Cunningham, Director of Public Works (Staff Contact: Tim Burke, (707) 449-5170) AUTHORIZATION FOR THE DIRECTOR OF PUBLIC WORKS TO EXECUTE A SUBDIVISION IMPROVEMENT AGREEMENT FOR INSTALLATION OF INFRASTRUCTURE IN THE BRIGHTON LANDING, VILLAGE 6 SUBDIVISION; and DISCUSSION: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VACAVILLE APPROVING A FINAL MAP TO CREATE A 51-UNIT SINGLE FAMILY SUBDIVISION AT BRIGHTON LANDING, VILLAGE 6; and RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VACAVILLE TO SUMMARILY VACATE THE PUBLIC UTILITY EASEMENT AND PUBLIC ACCESS EASEMENT WITHIN THE BRIGHTON LANDING, VILLAGE 6 SUBDIVISION The Brighton Landing, Village 6 subdivision is a 51-unit single-family development totaling 8.21 acres. The developer is Woodside 05N, LP, a California limited partnership. The Brighton Landing, Village 6 development is located just south of Elmira, approximately 3000 feet east of Leisure Town Road (Attachment 1). The Tentative Map was approved by the City Council on February 26, 2013. The single family lots range in size from 4,000 6,286 square feet, with a majority of the lots in the 4,000 4,160 square foot range. Staff has reviewed the improvement plans and final map, and has negotiated a Subdivision Improvement Agreement with the developer for the construction and installation of the infrastructure detailed on the improvement plans and final map. The developer has paid the necessary fees and posted the required bonds. Public utility easements (PUE) and public access easements (PAE) were dedicated to the City with the approval of the Brighton Landing Large Lot Final Map. Typically, the proposed right-ofway, PUE and PAE on the individual Final Maps match that previously dedicated with the Large Lot Final Map; however, minor modifications have been made to the street layouts from what was anticipated with the Large Lot Final Map, leaving remnants of the PUE and PAE dedicated with the Large Lot Map needing to be abandoned. In accordance with the Public Streets, Highways, and Service Easements Vacation Law, the Public Utility Easement and Public Access Easement as shown on Attachment 1 may be summarily vacated because it is deemed surplus. The easement was dedicated at no cost to the City and will, therefore, be vacated at no cost to the property owner in accordance with the City s abandonment policy.

FISCAL IMPACT: There is no impact to the General Fund as a result of this action. RECOMMENDATION: By simple motion: 1) Authorize the Director of Public Works to enter into a Subdivision Improvement Agreement with Woodside 05N for Brighton Landing, Village 6 Subdivision; and 2) Adopt the subject resolutions. RESOLUTION NO. 2017- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VACAVILLE APPROVING A FINAL MAP TO CREATE A 51-UNIT SINGLE FAMILY SUBDIVISION AT BRIGHTON LANDING, VILLAGE 6 WHEREAS, Woodside 05N, LP, a California limited partnership, ( Subdivider ) hereby submits to the City Council of the City of Vacaville a map of a proposed subdivision within the City limits called Brighton Landing, Village 6; and WHEREAS, the Tentative Map has heretofore been approved by the City Council of the City of Vacaville; and WHEREAS, Subdivider executed a Subdivision Improvement Agreement with the City of Vacaville, covering said subdivision, in which the Subdivider covenants to construct all public improvements shown upon said subdivision map, in accordance with applicable laws, ordinances and specifications, and to hold harmless the City of Vacaville from material and labor claims for such construction; and WHEREAS, the City Council of the City of Vacaville has authorized the Director of Public Works or his designee to execute the Subdivision Improvement Agreement covering said subdivision; and WHEREAS, said Subdivider has delivered to the City Clerk of the City of Vacaville a corporate surety bond as security for his performance of the terms of said Agreement. NOW, THEREFORE, BE IT RESOLVED that said final map and all offers of dedication for public use for the easements and facilities shown thereon are approved and accepted by the City of Vacaville. I HEREBY CERTIFY that the foregoing resolution was introduced and passed at a regular meeting of the City Council of the City of Vacaville, held on the 23rd day of May, 2017, by the following vote: AYES: NOES: ABSENT: ATTEST: Michelle A. RESOLUTION NO. 2017- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VACAVILLE TO SUMMARILY VACATE THE PUBLIC UTILITY EASEMENTS AND PUBLIC ACCESS EASEMENTS WITHIN THE BRIGHTON LANDING, VILLAGE 6 SUBDIVISION WHEREAS, Public utility easements (PUE) and public access easements (PAE) were dedicated to the City along with the approval of the Brighton Landing Large Lot Final Map; and WHEREAS, the Brighton Landing Village 6 Final Map will modify the required right-ofway, public utility easements, and public access easements, rendering the previously dedicated public utility easement and public access easements surplus; and WHEREAS, in accordance with Government Code Section 65402, the City Council, acting as the Planning Agency for such purposes, finds that the proposed abandonment of said public utility easement does not conflict with any applicable provision or policy of the City s adopted General Plan or any of its elements; and WHEREAS said easement was dedicated at no cost to the City and will be vacated at no cost to the property owner; and WHEREAS, this Vacation is a summary vacation pursuant to Streets and Highways Code, Chapter 4, Sections 8300et seq.. WHEREAS, that from and after the date this resolution is recorded, the easements as described on the Brighton Landing Village 6 Final Map no longer constitutes a public utility easement and public access easement. NOW, THEREFORE, BE IT RESOLVED that the City of Vacaville hereby abandons the public utility easement and public access easements as described on the Brighton Landing Village 6 Final Map; and I HEREBY CERTIFY that the foregoing resolution was introduced and passed at a regular meeting of the City Council of the City of Vacaville, held on the 23rd day of May, 2017, by the following vote: AYES: NOES: ABSENT: ATTEST: Michelle A.
