Section 7.07. Intent The requirements of this Section are intended to provide for the orderly growth of the Town of Holly Springs and its extra-territorial jurisdiction by establishing guidelines for: the coordination of streets or highways within a proposed project or subdivision with existing or planned streets or highways; the dedication or reservation of rights-of-way or easements for street purposes; distribution of population and traffic in a manner that will avoid congestion and overcrowding; and, the provision of easements not prepared in connection with a final plat. A. General Requirements. 1. Street Layout and Arrangement. In order to provide for the convenient movement of traffic, effective fire protection, efficient provision of utilities or where such connection is in accordance with the comprehensive plan, streets shall be arranged so as to: a. provide for the continuation of collector streets and thoroughfare streets between adjacent subdivisions; b. maximize interconnectivity between projects and subdivisions and within projects or subdivision; and, c. minimize the use of cul-de-sac streets. 2. Dedication of any Street by Final Plat. Pursuant to GS 160A-372, land shall be dedicated and reserved within in each subdivision for street right-of-way purposes. When a street is dedicated in connection with a subdivision, the approval of a final plat shall not be deemed to constitute or effect the acceptance by the Town of Holly Springs of any street shown on the final plat. The Director of Engineering is hereby authorized by the Town Council to accept public dedication of streets upon the following conditions: a) the street is located on lands within the corporate limits of the Town; b) the street has been constructed within a recorded right-of-way and done so in accordance with the Town of Holly Springs Engineering Design and Construction Standards; c) the warranty period for the street construction has expired and no warranty issues remain; and d) the person dedicating the street is not otherwise in default of any other obligation to the Town. Acceptance of dedication of lands for street right-of-way purposes located within the subdivision jurisdiction of this UDO, but outside the corporate limits of the Town of Holly Springs, shall not place on the Town of Holly Springs any duty to open, operate, repair or maintain any street, and the Town of Holly Springs shall, in no event, be held to answer in any civil action or proceeding for failure to *Amended Supplement #15 7.07-1 Town of Holly Springs

B. Street Design. open, repair or maintain any street located outside the corporate limits of the Town of Holly Springs. [Amended Ordinance #13-09, 14-07]* [Removed Ordinance #13-09] All streets, whether public or private, shall comply with the following general requirements for street design. 1. Street Classification. All proposed projects or subdivisions submitted for approval pursuant to this UDO shall allocate adequate areas for streets in conformity with the Comprehensive Transportation Plan and the Town of Holly Springs' Engineering Design and Construction Standards. [Amended Ordinance #12-05] 2. Street Names. Streets which are extensions or a continuation of, or obviously in alignment with, any existing streets, either constructed or appearing on any validly recorded plat or survey, or valid plat previously approved by the Town of Holly Springs, shall bear the names of such existing streets. Names for all other streets shall be sufficiently different in sound and in spelling from other streets in Wake County, irrespective of the use of a suffix (e.g., street, road, drive, place, court, etc.), so as to avoid confusion. All street names shall be approved by Wake County prior to recording of a final plat. 3. Access to Thoroughfares. If the proposed project or subdivision abuts upon or contains an existing or proposed thoroughfare street limited access street or in some cases collector streets, the subdivision street plan shall provide a new street type connection connecting the project or subdivision to the existing street. Each lot in the project or subdivision that abuts the existing street shall have access on the new street. This shall be in in conformance with the Town of Holly Springs' Engineering Design and Construction Standards. [Amended Ordinance #13-09] 4. Extension of Streets. All streets shall be extended by dedication, construction and acceptance across the entire frontage of all lots, phases or sections within a project or subdivision which have frontage on such street. 7.07-2 Town of Holly Springs *Amended Supplement #15

5. Secondary Means of Access. See Town of Holly Springs' Engineering and Design Construction Standards. 6. Street Stub-Out for Interconnectivity. See Town of Holly Springs' Engineering and Design Construction Standards. 7. Frontage on Improved Streets. All projects or subdivisions shall be designed so that all areas to be developed or subdivided shall have frontage on and gain access from: a. an existing Town or State street; or, b. a street shown upon a final plat approved by the Town of Holly Springs and recorded in the office of the Wake County Register of Deeds. Such street shall be improved as required by the rules, regulations or specifications of the State of North Carolina or the Town of Holly Springs, whichever is stricter, with the width of the right-of-way and pavement to be in compliance with the Comprehensive Transportation Plan and this UDO. [Amended Ordinance #12-05] 8. Grading and Improvement Plan. Streets shall be graded and improved to conform with the construction standards and specifications set forth in the Town of Holly Springs' Engineering Design and Construction Standards and Ordinance No. 00-023 Soil Erosion and Sedimentation Control. Such construction standards and specifications shall be indicated on the required construction drawings shall be approved as to design and specification by the Director of Engineering. 9. Topography and Arrangement. See Town of Holly Springs' Engineering and Design Construction Standards. 10. Street Signs. The Town of Holly Springs shall, at the developer's or subdivider's expense, erect or place street name signs, pavement marking and traffic control signs in conformance with the Town of Holly Springs' Engineering Design and Construction Standards, Town Policy and the North Carolina Manual on Uniform Traffic Control Devices at every street intersection within the project or subdivision. *Amended Supplement #14 7.07-3 Town of Holly Springs

11. Reserve Strips. The creation of reserve strips adjacent to the right-of-way which may be used to deny access to a street shall not be permitted. 12. Cul-de-sac Streets. See Town of Holly Springs' Engineering and Design Construction Standards. [Removed Ordinance #12-05] 13. Widening and Realignment of Existing Streets and Thoroughfares. a. Projects or Subdivisions When any land proposed for a residential subdivision, multifamily project, non-residential incremental subdivision, commercial / mixed use project, industrial project or any other type of project or subdivision: has frontage on a proposed or existing street, alley public way or other thoroughfare; borders an existing narrow street; or, when the Comprehensive Transportation Plan indicates plans for realignment or widening of a street that would require use of some of the land in the project or subdivision, one-half (1/2) of the right-of-way of such street, alley, public way or other thoroughfare shall be dedicated for the full length of the frontage of such lot, project or subdivision in accordance with the requirements and specifications of the Town of Holly Springs Comprehensive Transportation Plan and Town of Holly Springs Engineering Design and Construction Standards in connection with: the final plat for a subdivision; or, the issuance of a certificate of compliance for any other project (except UDO permits for signs). Further, Owners shall agree to construct the improvements (including medians and sidewalks as determined by the Director of Engineering) required in such right-of-way along the entire frontage or frontages of the lot, project or subdivision in accordance with the provisions of the Comprehensive Transportation Plan and the Town of Holly Springs' Engineering Design and Construction Standards. Subject to the approval of the Town Council, a payment-in-lieu of street construction may be accepted. Minor Subdivisions of land under individual ownership, for the purpose of creating single family residential lots, shall not ordinarily be required to construct road improvements. Single Family Dwelling or Two Family Dwelling Prior to the issuance of a UDO permit for the development of any single family dwelling or two family dwelling on any lot located along any existing or proposed street or thoroughfare as indicated on the Town of Holly Springs' Comprehensive Transportation Plan, the Owner shall dedicate right-of-way to the Town of Holly Springs for such street or thoroughfare in accordance with the 7.07-4 Town of Holly Springs *Amended Supplement #14

requirements and specifications of said Comprehensive Transportation Plan. [Amended Ordinance #12-05] c. Incorporation of Existing Streets When any land proposed for project or subdivision includes or is traversed by a proposed or existing street, alley, public way or other thoroughfare, such street, alley, public way or other thoroughfare shall be incorporated into the project or subdivision as a functional part of the street system of the project or subdivision and shall be constructed in accordance with the Comprehensive Transportation Plan and the Town of Holly Springs' Engineering Design and Construction Standards. Limitation Land reserved for any street purposes, whether public or private, or by right-of-way or easement, shall not be counted in satisfying the minimum yard or lot area requirements of this UDO. 14. Dedication of Public Streets on a Final Plat. All public streets shown on a final plat shall be designated in accordance with GS 136-102.6. The designation of a street as public on a final plat shall be conclusively presumed an offer of dedication of such street to the public free and clear of all liens and encumbrances. 15. Design and Construction Standards for All Public Streets. In order to provide for streets which are of a suitable location, width, material and cross section to accommodate prospective traffic and afford satisfactory access to traffic, including public safety vehicles, snow removal, sanitation, and road maintenance equipment, and to coordinate streets so as to compose a convenient system and avoid undue hardships to adjoining properties, all streets which are to be dedicated to and accepted for maintenance by the Town of Holly Springs shall be designed and constructed in accordance with the Town of Holly Springs' Engineering Design and Construction Standards and Comprehensive Transportation Plan. [Amended Ordinance #13-09]* 16. Curb and Gutter. Curb and gutter shall be provided for all streets in all projects or subdivisions in accordance with the Town of Holly Springs' Engineering Design and Construction Standards. 17. Street Lighting. Street lighting shall be provided along all interior and perimeter streets, at the developers or subdivider's expense, in accordance with the most recent street lighting policy adopted by the Town of Holly Springs. *Amended Supplement #14 7.07-5 Town of Holly Springs

18. Excess Right-of-Way or Slope Easement. Right-of-way widths in excess of those recommended by the Comprehensive Transportation Plan and required by this UDO or slope easements shall be required whenever, due to topography, additional width is necessary to provide for adequate and stable earthen side slopes. Such earthen side slopes shall not be in excess of one (1) foot vertical for each three (3) feet horizontal. [Amended Ordinance #12-05] 19. Bridges. Bridges of primary benefit to the subdivider, as determined by the Town Council, shall be constructed at the full expense of the subdivider without reimbursement from the Town of Holly Springs. [Amended Ordinance #04-06] 20. Alleys. Alleys may be proposed in such instances where the use of alleys was indicated on an approved development plan for residential development options or infill development options. [Amended Ordinance #10-11, #15-11]* 21. Private Streets, Private Alleys, Interior Access Driveways and Interior Access Drives. a. Design Standards Private streets or private alleys (which are not intended to be dedicated to or accepted by the Town of Holly Springs for maintenance) which have been authorized for use shall comply with the minimum pavement width standards and the minimum depth and materials standards set forth in the Town of Holly Springs' Engineering Design and Construction Standards. Services Prior to the issuance of a UDO permit or obtaining final plat approval, the developer or subdivider shall file documentary assurances with the Town of Holly Springs that all lots served by private streets or private alleys shall be provided with the following services: regular trash pick-up; leaf pick-up; snow removal; daily mail delivery service; roadway maintenance and repair, including, but not limited to, driving surface, roadway subgrade, subsurface drainage, roadside drainage, curbs, sidewalks, street lights, street name signs, traffic control signs, and traffic control signals; and, powers to enforce speed control and parking regulations. Such services shall be provided in accordance with the specifications approved by the Town Council, which shall include the establishment of a maintenance fund or escrow account by the developer or subdivider, which may be supplemented by regular or special assessments against each lot owner provided such assessments are at reasonable and non-discriminatory rate of charge. assurances shall be incorporated into the applicable final plat that is recorded in the Office of the Register of Deeds or otherwise provided for through legally binding perpetual agreements as approved by the Town Council. [Amended Ordinance #04-06] 22. On-Street Parking Areas. C. Sidewalks. Perpendicular, angled or parallel on-street parking areas may be approved for use on local streets where the on-street parking areas: a. are located in the Town Village District; [Amended Ordinance #04-11]* b. are consistent with the intent of an approved development plan; c. will not interfere with the safe and efficient flow of typical or emergency traffic; and, d. where the design of such on-street parking areas are approved by the Director of Engineering. 1. Sidewalk Location. 2. Walkway or Pedestrian / Bike Path Alternative. Under appropriate circumstances or when approved for use as part of a development plan approval, an alternative walkway or pedestrian / bike path may be proposed in addition to sidewalks. Walkways or pedestrian / bike paths shall be a minimum of eight (8) feet in width to a maximum of eighteen (18) feet in width and may be located in easements reserved for such use outside of the street right-of-way. 3. Sidewalk, Walkway and Pedestrian / Bike Path Standards. Sidewalks shall be constructed in compliance with the Town of Holly Springs Engineering Design And Construction Standards. Walkways or other pedestrian / bike paths may be constructed of concrete, asphalt or other approved material. The proposed materials and standards for construction to be used shall be included as part of the request for such walkways or other pedestrian / bike paths. The walkways or other pedestrian / bike paths shall be installed in compliance with the approved materials and standards. 4. Pedestrian Access Easements. In order to facilitate pedestrian access from streets to schools, parks, playgrounds, or other nearby streets, a perpetual, unobstructed pedestrian access easement, at least twenty (20) feet in width, may be required. Such pedestrian access easements shall be provided: on the final plat; or, by separate grant of easement subject to the approval, by resolution, of the Town Council.
