Under the Ca. Education Code the sale of surplus property can only occur with special conditions: Board of Education must convene a Surplus Property/7-11 Committee and make public findings to declare property surplus. This happened in 2007. Property must first be offered to public agencies before being sold in public auction Proceeds of Property sale can only be used for facility related capital improvements or construction Lease revenue is allowed to be used in the general fund for regular school district expenditures Current District Strategy for surplus and other real property development is: to not sell property, unless there are unique or overriding conditions to leverage District real property assets for on-going annual revenue that will aid the general fund, including long term ground lease, development or exchange for income property
