Require landowner's surveyor to prepare a sketch showing thee exact location of all Manitoba Hydro facilities on the property. Centra Gas Manitoba Inc. has no easement requirements. Analysis This subdivision application was received on December 8 th, 2016, and circulated for commenting as per The Planning Act. The application is exemptt from Public Hearing requirements. The application proposes to subdividee 4.6 acres from an existing 81 acre holding for retirement purposes. This proposal is generally in keeping with the intent of the Development Plan and the Zoning By-law. It should be noted that the proposed lot does not meet the minimum site width requirement, therefore a variance is requried. Commenting agencies have generally not expressedd concern orr objection to the proposed subdivision. Manitoba Hydro will require easements; the location of such easements will be determined following the submission of a sketch (prepared by a Mantioba Land Surveyor) showing the exact location of all Manitoba Hydro facilities on the property. 9. Options Under Section 125(1) of The Planning Act, 'where the council of a municipality receives an application pursuant to Section 124(2), it shall, after considering the application, by resolution (a) reject or refuse to approve the applicationn for subdivision; or (b) approve the application for subdivision, without conditions or with conditions as set out in Section 135.' Recommend dations and Conditions Based on the analysis, above, our office recommends approval of the application. Should Council wish to approve the application, our office recommends the following conditions be placed: 1. Applicant / owner submits confirmation in writing from the Chief Administrative Officer of the Municipality that: taxes on the land to be subdivided forr the currentt year plus any arrears have been paid or arrangement ts satisfactory to Council have been made; any applicable capital development fees have been paid. 2. Manitoba Land Surveyor prepares a 2 lot subdivision as proposed, ncluding lot area and width calculations, with lot 1 as proposed, and lot 2 (residual lot) as part of CT 2398041/ /1, including confirmationn that Crownn land is not involved in the proposal. 3. Applicant / owner obtains variances, if required. 4. Applicant / owner obtains: joint easement agreement (statutory easement agreement) for existing and/or future MB Hydro facilities associated with the subdivision; plan of easement prepared by a Manitoba Land Surveyor as required by The Real Property Act.
