THE BENEFITS OF NEW BUILD HOMES New developments make ideal places to live, or invest your money in. Newly built properties are designed with energy efficiency in mind, lowering household bills and providing a clean, bright space. For investors, it means that properties are ready to move into, have few repairs and decoration costs for the first few years. Properties should be guaranteed by NHBC or similar, for 10 years with a warranty and protection scheme. THE PROCESS The process of buying a property off- plan in the UK differs from purchasing an existing home. Most new development purchases take the following process: RESERVATION CONTRACT COMPLETION 1 2 3 RESERVATION Once the purchase price has been agreed, the buyer will officially reserve the property and pay a fee to secure the apartment and ensure it is no longer marketed for sale in the time period before the exchange of contracts. The reservation will normally afford the buyer a period of exclusivity in which to formalise the purchase of the property without the fear of incurring any unnecessary costs. At the reservation stage the purchaser is required to supply photographic identification and a current proof of address as part of the Anti-Money Laundering (AML) check process. CONTRACT Following agreement of reservation both parties will instruct lawyers. The seller s lawyer will send all the relevant documentation pertaining to the property to the buyer s lawyer for review. Investigative searches and due diligence on the contract, evidence or ownership are carried out by the buyer s lawyer to produce a Report on Title which is delivered to the buyer prior to the formalisation of contracts. Together the lawyers agree the exact wording of the contract. The terms may vary from one transaction to another depending on the parties and the property. In the case of a new development the buyer will purchase the property on a set of plans and specifications setting out what the developer has agreed to construct. If there is an exclusivity period contracts must be formalised by an agreed deadline. If the buyer decides to proceed with the purchase they will sign the contract and return to their lawyer. When contracts are exchanged both parties are locked into the transaction and each party will have a dually signed copy of the contract handed over to the other party an exchange of contracts. Usually a 10% deposit is payable on exchange of contracts. Depending on the contractual terms a larger deposit or stage payment between exchange and completion may also be required. It is important for the purchaser to take legal advice to ensure that any deposit payments are properly protected by way of suitable contractual provisions or warranty. On exchange of contracts both parties are legally bound to complete the purchase. The buyer should ensure that they have the ability to put in place the necessary funding for completion and any requisite stage payments. COMPLETION Completion of the transaction will take place at an agreed date when the property is ready for occupation. The buyer will pay the balance of the purchase price and will receive keys to the property once receipt of the monies is confirmed. In the case of new build, completion is normally on notice from the seller that the property is finished in accordance with the plans and specifications outlined in the contract. A surveyor may inspect the property for any outstanding snagging items prior to completion. A purchaser should take comprehensive legal advice to ensure the contract contains adequate sureties that the completion process is undertaken properly. In the run up to completion the buyer s lawyers will prepare a completion statement setting out the funds required from the buyer to complete the purchase, including the costs associated with the purchase.
