(Bill No. 080853) AN ORDINANCE Amending certain Sections of Titles 4 ( The Philadelphia Building Construction And Occupancy Code ), 6 ( Health Code ), 9 ( Regulation Of Businesses, Trades And Professions ), 14 ( Zoning and Planning ) and 19 ( Finance, Taxes And Collections ) of The Philadelphia Code related to license and permit fees and other charges by modifying the amount of such fees, under certain terms and conditions. THE COUNCIL OF THE CITY OF PHILADELPHIA HEREBY ORDAINS: SECTION 1. Titles 4, 6, 9, 14 and 19 of The Philadelphia Code are hereby amended to read as follows: TITLE 4. THE PHILADELPHIA BUILDING CONSTRUCTION AND OCCUPANCY CODE CHAPTER 4-200.0. TEXT OF SUBCODES SUBCODE "A" (THE PHILADELPHIA ADMINISTRATIVE CODE) CHAPTER 9. FEES SECTION A-901 GENERAL A-901.11 Administrative fees: For items that require the Department to perform administratively, the fee schedule is listed below, provided, however, that the Department is authorized to establish by regulation an alternative fee for any such activities, which alternative fee shall supersede the fee listed below. TITLE 6. HEALTH CODE. CHAPTER 6-300. FOOD. 6-301. Food Establishments. (4) Except as provided in 6-301(5) the license fee for food establishments selling food is: (a) Food establishments where food is prepared or served for consumption on or off the premises, including but not limited to, eating and drinking establishments and caterers: (.1) with up to 50 seats...[$220.00] $250.00; (.2) with 51 or more seats...[$315.00] $350.00; (.3) caterers...[$315.00.] $350.00. (b) Retail food establishments with permanent location, including, but not limited to candy stores and drug stores without soda fountains, grocery, meat markets, and other food stores, but including any such food establishment licensed under 6-301(4)(a) or (d): (.1) having less than 5000 square feet of floor area...[$125.00] $150.00; (.2) having 5000 square feet or more of floor area...[$440.00] $500.00. (c) Retail food establishments, without permanent location, including, but not limited to mobile vending units such as motor vehicles, movable stands and carts, newsstands, temporary special event establishments, [one hundred twenty five (125)] one hundred fifty (150) dollars per unit, per year. TITLE 9. REGULATION OF BUSINESSES, TRADES AND PROFESSIONS. CHAPTER 9-200. COMMERCIAL ACTIVITIES ON STREETS. 9-203. Street Vendors. (3) Issuance. No license shall be issued unless: (b) The applicant pays the following annual license fee: (.2) [two hundred fifty ($250.00)] three hundred ($300.00) dollars for each person vending by using a handcart, pushcart, stand or similar arrangement which is mounted on wheels but has not an internal-combustion engine; (.3) [two hundred fifty ($250.00)] three hundred ($300.00) dollars for each person vending from a horse-drawn wagon; (.4) [two hundred fifty ($250.00)] three hundred ($300.00) dollars for each person vending from a motor vehicle of any kind. 9-204. Sidewalk Vendors in Center City. (4) License Issuance. Licenses shall be issued upon compliance with the following: City of Philadelphia -5-

(c) The applicant, after being notified by the Department that his application has been provisionally approved: (.3) pays the initial license fee of [two hundred ($200)] two hundred fifty ($250) dollars; and (6) License Renewal; Change of License Information; Change in Category of Goods Sold. (a) The Department shall send to each person licensed under this Section, at a time reasonably in advance of the end of each license year, a renewal license. If the licensee returns the renewal license to the Department, together with payment of the annual renewal fee of [two hundred fifty ($250)] three hundred ($300) dollars and a statement of the changes, if any, in the license information required by subsection 9-204(4), the Department shall then validate the renewal license and return it, together with a new license plate, to the licensee, who shall thereby be licensed for the succeeding license year. 9-206. Sidewalk Vendors in Neighborhood Business Districts. (5) License Issuance and Renewal. Licenses shall be issued and renewed upon payment of an annual fee of [two hundred fifty (250)] three hundred ($300) dollars and pursuant to regulations established by the Department. 9-1003. Plumbers. (7) Fees. CHAPTER 9-1000. TRADES. City of Philadelphia -6-

(b) The annual license fee for plumbers shall be as follows: (.3) Master Plumber...[$180] $200 9-1004. Contractors. (2) License required. (c) A license under this Section shall be renewed every three (3) years upon payment of the [one hundred and fifty (150)] two hundred ($200) dollar renewal fee, subject to the conditions set forth in subsections 9-1004(3), (4), (5), and (6). (3) Application Requirements. Applications for a Contractor s license shall be made on forms to be supplied by the Department. No license shall be issued until the applicant: (c) pays a non-refundable application fee of [$150.00] $200.00; and TITLE 14. ZONING AND PLANNING. CHAPTER 14-1700. ADMINISTRATION AND ENFORCEMENT. 14-1706. Schedule of Fees. The department is authorized to require a non-refundable filing fee to be charged upon application for a zoning permit. The amount of the fee shall be determined by City of Philadelphia -7-

regulations of the department. The filing fee shall be applied as a credit to the permit fee. The following are the fees to be paid under the requirements of this Title; except that no permit fees shall be required of any person applying for a use registration permit for a family day care home pursuant to Section 14-203(1)(g) and any school based mental health clinic. (a) For permit processing and document reviews: 1. Zoning Permits Parcels containing one- or two-family dwellings...[$25.00] $30.00 All other parcels equal to or less than 30,000 square feet...[$100.00] $125.00 All other parcels greater than 30,000 square feet...[$200.00] $250.00 2. Use Registration Permits (For each use in new construction and for each use change in an existing structure)...[$100.00] $125.00 3. Accessory sign permit...[$100.00] $200.00 4. Inspection fee In addition to the permit fee, an inspection fee equal to the permit fee shall be imposed whenever a new use (except single family dwellings) or construction commences without the required permits. (a) Reserved. (b) Application for a "Certification Statement" required for transfer of real estate pursuant to Pennsylvania Act 652 of 1961, one hundred ($100.00) dollars. (c) For a hearing before the Zoning Board of Adjustment pursuant to 14-1805(10), the fees shall be paid per property that is included in the appeal as follows: (.1) For properties containing a one- or two-family dwelling only: [$100.00] $125.00. (.2) For any property not included in item (.1): [$200.00] $250.00. (.3) The fee for each accelerated hearing before the Board shall be [$500.00] $625.00 in addition to the fee specified in (.1) or (.2) above. The maximum accelerated hearing fee for simultaneous hearings resulting from multiple permit applications shall be [$1,500.00] $1875.00. (d) For a reposting of notices of Zoning Board of Adjustment hearings pursuant to 14-1805(11), [$50.00] $65.00. (e) For certification that a permit is not required, [$20.00] $25.00. 19-2602. Licenses. TITLE 19. FINANCE, TAXES AND COLLECTIONS. CHAPTER 19-2600. BUSINESS PRIVILEGE TAXES. (2) Two (2) types of business privilege licenses as required by subsection 19-2602(1) shall be issued, subject to all other provisions of this Section: (a) A permanent license shall be issued upon payment of a fee of [two hundred fifty (250)] three hundred (300) dollars.
