approved prior to installation. No wooden ramps are permitted on the outside steps or porch. SATELLITE DISHES AND ANTENNA (Prior Approval Required) Dishes are no larger than 39 inches (1) meter) in diameter. Dishes are installed in an inconspicuous location and screened from other units to the extent possible. The cables and wires are secured in an inconspicuous manner. AN APPLICATION IS REQUIRED FOR ALL SATELLITE DISHES AND ANTENNAS EXTERIOR LIGHTING (Prior Approval Required): Fixtures not included with original units. Security lights.* *Homeowners must ensure all security lights are aimed onto their own property only. DECORATIVE OBJECTS (Prior Approval Required): Applications shall be required for all exterior decorative objects whether they are natural or man-made. Typical exterior decorative objects include, but are not limited to, birdbaths, wagon wheels, scriptures, fountains, wind chimes, ponds, sundials, rocks or rock gardens, flagpoles, low flower and shrub border fencing, freestanding poles of any type, banners with their brackets and items attached to approved structures. Additionally, wind chimes need approvals from all neighbors within audible range. No artificial plant material is permitted in the front, back or side yards. Generally, man made decorative objects may be considered for the rear yard only. Natural exterior decorative objects (such as driftwood and stones) will be considered for both front and rear yards. Objects will be evaluated on site, proportion, color and appropriateness to surrounding environment. Applications must include: Site plan. Detailed drawing or picture of the object. 5

Materials. Any additional information that will be helpful in the review of the application. No Prior approval is required for door wreaths or similar decorations. Seasonal decorations can be displayed 30 days prior to and 15 days after a holiday. LANDSCAPING (Prior Approval Required): Homeowner shall provide a plan to include the species or common name for all proposed trees and shrubs, as well as their locations in the front, side, or rear beds. NO APPROVAL REQUIRED Natural flowering plants in the front or side mulched areas or in pots or planters on patios decks, steps, porches, driveways, or adjacent mulched areas. Planting beds and plants (excluding shrubs and trees) in the rear yards of the units provided they would not exceed the privacy fence height nor interfere with lawn maintenance. Yard beds shall have no artificial edging that interferes with lawn mowing. All materials planted by the unit owner shall be mulched with the same type used by the lawn maintenance company. Dead plant material should be removed promptly and empty pots, baskets, etc., stored indoors in the off-season. Planters, etc., placed on driveways must be removed in the winter to facilitate snow removal. The unit owner should water plants, lawns, and trees provided by the builder when needed. The landscape maintenance company will mulch and maintain the areas originally planted by the builder. However, the unit owner is responsible for promptly removing and replacing all dead shrubs. The resident is responsible for maintaining all landscaping done in the modified area including watering, weeding, fertilizing, trimming and removing and replacing dead plants, etc. 6

EXHIBIT C LONG REACH VILLAGE ARCHITECTURAL COMMITTEE When Snowden Overlook and the Kendall Overlook Condominium are annexed to Long Reach, unit owners must conform to the Long Reach Architectural Guidelines. The Long Reach Village Architectural Committee will not accept applications for change from Kendall Overlook residents without a letter of approval from the Kendall Board. However, Kendall approval does not guarantee Long Reach approval. To save you from reapplying after annexation, you are advised to submit an application for change to Long Reach. When you receive approval from Kendall, attach that approval letter to the Long Reach application. Howard County The Unit Owner must obtain any required building permits for structural changes from Howard County. Kendall Board approval does not guarantee approval from Howard County. 7
