Below are some notes and considerations for our January 10, 2017 meeting. AGRICULTURAL LAND UE This land use category has been trimmed down considerably since our last meeting. The agricultural uses listed under Farm Operations in the Michigan Right to Farm Act (Act 93 of 1981) have been removed, and Farm Operation has been added to the table. Farm Operation will need to be added to the definitions with a reference to the law. Further discussion and determination is needed for the variations of wineries, breweries, and distilleries. The definitions and provisions from the Michigan Liquor Control Commission will be reviewed. Minimum lot size 5 acres It was requested at the last meeting to review the Michigan Liquor Control Commission definitions on the various types of licensing they offer. Explanations are listed below, along with any Acme specific provisions: Breweries Brewer manufacture beer and sale to licensed wholesalers, allowed to: o Have multiple brewing facilities can serve for on-premises consumption at no more than two of their licensed facilities o Brew beer in one of their facilities, sell for consumption at their other facilities o Offer free tastings o ell for off-premise consumption o Cannot sell direct to retailers, must use a wholesaler o Must obtain a food establishment license o Acme Township AG provisions: pecial Use ermit Minimum 10 acres At least 5% of products grown in Acme, 75% grown in Michigan Micro Brewer same as Brewer, except indicated below: o No more than 60,000 barrels per year (combined production of all their facilities) o Micro brewers producing more than 30,000 combined barrels per year can serve for on-premises consumption at no more than three of their licensed facilities o Acme Township AG provisions: age 1 of 4

If operated by another person, MLCC has to agree. o Acme Township AG provisions Allowed by-right Minimum 10 acres, with at least 5 acres used for growing items used in production At least 5% of products grown in Acme, 75% grown in Michigan Although not specifically stated, I assume its reciprocated that you can also operate a small winery at the same location REIDENTIAL LAND UE FR: ingle Family Rural has taken over the former R-1: One-Family Forest & Coastal District o Minimum lot size 1 acre o Expanded the district boundaries from the previous R-1 FN: ingle Family Neighborhood has taken over the former R-2: One-Family Urban Residential and R-3: Urban Residential districts o Minimum lot size 15,000 sq ft w/ sewer; 20,000 sq ft w/o sewer o I combined the R-2 and R-3 uses in the table into the new FN. The only difference was that R-3 allowed duplexes and multifamily dwellings through U. With the expanded CF and MHN, along with the name ingle Family Neighborhood, these uses may no longer be appropriate o We have a previously existing ingle Family Neighborhood from the form-based code district. Those uses have been added to the new FN and are indicated with quotation marks ( or ) Duplexes were allowed by right in the previous ingle Family Neighborhood o hould FN still incorporate form-based code. Now that FN encompasses a much larger area, with larger lots, owners will be required to adhere to a 30 built-to-line (just one example) o hould Manufactured Homes stay as uses allowed by right in the AG, FR and FN Districts For some reason, they are not listed as a use in R-1MH: Mobile Home age 3 of 4

INDUTRIAL AND WAREHOUING LAND UE This is a new land use category that has been added. Uses formerly listed under Commercial Land Uses that appear to fit this description have been moved to this category The category hasn t been reviewed yet so you will see a lot of redundancy. Opportunity exists to trim this category down by consolidating specific land uses into broader descriptions. B-3: lanned hopping Center This district is proposed to be removed. I ve left the district, and its uses, in the table for the time being. The uses should be reviewed to determine if they are accounted for elsewhere in the Township o Either in another district, or under another land use category If not, are they uses we want to even keep, and therefore add to another district? age 4 of 4

ARTICLE 3 - REGULATED UE AND DIMENIONAL REGULATION 3.1 LAND UE AND ZONING DITRICT TABLE The Use Table in this Article lists by Land Use Type (i.e. residential, commercial, etc.) where a particular land use is allowed in a respective base zoning district. 3.2 ERMITTED UE [] If a land use is permitted by right in a Zoning District, it is identified by the symbol. 3.3 ECIAL LAND UE [] The symbol is noted if a land use is permitted after review and approval as a pecial Land Use in accordance with Article 5 this Zoning Ordinance. 3.4 UE NOT ALLOWED If a land use type is not allowed in a Base Zoning District, it is blank without a or. 3.5 ITE ECIFIC TANDARD Land use types, denoted with an, are further regulated with site specific standards are identified in Article 5, pecial Land Uses. 3.6 UNLITED UE If an application is submitted for a use type that is not classified in the Land Use Table of this Article, the lanning Commission is authorized to classify the new or unlisted use type into an existing land use category that most closely fits the new or unlisted use.
