EXECUTIVE SUMMARY Steil Surveying Services, on behalf of Hansen & Hansen, LLC, has submitted an application for a Subdivision Permit and Plat for West Ridge Estates 4th Filing, situated generally south of the intersection of Little Star Drive & Horse Creek Road. This subdivision is a reconsideration of West Ridge Estates, 1 st and 2 nd Filings to modify the approved and recorded plats to provide an additional note, per the Laramie County Board of Commissioners conditional approval of West Ridge Estates, 3 rd Filing, to Restrict Further Subdivision of all platted lots within all filings of the West Ridge Estates Subdivision(s). BACKGROUND The Laramie County Board of Commissioners approved the West Ridge Estates subdivision permit and plat on April 19, 2016, the West Ridge Estates 2 nd Filing subdivision permit and plat on August 2, 2016, and the West Ridge Estates 3 rd Filing subdivision permit and plat on February 21 st, 2017; all plats have subsequently been recorded. Pertinent Regulations Section 2-1-101 (a-d) of the Laramie County Land Use Regulations governing the criteria for a subdivision permit. DISCUSSION The Laramie County Comprehensive Plan (2016) describes this area as best suited for Rural Ag Interface (RAI). This category recommends primarily residential development with limited service commercial and retail uses at major intersections. Density of uses should be based on availability and access to water. The Plan also notes that due to lengthy response times, existing topography and limited reliable water resources, cisterns are encouraged in any development within the RAI area as well as utilizing fire-wise planning. The proposed plat re-creates each of the lots in West Ridge 1 st and 2 nd Filing, with an average (net) size of 15.47 acres each. The intended use for the lots is single-family residential. The nine lots created would require individual well and septic systems. Given the proposed lot size, it appears there is adequate area. A sign was posted on the property and notice was sent to adjacent property owners regarding this application. Staff received no public comment regarding this application. Agency comments were received regarding discrepancies on the plat, which have been corrected on the revised plat submitted May 26, 2017. The Laramie County Land Use Regulations have criteria for a subdivision permit and plat. This application meets minimum requirements as a replat of nine existing lots with no change in lot size or configuration. Staff finds the proposed Subdivision Permit is in conformance with the plans and policies of the Laramie County Comprehensive Plan (2016) and the Laramie County Land Use Regulations (2011). The Laramie County Planning Commission held a public hearing of this application on June 8, 2017. No public comment was received. The Planning Commission voted (3 0) to recommend approval to the Board with no conditions. RECOMMENDATION and FINDINGS Based on evidence provided, staff recommends the Laramie County Board of Commissioners find that: a. This application meets the criteria for a subdivision permit pursuant to section 2-1- 101 (a-d) of the Laramie County Land Use Regulations. b. The drainage information previously submitted still applies to this replat so no new drainage information is required. Surveyor Review 1. The DEDICATION indicates ALL OF TRACTS 1 THRU 5, WEST RIDGE ESTATES, 1ST FILING AND ALL OF TRACTS 6 THRU 9, WEST RIDGE ESTATES, 2ND FILING, are to be surveyed, vacated and re-platted as WEST RIDGE ESTATES, 4TH FILING. Tract 9 of WEST RIDGE ESTATES, 2ND FILING was omitted from the VACATION STATEMENT and it was also omitted from the description of land included in the subdivision shown in the Title Block. 2. States that all public land survey corners on or within the subdivision boundary shall have field observation coordinates provided on the plat. These coordinates shall reference Wyoming State Plane Coordinate System, East Zone, U.S. Survey foot, NAD 1983(CORS96).. Three Wyoming State Plane Coordinates are provided on the Plat: the Southwest Corner of Section 29, the Southwest Corner of Tract 9 and the Northwest Corner of Tract 1. Using the State Plane Coordinates provided and inversing between the Southwest corner of Section 29 and the Southwest Corner of Tract 9 the bearing and distance are, N54 48 30 E - 1616.77 feet, not matching the Plat bearing and distance. Using the coordinates provided and inversing between the Southwest corner of Tract 9 and the Northwest corner of Tract 1 the bearing and distance are, N38 18 10 W -- 2132.79 feet, not matching the Plat bearing and distance. Please correct or explain the differences. 3. Note 2 indicates that the Bearings are based on the West Line of Section 29, having a bearing of N00 06 17 E. Is that bearing astronomic, Wyoming State Plane Grid Based or is it assumed? 4. The point of curvature for C5 in the Northeast corner of Tract 3 is not identified with any type of symbol. 5. The Vicinity Map would be easier to read and it would be more useful to the lay public if one were to add some information such as, at a minimum, the Section, Township and Range data with enough detail to indicate the location of the subdivision within the Section. It is helpful to identify where the subdivision is located with respect to nearest well known community or significant area feature that the general public is familiar with and can relate to. 6. As a final note, I did not see any mention of irrigation water rights on the subdivision so I assume there aren t any on the subdivision. Minutes of the Proceedings West Ridge Estates, 4 th Filing Laramie County Planning Commission Prepared by the Laramie County Planning & Development Office Laramie County Wyoming Thursday, June 08, 2017 170608 00 The Laramie County Planning Commission met in regular session on Thursday, June 8, 2017 at 3:30 p.m. Members in attendance were: Commissioner Jody Clark, Chairwoman; Commissioners Jason Caughey and Joe Patterson; Brad Emmons, Planning Director; Rebekah Puchek, Planning Technician/Recording Secretary. The meeting register was signed by: Casey Palma, 1102 W 19th Street, Cheyenne, WY. 01 Review and action of a Subdivision Permit and Plat for West Ridge Estates 4th Filing, a replat of West Ridge Estates 1st and 2nd Filings, Laramie County, WY. Brad Emmons, Planning Director, introduced the only item and Casey Palma of Steil Surveying Services as agent for the applicant. Mr. Palma briefly described the re-subdivision of West Ridge Subdivision 1st and 2nd Filings in order to add a notation to the plat to the effect that further subdivision of any lot was prohibited. Mr. Emmons gave an overview of the staff report. Staff found the proposed subdivision permit and plat was in conformance with the plans and policies of the Laramie County Comprehensive Plan and Laramie County Land Use Regulations and recommended approval with no conditions. Commissioner Clark opened the hearing to the public. Hearing no comment, the public portion of the hearing was closed. Mr. Palma made note that two additional easements had also been added to the plat. Commissioner Patterson moved to recommend approval of the application to the Board of County Commissioners.
