1 KINGS CREEK VILLAGE ASSOCIATION, INC RULES & REGULATIONS Each owner, resident, invitee, relative or guest shall, in addition to the obligations and duties as set forth in the Kings Creek Village Association Articles of Incorporation, the By-Laws or any amendments thereto, be governed by the following regulations: I. COMMUNITY BUILDING Recreation Building will be open 8:30 A.M. to 9:00 P.M. (4/6/87) A. All resident owners or tenants who reside within KCVA must have valid K.C.V.A. photo I.D. card for use of all recreational facilities and common areas belonging to KCVA or any of its Sub-Associations, including but not limited to the Townhouse Area, Village of Kings Creek (VKC) condominiums, Camino Court, Single Family Homes and Four-Plex units. Residents of VKC must obtain their I.D. cards from the VKC manager s office. B. Guests must be accompanied by their resident host or have valid guest photo I.D. card. Guest photo I.D. cards are issued for House Guest only. 1. House Guest shall be any person who is staying in the resident s unit on a temporary basis. Introduction and permission from the resident is required on K.C.V.A. form which the resident shall fill out and sign in person at the Pro Shop (located on the ground floor of the Community Building). The resident host accepts responsibility for House Guest s actions in the use of KCVA facilities and agrees to pay for any damage caused by the House Guest. a. No more than two (2) House Guest I.D. cards will be issued to a resident s unit at any one time except with special approval of the Sub-Association s Manager and the KCVA Manager. b. House Guest are not permitted to have additional guests when using KCVA facilities. c. House Guest I.D. card will be valid for a maximum of 30 days (7/12/82) 2. Day Guests a. Day guests must be accompanied by a resident at all times. C. Members and their guests must be properly attired at all times in the Recreation Building. No wet bathing suits or bare feet are allowed. Shirts are required to be worn by all. D. No intrusive music or musical instruments may be played in the Recreation Building without permission from the Manager unless headphones are used. E. Children under 12 years of age must be accompanied by an adult for admission to the pool area or Community Building. Parents are responsible for conduct of their children at all times. Dependents 12-18 years old, with a valid photo I.D. card, may use the pool, tennis, handball and other clubhouse and recreation areas without parents being present, provided they conduct themselves in a responsible fashion according to the Association Rules. Unless parents are present, dependents in the 12-18-year age group are limited to three guests or invitees at a time. (7/8/85)

2 F. Running, pushing, wrestling, skateboarding, rollerblading, rough-housing, ball playing or causing undue disturbance in or about the pool area will not be tolerated. G. No wheeled play vehicles (included but not limited to bicycles, skateboards, rollerblades or recreational scooters) are allowed in the pool area. H. All persons use this facility at his or her own risk and in conformance with all rules and regulations. Any person may be barred from the recreational facilities at the discretion of the K.C.V.A. manager for violations, improper conduct and/or for any other reason which in the manager s judgment constitute a hazard to others or to the association. (11/24/86) I. No glass bottle beverages are allowed in the pool, pool area or downstairs of the Community Building. J. No smoking allowed in the pool, pool area, Community Building or recreational areas. K. Members are responsible for ensuring that they and their guests clean up and remove all their belongings and debris/rubbish from all common areas. L. Members are responsible for any damage caused by them or their guest. M. Billiard and ping-pong tables are available on a first-come-first-serve basis with a time limit of one hour of use if there is a waiting list for their use. Reservations may be made for specified time periods by telephone or in person at the Pro Shop office. Each resident may make a reservation (1 table) for him or herself only, and may be accompanied by up to three (3) guests. (305-279-2101) N. All residents must check in at the Pro Shop office with their I.D. card and sign in to receive their table assignment. Non-residents without a guest pass or a resident host, will be asked to leave. O. Reservations are automatically cancelled if resident does not check in within 10 minutes after their scheduled time. Residents who repeatedly fail to honor their reservations may be denied use of the facilities for this purpose. P. No sitting on billiard or ping-pong tables. Q. No gambling or profane language allowed in the Community Building. R. No one under the age of 18 is allowed to use the upstairs area of the Community Building unless accompanied by an adult or by special permission of the manager. S. No loitering in the Pro Shop by unauthorized persons. T. No personal phone calls are to be made from the Pro Shop by residents. U. The KCVA recreational facilities are for the sole use and enjoyment of all KCVA residents (with valid I.D. card) and their guests. Use of any KCVA recreational facility for teaching and/or instruction in tennis, racquetball, swimming, billiards, etc. whether for a fee or gratis, is strictly prohibited unless specifically approved by the Board of Directors. 3 V. Residents signing up for the use of the basketball court must have valid KCVA I.D. card and are allowed up to three (3) guest. Use of court is for 1/2 hour. (7/10/89) W. Renters & Owners - I.D. Cards (7/12/93) 1. Renters in Kings Creek Village must present a valid current lease to obtain a KCVA I.D. card. 2. Sub Associations are responsible for approval of their own renters. Owners will fill out appropriate approval forms which the renter or owner will present with a copy of a valid current lease to the Pro Shop. 3. Renters I.D. cards will be issued for period of the lease, up to a maximum of two years. II. SWIMMING POOL RULES APPLY TO COMMUNITY AND WEST END POOLS) A. Children under 12 years of age must be accompanied by an adult. In addition, any children who are unable to swim must be accompanied by an adult at all times. B. No glass allowed on deck or in pool area. C. No gum chewing in the pool or pool area. D. Showers are required before entering the pool. E. Safety equipment is for emergency use only. F. No rafts, large floats or scuba diving are permitted in the pool. (7/9/84) G. Children under 3 years of age must be accompanied by an adult at all times. Children who are not potty-trained must wear swimming diapers. H. No pets allowed in the pool area. I. No BBQ grills or other cooking devices are allowed in or around pool area. J. All guests using KCVA swimming pools must be accompanied by their Resident Host. K. No private parties of any type are allowed at any of the KCVA swimming pools at any time. L. Swimming Pool Hours 1. West End Pool 8:30 a.m. to Dusk 2. Community Pool 8:30 a.m. to 9:00 p.m. (7/11/88) M. All persons using the swimming pool must wear appropriate swimming attire. (7/11/94) N. No food or drink is permitted in the swimming pools.

4 III. TENNIS AND RACQUETBALL REGULATIONS A. Tennis and Racquetball courts may be used from 8:30 a.m. to 9:00 p.m., weather permitting. B. Three guests per member may play on one court at the same time if they are accompanied by the member host. C. Reservations may be made for specified time periods by telephone or in person at the Pro Shop office. Each resident may make a reservation (1 Court) for him or herself only. (305-279- 2101) D. Between 5:00 p.m. and 9:00 p.m., each family is allowed one reservation only. This is to enable other residents a greater chance to play. From 9:00 a.m. to 5:00 p.m., residents may reserve more than one-time slot. E. All residents must check in at the Pro Shop office with their I.D. card and sign in to receive their court number. Nonresidents without a guest pass or a resident host, will be asked to leave. F. Reservations are automatically canceled if resident does not check in within 10 minutes after their scheduled time. Residents who repeatedly fail to honor their reservations may be denied use of the courts. G. On the tennis courts, shirts must be worn as well as proper tennis shoes at all times. H. No food, glass containers, chairs, pets, bicycles, skateboards, etc. allowed on courts. Use the trash cans for all discards. I. Spectators must remain outside fence. J. Management reserves the right to deny use of courts for any violations. K. Under no circumstances shall any shall any child under the age of 12 years play on any racquetball court unless he or she is accompanied by an adult resident of Kings Creek Village who possesses a valid I.D. card. L. No intrusive music or musical instruments may be played in any recreational area of KCVA without permission from the Manager unless headphones are used. M. Players waiting for a racquetball assignment may warm up on a court not being used or assigned. Approval of the Pro Shop employee on duty must first be obtained. In the event of any dispute the Pro Shop employee on duty shall have the ultimate decision and refer the incident to the KCVA manager. IV. GREENBELT/TOWNHOUSE GROUNDS AND WALKWAY AREAS A. The greenbelt area is for use of bicycles and foot traffic only (exceptions: see B below).

5 B. No motorized or battery-operated vehicles of any kind, except as approved by KCVA or KCVTA Manager, will be permitted in this area, except for authorized work vehicles. C. Whenever pets are outside of a unit property line, a resident must have their pet(s) under their control and leashed in accordance with Miami-Dade County law. In addition, the person with the pet must pick up the pets waste, place it in a plastic bag and dispose of it properly in the trash containers. D. No temporary or permanent structures of any kind may be constructed or erected on the greenbelt by a KCVA resident, unless the resident has first filled out the appropriate from and received approval from the KCVA Board of Directors. The resident further agrees to be financially responsible for any damage caused by the placement of such a structure, and assumes all liability for any injuries or other harm that may occur as a result. (Forms may be obtained from the KCVA Manager s office.) V. RESIDENTIAL UNIT A. Members shall not use or permit the use of their premises in any manner, which would be disturbing or be a nuisance to other residents or their guests, or in such a way as to be injurious to the reputation of the Association. B. Common walks, park area and other common elements shall be kept free from rubbish, debris and other unsightly materials, and shall not be obstructed, littered, defaced or misused in any manner. C. Members shall not cause or permit anything to be hung or displayed or affixed to the outside or inside of windows and sliding glass doors or placed on the outside of walls or fence of a building, without the prior written consent of the Association (exceptions: see D below). Approved and code-compliant storm shutters may be installed upon prior approval of the Sub-Association and KCVA. D. No signs, advertising or notices of any kind or type whatsoever, except For Rent or For Sale signs, shall be permitted or displayed on the exterior of any unit, nor shall the same be posted or displayed in such a manner as to be visible from the exterior of any unit, without written approval of the Association. On 40 sq. in. For Sale or For Rent sign may be affixed to the driveway entrance gate of any Townhouse, on a 5 foot stake in the front yard of any single family residence, or on the front door of any condominium unit. 1. Exceptions: Political signs may be displayed during any local, state or federal campaign or election cycle. Homeowner/resident is responsible for removing and discarding these signs at the conclusion of the election. Flags of an appropriate nature may be displayed. KCVA reserves the right to request that any inappropriate signs or flags be removed, and if they are not so removed, KCVA may remove and discard the item. Village of Kings Creek (VKC) condominium residents and owners are not permitted to display signs or flags on the front doors of their units.

6 VI. KINGS CREEK SHOPPING CENTER A. All businesses and offices in the Kings Creek Shopping Center may operate between the hours of 6:00 a.m. and 11:00 p.m. Sunday through Thursday, and 6:00 a.m. through Midnight Friday and Saturday. Any noise or music emanating from any tenant of the Shopping Center must drop to a level so that it cannot be heard within a Kings Creek residential unit by 10:30 p.m. every night. B. No car may be parked in the parking lot in front of, beside or in back of the Shopping Center between the hours of Midnight and 6:00 a.m. unless the vehicle has a permit issued by KCVA. Any car parked in the Shopping Center parking areas between the hours of Midnight and 6:00 a.m. without a permit will be issued a warning sticker for the first two offenses, and towed upon the third or additional offense. VII. PETS A. No live animals of any description are permitted in the common areas under any circumstances, unless they are on a leash. No live animals of any kind are allowed in the KCVA Community Building, on the recreational grounds or in the swimming pool area. (1/25/88) B. All Kings Creek residents who have one or more pets must provide the KCVA Manager with annual proof of proper vaccinations in accordance with local, state, county and federal regulations. C. No pets are permitted that are on any local, state, county or federal prohibited species list. VIII. MAINTENANCE All requests for repairs or maintenance in common areas of the Village should be submitted to the KCVA Manager s office. Requests for repairs or maintenance in buildings, residential units or the grounds of Sub-Associations, should be directed to the Sub-Associations Manager s office. IX. PACKAGE DELIVERIES The Association cannot be responsible for receiving packages for members. X. PARKING NO mechanical work or washing of automobiles is permitted in any common area. NO boats, trailer, camper/trailers, oversized motor homes, or any parts thereof, may be parked or stored in any parking lot or any common area. NO inoperative motor vehicles may be parked or stored in any parking lot or any common area. NO parking on common areas, including the greenbelt, except in designated parking spots (see exception in following paragraph).

7 Residents who own or lease more than two (2) cars may park one (1) additional vehicle ( overflow vehicle ) in the parking lot of the Community Building, with prior approval of the KCVA Manager and with an appropriate parking decal (to be issued by the Manager) displayed in the lower left corner of the front windshield. If the Clubhouse is being rented out for a private event, all overflow vehicles must be moved at least two hours prior to the scheduled start of the event, and may not be returned to the parking lot until after the scheduled end time of the event. In the event of non-compliance, violators are subject to having their overflow vehicles towed. NO commercial vehicles parking overnight at residences. Any work vehicle belonging to a resident must be parked at the side of or behind the unit. NO commercial vehicles of any kinds may be parked or stored on or about any parking lot or common area of Kings Creek Village or on or about the Kings Creek Shopping Center between midnight and 6:00 A.M., with the exception of the following: A. Delivery vehicles or service vehicles while in the process of performing their services. B. Commercial vehicles used or maintained by tenants of Kings Creek Shopping Center in the ordinary course of business. Such vehicles, if parked overnight, must be parked at the side or in back of the Center. For purposes herein, commercial vehicle shall be defined as a vehicle designed or customarily used for the transportation of goods, products, tools, equipment or passengers for hire. Any violation of these rules may result in the vehicle in question being towed, without liability to KCVA, and solely at the vehicle owner s expense. XI. SOLICITING No soliciting, distribution of handbills and/or other advertising material is allowed in the Village. Questions or problems should be referred to the Village Manager,305-279-2101. (10/3/88) If possible, please deliver the original or a copy of the material to the Manager so he or she may follow up with the distributor. XII. SECURITY Security s responsibility is to patrol the entire Kings Creek Community. Security guards are aware that K.C.V.A. has initiated an I.D. system and that each resident should have an I.D. card. Security may request proper I.D. at any time, especially at the swimming pools and recreational areas, tennis courts and racquetball courts. If you have a real emergency, call Dade County Emergency by dialing 911 and you will be connected to the proper agency (Fire, Police and Rescue). For general and minor security problems for the security guard call 305-733-7467, 24 hours per day, 7 days per week. REQUIREMENTS FOR APPROVAL OF SPECIAL STRUCTURES, AND ALTERATIONS No structural changes, alterations, including exterior painting shall be permitted without prior application to and the written approval of the Architectural Control Committee and the KCVA Board of Directors. A. A unit owner planning to install a utility shed, playhouse, animal shelter and/or any other building structure, fence or dog run must first submit a Request for Architectural Control

8 Approval form to the KCVA Architectural Control Committee for review and recommendation, subject to final approval by the K.C.V.A. Board of Directors. B. Installation of a utility shed, playhouse, animal shelter or dog run shall be governed by Building Codes, (copies of the relevant sections are available in the KCVA manager s office specifically sections # 4401, 4402, 4403, 4404, 2301 through 2311, 203, 204 and 205 (copies of the above sections are available in the K.C.V.A. manager s office) and the following K.C.V.A. specifications: 1. All structures in A & B above shall be suitably and securely attached to a concrete slab or in the alternative, have suitable and secure tie downs (sec. # 4403.I, S.F.B.C.). 2. No structure described in the above sections shall exceed 10 feet x 10 feet x 7 feet in height. 3. No structure described in the above sections shall be of a permanent nature and must be movable. 4. The Request for Architectural Control Approval Form application shall include the following: a. Size of structure b. Exterior color c. Location on property d. Purpose of structure e. Description of manner in which structure will be secured to ground (concrete slab tie downs, etc.) f. Statement certifying that upon approval of application the owner shall apply to Dade County for required building permits and shall provide copies of same to the KCVA Board before commencing construction. K.C.V.A. Architectural Request Approvals are valid for one year from the date of committee approval. (10/3/88) XIV. FENCES A. All fences be limited to a maximum height of 6 feet and either chain link of shadowbox type (wood) with 6 x not less than 3/4 boards. All wood to be pressure treated. (7/1/94) B. All fences will have maximum distance of 48 between posts to prevent sagging and all posts will have proper concrete bases. C. All fence posts will be 4 x 4 and pressure treated and secured in cement at least 2 deep. D. All fence colors must be approved by both the Sub-Association and KCVA. All work to be done in accordance with South Florida Building code - Dade County Edition. E. All work is to be done in accordance with all relevant Building Codes. F. All fence proposals must be submitted (on the proper form) and approved by the KCVA Architectural Committee or the KCVA Board of Directors, in writing. (7/28/86) XV. ARCHITECTURAL CONTROL All work or alterations that require the approval of the Architectural Control Committee (in accordance with Article VII of the By-Laws) must also conform to all applicable local, state and/or federal regulations. In the event that any such work requires the issue of a permit, a copy of the permit and final approved inspection documents must be furnished to the KCVA Manager s office as

9 soon as such approval is obtained. XVI. REGULATIONS CONCERNING GARBAGE CONTAINERS AND GARBAGE DISPOSAL FOR TOWNHOUSES, FOUR-PLEX CONDOMINIUMS AND SINGLE FAMILY RESIDENCES A. All occupants of Townhouses, Four-Plex Condominiums and Single Family Residences shall keep their garbage in Dade County Carts and Recycle Carts provided by Miami-Dade County. B. All said containers shall be kept inside the occupants premises except when put out at Street Side for collection. Containers should not be placed Street Side prior to sundown of the evening immediately preceding the scheduled garbage collection day, and must be taken inside the occupants premises not later than the evening of the scheduled collection day. C. Any large trash or debris including furniture or appliances, may not be placed Street Side for pickup unless there is a previously scheduled collection, and must only be placed there on the day of the scheduled collection. Kings Creek Village Association maintains an annual contract with the County for removal of such items. Any resident needing this service should call the KCVA Manager to schedule a pickup. D. Any Christmas tree or other holiday decoration item that is being disposed of, must be disposed of properly and in a timely fashion by the owner/resident. KCVA reserves the right to dispose of any such debris that is not properly disposed of and to bill the owner or resident for the costs associated with the disposal. XVII. BURGLARY AND ROBBERY ALARM SYSTEMS IN DWELLING UNITS A. Owners of all residences & dwelling units in which an Alarm System has been or hereafter will be installed shall within furnish to the Village Manager written notice of the existence of such Alarm System or ten (10) days after the installation of an Alarm System hereafter installed. B. The notice shall be on a printed form furnished without charge by the Village Manager to and at the written request of the unit owner. The notice shall contain the following information, to wit: 1. Name, Address and Telephone Number of the unit owner and/or unit occupant if not owner occupied. 2. Location of the unit involved, showing exact address with Building and Apartment designations when applicable. 3. Name, Address and Telephone Number of the person, firm or corporation that is or will be monitoring and/or servicing the Alarm System. 4. Names, Addresses and Telephone Numbers of two (2) persons (other than the owner and occupants of the unit involved) who will have access to the unit in the event of the activation of the Alarm during the absence of the occupants from the unit. C. It shall be the responsibility of the sub association i.e. Camino Court Condominium, Camino Circle Condominium, Townhouse Association and the Village of Kings Creek

10 Condominium, in which the unit involved is located to take such remedial action in the event of the activation of the Alarm System during the absence of the occupants of the unit. D. The Village Manager shall maintain a record of all notices filed with his office pursuant to this rule and shall provide a copy to the respective Sub-Association in which the unit is located, maintaining a record of each notice filed with his office and date of such transmittal. XVIII. TV SATELLITE DISH ANTENNAS All proposed satellite or TV antenna installations shall be submitted to the KCVA Architectural Control Committee for approval. The dish shall be located in the back of the homeowner s property and landscaped so that it is as unobtrusive as possible, and not visible from the street. The Architectural Control Committee applicant must contain specifications, including diameter, height, photo or color image, and diagram or rendering of the proposed location of installation. XIX. INSPECTION AND COPIES OF RECORDS AND DOCUMENTS A. In accordance with Florida Statutes, any KCVA member may request to inspect the official records of the Association by submitting their request in writing via Certified Mail. The request must specify the records to be inspected. Any copies of the records being inspected are subject to a charge of $0.50 per one-sided copy to cover the cost of photocopying. B. Any KCVA member may obtain a copy of the Association By-Laws, Rules & Regulations, and other governing documents by submitting their request for a copy in writing. The Association may charge a reasonable fee to cover the cost of these copies, not exceed $15.00.
