Background: Chuck Millar and Harvey Oyer on behalf of 207 Dixie LLC, 424 Datura LLC, and 427 Evernia, has submitted a petition for the abandonment of the platted 14-foot alley, consisting of approximately 5,460 square feet, and located between Quadrille Boulevard and Dixie highway, north of Evernia Street and south of Datura Street, pursuant to Chapter 78, Article VII, of the Code of Ordinance of the City of West Palm Beach, Florida. The applicants are the owners of the property north and south of the subject right-of-way and are proposing the construction of a new 8-story 316 residential unit building. The applicants agreed to compensate the City in the amount of $490,000 as the value for the alley to be abandoned, as estimated by an appraisal conducted by Anderson & Carr, Inc., dated June 24, 2015. By Resolution No. 284-15, on October 13, 2015, the City Commission made findings and approved the abandonment of the alley and authorized the Mayor to execute the Disclaimer of interest in the alley upon receipt of the agreed compensation.
AGENDA COVER MEMORANDUM Page 2 C.M. # Date: The applicants now request, in order to simplify their loan closing and the issuance of title insurance, that the Mayor be authorized to execute the Disclaimer in advance and deposit it into escrow with a provision that it cannot be recorded until the City receives the agreed compensation, which compensation will come from the loan closing; Resolution No. 86-16 amends Resolution No. 284-15 and authorizes the Mayor to sign the Disclaimer, along with an escrow instruction letter to the title company, and allows the Disclamer to be delivered to the title company with instructions that the Disclaimer cannot be recorded until the compensation is paid to the City. Upon adoption of this Resolution, the Mayor is hereby authorized to execute a Disclaimer, in form and substance similar to that attached as Exhibit C to Resolution No. 284-15, to disclaim the City s interest in said right-of-way.
SECTION 2: SECTION 3: SECTION 5: RESOLUTION NO. 86-16 B. All other provisions of Resolution No. 284-15 shall remain unchanged and in effect. The Mayor is further authorized to execute an escrow instruction letter to First American Title Insurance Company, the title agency handling the applicants closing, directing that the Disclaimer is to be held in escrow and cannot be recorded until the City receives the agreed compensation of $490,000. Such letter shall be in a form approved by the Office of the City Attorney. After execution of the Disclaimer and the escrow instruction letter by the Mayor, the City Clerk shall provide the original Disclaimer, original letter, and a certified copy of this Resolution, to the Deputy City Attorney for forwarding to First American Title Insurance Company. This Resolution shall take effect immediately. The Disclaimer approved by Resolution No. 284-15 shall not take effect or be recorded in the Public Records until the City has received the agreed compensation.
