RESTRICTED October 1956 SIM PROTOCOL RECTIFICATIONS AND MODIFICATIONS SCHEDULE IX - CUBA The Government of Cubs requests that the following rectifications and modifications be included in the Protocol bo be drawn up at the Eleventh Session. The following points are brought to the attention of the contracting parties. There have been deleted both in Part I and in Psrt II of Sehedule IX all the items which appeared with the indication "Not negotiated" in the "Rate of duty" column. Consequently the third of the General Notes appearing at the end of Parts I and II of Schedule IX, which explained the res son for the inclusion of these items, is also to be deleted. The Cuban Government does not consider it necessary to retain this note in view of the change in the circumstances which originally required its inclusion. In connection with the "Not negotiated" items, the Cubaç> Government wishes also to point out that Item 113-A has been listed amongst those which should be deleted from Part I of Schedule IX (Geneva), although it did not appear in the original Geneva Schedule: it was inserted therein by the first Protocol of Rectifications. As for Items 260-F, 260-G, 260-H, and 260-1, they appear in the First Protocol of Modifications, where their numbers were changed. With respect to Part II of Schedule IX, it will be noted that Item 260-1 appears among those to be deleted. This item appeared in the original Geneva Schedule as 260-H, but the number was changed by the first Protocol of Modifications. For reasons si ilar to those given in the case of "Not negotiated" items, the Cuban Government has decided to delete from Part II of Schedule IX (Geneva), items 166-D end 224-B, against which the note "See Part I" appeared in the "Rate of duty" column. Finally the Cuban Government wishes to refer to the renegotiations under Article XXVTII, and the Declaration of 10 March 1955 which Cuba entered into in Geneva in 1955 With Australia, Chile, Norway and Czechoslovakia (SECRET/22, Add.2), These negotiations have not been concluded. Although there is no reference in the attached list to the items initially negotiated with Czechoslovakia and there is ne indication to the effect that the items which are the subject of renegotiations with Australia, Chile and Norway should not continue to appear in the records of the CONTRACTING PARTIES as initially negotiated with these countries, this should not be understood to mean that all these items have been rebound. Their final status is in fact dependent on the result of the renegotiations mentioned above. MGT/14-2/56 T.S.V.P.

- 1(a) - SIXIEME PROTOCOLE DE RECTIFICATION ET DE MODIFICATION LISTE IX - CUBA Le Gouvernement de Cuba demande que les rectifications et modifications suivantes soient insérées dans le Protocole qui doit être établi lors de la onzième session. L'attention des parties contractantes est appelée sur les points indiqués ci-dessous. Toutes les positions reprises dans les Première et Deuxième Parties de la Liste IX qui comportent l'indication "Pas de négociation" dans la colonne du "Taux du droit" ont été retranchées de cette Liste. En conséquence, doit être également supprimé, dans les Notes générales qui figurent à la fin des Première et Deuxième Parties, le paragraphe III dont l'objet était d'exposer les raisons motivant l'insertion de ces positions. Le Gouvernement cubain estime qu'il n'est pas nécessaire de retenir cette note du fait de la modification des circonstances qui avaient exigé primitivement son inclusion. En ce qui concerne les positions en regard desquelles se lit la mention "Pas de négociation", le Gouvernement cubain désire également signaler que la position 113-A figure parmi celles qui sont retranchées de la Première Partie de la Liste XI (Genève) bien qu'elle n'ait pas été reprise dans la Liste originale de Genève; elle avait été insérée en application du premier Protocole de rectification. Pour ce qui est des positions 260-F, 260-G, 260-H et 260-1, elles apparaissent dans le premier Protocole de modification, où leurs numéros avaient été modifiés. Dans le cas de la Deuxième Partie de la Liste IX, l'on notera que la position 260-1 est comprise parmi celles qui sont à supprimer. Cette position figurait dans la Liste originale de Genève sous le numéro 260-H, mais celui-ci a été changé en application du premier Protocole de modification. Pour des raisons semblables à celles qui sont données dans le cas des positions comportant la mention "Pas de négociation", le Gouvernement cubain a décidé de retrancher de la Deuxième Partie de la Liste LX (Genève) les positions 166-D et 224-B en regard desquelles figure, dans la colonne du "Taux du droit", la mention "Voir Première Partie". Enfin, le Gouvernement cubain désire se référer aux renégociations que Cuba a engagées à Genève, en 1955, conformément à l'article XXVIII et à la Déclaration du 10 mars 1955, avec l'australie, le Chili, la Norvège et la Tchécoslovaquie (SECRET/22/Add.2). Ces négociations ne sont pas

Bien qu'aucune référence ne soit faite, dans la liste ci-annexée, aux positions négociées primitivement avec la Tchécoslovaquie et qu'il n'y ait pas d'indication à l'effet que les positions qui font l'objet de renégociations avec l'australie, le Chili et la Norvège ne devraient pas continuer à figurer dans les documents des PARTIES CONTRACTANTES comme ayant été négociées primitivement avec ces pays, ceci ne devrait pas être interprété comme signifiant que toutes ces positions ont été reconsolidées. Leur situation finale dépend, en fait, du résultat des renégociations mentionnées ci-dessus.
