STUDENT NAME: Miss First Name Surname STUDENT NUMBER: 123456 This Tenancy Agreement and the Residence Regulations creates a legally binding obligation between the tenant named above & Residential Services, Swansea University, Singleton Park, Swansea, SA2 8PG, Wales, U.K. You must be read and understand this agreement before accepting. This Tenancy Agreement is governed by and construed in accordance with the law of England and Wales. A Reservation Deposit of 350.00 is required within 7 days of the offer date to confirm your booking. The Reservation deposit is non- refundable if you do not move into the accommodation. 2. Once you have arrived, the reservation deposit will be credited towards your payment in May (Or if you are a part year student, the final terms rent). 3. Statements are sent to the student university email address, even where a Parent/Guardian sets up the payment. 4. Payments must be received by the due date and remain the responsibility of the above-named person, If you are unable to make a payment please contact accommfinance@swansea.ac.uk4. prior to the due date. 5. Invoices are sent to the students university email account 7 days prior to the due and will include Accommodation Fees and any other charges added to the account. 6. The Invoice will state if you have set up a Direct Debit, if you do not have a Direct Debit set up you will be given instructions on how to pay your Fees. Please check the Invoice carefully. 7. Payments received after the due dates will automatically include a late payment charge of 50.00. 8. Please see Residence Regulations for full details of our Debt Management policy. 9. This is a fixed term Tenancy and both the University and Student understand that it is not possible to bring this Tenancy Agreement to an end before the end date of the Tenancy. The only exception to this is if a replacement tenant (a current student not currently in residence) wishes to take over the tenancy agreement, if approved, a tenancy substitution charge of 350.00 is payable prior to release from the tenancy. Pre-Paid Dining Card Details. For students staying in Kilvey and Rhossili in addition to kitchen facilities you will be provided with a Pre-Paid Dining card. Your Pre-Paid Dining card is credited on a termly basis with the equivalent of 28.00 per week to enable you to purchase meals in any of the catering outlets on-site. your Pre-Paid Dining card will be ready for collection from the catering department office in Fulton House at the start of the academic year. All you need to do is collect it from the catering office any time from 9.30am to 2.00pm Monday to Friday with suitable ID and we will issue you with your card. 3. FOR CLARIFICATION For the purpose of the Tenancy Agreement the following terms are clarified: Accommodation Fees Contents Contract Dates End Date Flat Common Parts Flat Contents Landlord Tenancy Agreement Payment Dates Rent Reservation Deposit Residence Residence Common Parts you and other residents of the Residence. Residence Contents Residence Regulations Room Allocation Room Contents Services means the total amount of rent you must pay for Your Tenancy as set out in box B above. means the Residence Contents, the Flat Contents and the Room Contents. means the period between the Start Date and the End Date of Your Tenancy. means the end date of Your Tenancy as above means the part of the Residence in which Your Room is located and may include the Flat Common Parts. If Your Room is self-contained (i.e. you have exclusive use of a kitchen) then 'Flat' refers to Your Room. means any areas shared with other residents in the Flat, including the kitchen, hallways, bathroom, and other communal areas solely serving the Flat means all furniture, fittings and equipment provided for the use of all residents in the Flat. means the landlord referred above, and shall also include the Agent referred to above and other authorised representatives acting on behalf of the Landlord. means this agreement. means the dates when you must pay the Landlord for Your Room, as set out in above. means the total amount of rent you must pay for Your Tenancy as set out above. means a non-refundable fee as stated above which the Landlord charges to reserve your Room for the Start Date of Your Tenancy. When you move in and your Tenancy begins it will be credited to your last terms rent means the building where Your Room is located as set out above. means any areas shared with other residents of the Residence including any common room, hallways, outside areas, and any other communal areas shared by residents means all furniture, fittings and equipment provided for the use of all residents in the Residence. means the residence regulations attached at the schedule to this Tenancy Agreement. means the room or self-contained flat of which you have exclusive use as a resident as set out in above. means the furniture, fittings and equipment provided exclusively for your use in Your Room. means electricity, water and sewerage utility services.

Insurance of the building structure, its contents, personal injury and Third Party Liability 9. To provide block insurance cover for personal possessions as outlined in the policy Definitions: 10. Words in the singular should also be construed as plural and vice versa 11. To be eligible to live in this accommodation a person must be enrolled as a full time studying student 12. The University agrees to grant and the Student agrees to take the Rights for the Period of Residence on the conditions set out in this Tenancy Agreement and Residence Regulations. 4. STUDENTS OBLIGATIONS To comply with the Residence Regulations made available to the Student and to inform Residential Services of any changes in circumstances as soon as is reasonably possible. 4.1 FINANCIAL 1. To pay the Residence Fee to the University on or before the dates stated above. 2. Payment received after the above due date will automatically incur a late payment charge of 50.00. 3. Any appeal / Complaint should not affect the terms of the payments of accommodation fees, unless the accommodation is no longer available. 4. In this situation, the University will add to the claim its proper and reasonable costs and expenses, including agency fees, legal fees and the cost of management time. 5. To pay to the University all costs reasonably incurred in enforcing the Student's obligations or arising from a breach of them. Details of charges can be found in the Residence Regulations. 6. If payment of the Residence Fees is overdue by 28 days, the University may, in addition to taking action to recover the debt, terminate the Tenancy Agreement and take proceedings to evict the student. This will not release the student from the financial liability but additional costs may be incurred as a result of the debt recovery and eviction costs. All costs which the University properly and reasonably incur in doing so will be added to the amount claimed from the student. 4.2 REPORTING 1. On checking-in to the accommodation: via the on-line inventory check the condition of the accommodation and report any concerns to the University within 7 days. 2. To report defect damage or want of repair or failure of the Services within 24 hours of becoming aware of it. 3. To allow the University at reasonable times, after giving 24 hours' notice, to enter the Accommodation for the purpose of viewing, inspection, maintenance or repair (no notice being necessary in an emergency or where the need for repair was reported by the Student). 4. The Student will be responsible for any call out fee or expense incurred as a result of failing to allow a contractor to carry out works where reasonable arrangements have been made.

4.3 ACCOMMODATION 1. Not to use for any other purpose other than as a study bedroom. 2. To keep the Contents and (jointly with other students) the Common / Communal Areas in a clean, tidy and safe condition and free from obstruction. 3. Not to bring additional furniture into the Accommodation. 4. Not to share, sub-let or transfer occupancy to any person. 5. Visitors may stay (visitors must be over 18 years of age), up to a maximum of 2 nights at any time, with a maximum of three visits per term. For students living in a Single Sex area guests should be of the same sex. 6. At the end of each letting period to leave the Accommodation in a clean and tidy condition, return any furniture and fittings to their original position. 7. To inform Residential Services of any change to Tenancy Agreement, be it, leaving accommodation, moving room, withdrawing from university / suspending studies etc., 8. The Tenant agrees to permit the Landlord or his agent to enter the Property for the purpose of showing it to prospective tenants, at any reasonable time and by prior appointment. 4.4 GENERAL 1. Not to alter, cause, add to or do anything which may cause damage to property such as: 2. Tamper with any firefighting equipment, electrical installation or machinery 3. Cause a fire risk or in any way put the health and safety or security of others at risk. 4. Put anything harmful or which is likely to cause blockage in any pipes or drains. 5. Remove anything from, affix to, change, damage or attempt to repair the structure or decorative finish. 6. Cause nuisance, offence, disruption, harassment or persistent disturbance to others. 7. Children are not permitted to stay in residences overnight other than in designated accommodation. 8. Bring into the Accommodation any animal; Guide dogs for the blind and hearing dogs for the deaf excepted. 9. Alcohol: Consumption of alcohol is not permitted in accommodation designated as 'no alcohol'. 10. If the residence is deemed as a 'Quiet Residence' the playing of loud music and noise is strictly prohibited between the hours of 11:00pm and 8:00am. 11. You hereby agree to reside in the accommodation in accordance with the Terms & Conditions of the Tenancy agreement and the regulations. Where behaviour which contravenes any of part of the agreement is proven any current or future offer of accommodation made by Residential Services may be withdrawn. 4.5 OTHER CONDITIONS 1. This agreement is a Student Tenancy and the University is entitled to recover possession under any ground in Part II of Schedule 2 to the Housing Act 1988. 2. The Student is responsible for the conduct of all visitor(s) invited or otherwise. 3. The Student hereby authorises the University to use his/her personal data for all lawful purposes in connection with this Tenancy Agreement (including debt recovery, crime prevention, allocating rooms or where there is a serious risk of harm to the Student or to others or to the University's property). 4. The University is not liable to repair any damage caused by the Student unless the cost is met by the student (any excess on the policy being payable by the Student). 5. This Tenancy Agreement does not affect the University's disciplinary powers. 6. The University is entitled, at the Student's expense, to remove any article which constitutes an obstruction, a fire or health and safety risk. Items will, if requested (unless perishable), be returned to the Student at the end of the Tenancy Agreement. 7. The University is entitled to remove any items left in the Residence after the end of the Residence and shall not be obliged to return it to the Student 8. In compliance with Landlord and Tenant Act 1987 S.48 Notices under this Tenancy Agreement must be in writing and the University's address for service is given on the first page of this Tenancy Agreement 9. This Tenancy Agreement is not intended to confer any benefit to anyone who is not party to it. 5. UNIVERSITY OBLIGATIONS 1. To provide the Services. 2. Except in the case of an emergency, reported repairs or cleaning, to give the Student at least 24 hours' notice prior to entering the Accommodation. 3. Not to interrupt the Student's occupation of the Accommodation more than is reasonably necessary 4. Not to disclose personal information obtained from the Student, except as permitted by clause of this Tenancy Agreement or where there is serious risk of harm to the Student, to others or the University's property. Except where the student has given his/her permission on the Emergency contact details upon application.

5. To provide a full complaints procedure regarding accommodation, maintenance and service provision. Further details are available from Residential Services. 6. RS / the University will make reasonable adjustments to the facilities or services offered, to support a student with a specific housing need, provided all the necessary information to make the adjustment is made available to the University at least 6 weeks before the agreed occupation date. If the information is not available within this timeframe the University may not have sufficient time to implement the adjustments and therefore reserves the right to delay the occupation date until the work is completed or withdraw the accommodation offer. 7. During occupation, a student must inform RS of any change of care required, related to their stay in accommodation and support RS in implementing a new care strategy (where such new care strategy is deemed 'reasonable' by RS). Where the necessary level of support is not deemed reasonable for the University to implement, it is understood the University will be left with no choice but to terminate the Tenancy Agreement. 6. SERIOUS BREACH OF UNIVERSITY REGULATIONS A student may be permanently excluded from residence either for persistent behaviour which interferes with the rights of other students, or a single act which is deemed to endanger other students. Examples of the type of behaviour are: - a) A student who is proven to be persistently noisy b) Serious or persistent wilful damage or vandalism c) A student who remains persistently disruptive d) Illegal possession of a controlled substance e) Victimisation or harassment of another student within residence contrary to the University's Bullying and Harassment Policy. f) Misuse of firefighting and detection equipment. This will always incur a charge however persistent offenders risk exclusion from residence. g) Any behaviour deemed likely to jeopardise the safety of other residents, staff, or other users of the site. 1. The University reserves the right to relocate the Student to alternative University accommodation during the Period of Residence where it is reasonable to do so. In this case the Student will have the right to terminate this Tenancy Agreement without having to comply with the conditions in clause as an alternative to relocating unless the reason for relocation is because the Student is in breach of one or more of their obligations in this Tenancy Agreement. 2. Where the University relocates the Student because the Student is in breach of one or more of their obligations in this Tenancy Agreement (or where the relocation is made at the Student's request) the Student shall pay the University an administration fee of 350.00. 3. The University reserves the right to withdraw the accommodation if a student is found to have a criminal record that makes it inappropriate that they live in a communal environment on campus the offer will become null and void. All such matters must be disclosed at the time of application. The Allocations Manager will make the initial assessment; any appeal received being processed by the Head of RS. 7.0 CANCELLATION OF TENANCY You are accepting these terms and conditions for the entire duration of the contract. Ending the Tenancy prior to the fixed term date will only be accepted on grounds 1-3 as stated below: 1. Withdrawing from University 2. Suspending Studies 3. Not starting course Students, who for academic or personal reasons, are withdrawing from studies and leaving university please note you will: 4. Need to submit to Residential Services a Release from Accommodation Request Form 5. Need confirmation from academic registry that you are Withdrawing/Suspending studies.

6. Have 6 weeks from submission of form to depart your accommodation. This will allow you to stay in the accommodation in order to arrange future accommodation / travel plans. 7. Be liable for rent and any charges up until the agreed termination date of your contract. If you have requested and a replacement tenant is found sooner, you will be charged a tenancy substitution fee of 350 or rent: whichever is the lesser amount. E.g. If you submit the form on the Thursday 6 th November, your notice will be taken from Friday the 7 th and you will need to pay the rent for the next 6 weeks until you are released on Friday 19 th December. As rent is taken termly your account will then be adjusted to reflect this and any refund or charges will be processed through our finance department. Release from contract request on grounds of: 1. Wishing to travel from home. 2. Wishing to move to Private Accommodation If during the period of your tenancy you wish to request release from your contract on grounds 4 or 5 as above, this will be treated as a request only, We do not normally release students from the tenancy on these grounds unless we have a student, who is not currently in university accommodation, to take over the remainder of the contract, IF the university is successful in finding a replacement tenant a charge of 350 will be added to your accommodation fees in order to cover administrative costs. Whilst under this tenancy do NOT sign another tenancy agreement / financial commitment outside of university accommodation unless you have been officially released from your contract. If you do you could be liable for rent on both contracts for the full duration of the tenancy. Official notification of release of contract will only be confirmed by Residential Services central office in the form of an amendment notice / release form: this will also outline your financial liabilities. 8.0 TO ACCEPT THIS TENANCY AGREEMENT AND THE CONDITIONS CONTAINED You can accept on-line by signing on to your accommodation account, you will be agreeing to the terms and conditions contained within this Tenancy. Any student who accepts the offer of a place in University residence does so on the understanding that the room is offered and accepted for the full term of the Tenancy Agreement. Other than in exceptional circumstances, it is not possible for a student to be released from his/her contract during the year.
