Flat Fee MLS Listing Sign UP Form Through this Limited Service Agreement Seller grants erealtyproperties authority to list Sellers Property on the MLS (Multiple Listing Service). Date Seller Seller Property Address To Be Listed: MLS Listing Plan Desired: $99 Flat Fee 6 Month Listing $199 Flat Fee 12 Month Listing $299 Flat Fee 6 Month Listing w/negotiation, Documentation, and Closing Included. Seller agrees to provide erealty Properties with all necessary property information in order for the MLS listing to be completed. This includes filling out a property data sheet or online requested by erealty Properties and/or required by the MLS. Seller certifies and represents that seller is legally entitled to convey the property and all improvements and any agreed personal property.
Seller grants erealty Properties in writing; and within 24 hours of any and all changes affecting the status of the property. Status changes include: Entering a contract, closing a contract, terminating the sale, change of listing price. Failure to notify erealty Properties within 24 hours may result in the MLS listing being cancelled or a fine as per MLS Rules/Regulations. Seller agrees to be fully liable for any fines imposed by the MLS and/ or pertaining Realtor Association to erealty Properties as a result of Sellers failure to submit any changes in status. If seller requests changes after the approval of the MLS listing, a service charge of $15 per change request will be applied after payment is received. Status changes will not be considered effective until erealty Properties is notified in writing and changes are applied to the MLS. Seller agrees to make the property available to MLS members, at all reasonable hours, for showings to prospective Buyer during the term of this Listing Agreement. In the event the Property is sold, contracted to be sold to a procured Broker, the seller will offer a cooperating commission in the amount of: % of the sales price; or a flat fee of $ to the any licensed Florida Broker, which also does NOT exclude erealty Properties, who procures the prospect as a licensed buyer s agent who represents and introduces the property to a ready and able buyer pursuant to a written or oral agreement. The commission fee shall be paid to the Broker by Seller in the event of sales at time of closing the sale. erealty Properties, also has a right to act as a buyer Broker for any procured buyer who is a ready and able buyer and introduced to the property by erealty Properties. The seller can sell his/her property himself/herself to any buyer not procured by a participating real estate agent. Seller understands that by placing their property on the MLS, seller is agreeing to cooperate with any Broker who is member of the MLS. Seller grants Brokers who are members of the MLS to advertise this listing in the media; thus, allowing any Broker who is a member of the MLS permission to actively market the Property in attempt to find a prospect. Seller agrees to indemnify erealty Properties and hold them harmless from losses, damages, cots, fines, and expenses of any nature, including attorney s fees, and from liability to any person, that erealty Properties incurs because of Seller s negligence, representations, misrepresentations, actions, or inactions, the use of a lock box; the existence of undisclosed material facts about the property. This clause will survive erealty Properties performance and the transfer of title. Seller completely relieves erealty Properties from any and all Liability. Seller agrees to make all legally required disclosures, including all facts that materially affect the property value and are not readily observable or know by the buyer. Seller will immediately inform erealty Properties of any material facts that arise after signing this agreement. Seller grants erealty Properties the right to authorize dissemination of sales information prior to settlement of the MLS for its Participants.
Seller acknowledges that through this limited Service Agreement, erealty Properties is only responsible for listing the Sellers Property on the MLS. erealty Properties has No Brokerage Relationship with the seller and does not represent the seller. Seller has chosen to waive broker representation and be fully responsible for all appointment scheduling, property showings, negotiations, documentations, contract preparation, disclosures, representation, closing, escrows, and all other responsibilities pertaining to the sale of seller s property. Seller accepts legal responsibility for complying with all federal laws, state laws, local laws, governmental laws, ordinances, statues, MLS rules and regulations and property disclosures. erealty Properties strongly recommends that sellers seek guidance and advise of an attorney when selling real estate. All persons authorized to sell the property must sign this agreement and the undersigned signature(s) include all persons(s) who have an ownership interests in the property.
