Serbia Should Have Online Cadastre for Property Like Other Countries in the Region Tamara Borovcanin USAID Business Enabling Project The online real estate registry allows citizens to quickly and easily obtain complete information on real estate in one place information about position, shape, size, and also data about owners, about those with the usage right or about tenants. At the same place citizens also can get a copy of the plan and immovable property, which is in fact the ownership paper. Unlike its neighbors, Serbia still has no online real estate cadastre, although some projects are dealing with these issues over the last few years. In The Directorate for the digital agenda at the Ministry of Culture, media and information society, one project regarding improving e Government Portal (www.euprava.gov.rs) is in progress. The idea is to connect e Government Portal to the real estate register RGA. After logon to qualified electronic certificate, citizens, legal entities and state authorities will be able to access the real estate registry and see what real estate is their own property (in their possession). Insight into self owned real estate will be based on personal identification number and property owners will also be able to apply for registration of immobility. Positive side of Serbia's lagging comparing to the countries in the region is that it will be able to compare different solutions, see all benefits and drawbacks, and finally make the most quality e cadaster portal that will make easier life for all. Slovenia http://www.gu.gov.si/en/services/podatki_gu/#c12821 FYR Macedonia WEB of The Agency for Real Estate has a system overview of the cadastral data. This system gives to user some basic/general data (like data of owner and some basic data about parcels), but for all further information user needs to be registered. On the WEB it is possible to check the status of the request submitted to the counters in the cadastre of the Republic of Macedonia, but for this service users need to enter the password for online preview, which is the acknowledgment of receipt of application. At this point the data is available for the Center for Real Estate Skopje, Cadastre Offices for Real Estate Kavadarci, Negotino Kratovo, Sveti Nikole, Probistip Palanka, Kumanovo, Struga, Debar, Resen, Kicevo, Gevgelija and Valandovo. Using web services insight in property list to use the service, available in the property sheet through a web service of the Agency for Real Estate, user needs: to register the website, to download the contract for this service, legible to fill in six samples, payments to the bank account in cash value of the number of searches that you want to use according to tariff. According to the contract, information that are available on web are: The A list data for the right holder of the property (owner),name, surname / name, address of residence / office and part of the estate; The B list data estate cadastre plot (number of CP, sub number, number of building built on the cadastral parcel, name of the place / street, cadastral culture, area and real estate right); The V list data for structures built on cadastral plot number and sub number of the CP, the number of building, entrance, floor, apartment number, purpose of the building, name of the place / street surface and the real estate right; The D List data of mortgage / notes / restrictions Real burden, right of pledge, mortgage, servitude, other loads and limitations, facts and circumstances related to the holder of real estate right. Data obtained through the WEB service have an informative character and cannot serve as a public document. The tariff for the fee for using the data: for 1 20 insights to data (electronically from) user pays 70 denars; for 21 100 insights user pays 60 denars; for more than 101 insights user pays 50 denars. Data kept in the database are official cadastral data. Browser provides access to cadastral data from a specific date for the whole country. Insight into data is possible via a number of plot or by the number of the title deed in your chosen cadastral municipality. Printing the title deed has an informative character and cannot serve as a public document. Public documents issued by the competent local cadastral offices and their branches. The browser allows access to 2,939,654 sheets of possession and access to data on 16.940.829 land plots. The possession sheets recorded a total of 14.420.394 cadastral units and 2.379.619 people. Montenegro Data related to cadastre on the website of the Department of Real Estate are available for everyone and they were all updated 10.10.2011. Important information is that user doesn t need any kind of identification number to go through website. To go through the Overview of cadastral records of the estate of Montenegro, user needs to choose the Cadastral records or Holders of rights to real estate. Further on, he needs to choose one of the political and cadastral municipalities on the list. Eventually, user can search data by issue of property (deed) or by parcel number. Holders of rights to real estate can search data by ID number of holder. For these searches users have no expenses. Slovenia All products and data collected by the Geodetic Administration of the Republic of Slovenia (Gürsu) are public and available to all users for their personal use with payment of fee that varies depending on the application. The Surveying and Mapping Authority of the Republic of Slovenia shall not transfer the ownership of the data to the Client and shall not assume responsibility for any data defects and consequences thereof. Upon receiving the data, the Client shall obtain the right to use the data for the purpose for which they were obtained. The Client may authorize another person to obtain or process the data, but the Client shall advise such a person of the Terms and Conditions of the Use of Geodetic Data.

In the event of processing geodetic data that includes personal data the Client shall act in compliance with the Personal Data Protection Act (ZVOP 1, Official Gazette of the Republic of Slovenia, Nos. 86/04 and 113/05). The Client shall advise the Surveying and Mapping Authority of the Republic of Slovenia of any changes to the purpose of the use of the data. The Client shall undertake to ensure to cite the source of data which shall comprise "Public Information of Slovenia, the Surveying and Mapping Authority of the Republic of Slovenia, type of data with each use and any publication of data or products. Additionally, the Client shall indicate the time such data refer to or the date of the acquisition from the database. The Client shall undertake to ensure that in case of internet publication the data shall be used only as a basis for presenting other content and shall not be presented independently. The link to the Surveying and Mapping Authority of Slovenia website shall also be included: www.gu.gov.si. The Client shall not be permitted to distribute the data to third persons unless it is expressly permitted in a contract or by other means. The Client shall secure data and products thereof from unauthorized access by third parties. The right to use the data shall expire should the Client infringe the terms and conditions of use either intentionally or by negligence. The fine of 625.94 to 1.251.88 EUR (150,000 to 300,000 SIT) shall be imposed for an offence on an individual and a fine of 1.251.88 to 12.518.78 EUR (300,000 to 3,000,000 SIT) shall be imposed for an offence on a legal person or a sole proprietor, who re uses the public information for lucrative purposes for which the body charges a fee or stipulates other terms and conditions, when such use was not authorized by the body.
