NON-NEGOTIABLE STATEMENT OF OWNERSHIP REGISTRATION N0N- TRANSFERABLE REGISTRATION JULY 2013; KEYWORDS Title Only Registration Only NEW Non-Negotiable Title STATUTES, (KSA) 92-51-27 8-1,111 Back NEGOTIABLE TITLE AND NON-NEGOTIABLE STATEMENT OF OWNERSHIP CERTIFICATE NEGOTIABLE TITLE is any title, issued by Kansas or another titling jurisdiction which is used as the ownership document and to transfer the vehicle s ownership by assignment on same. NON-NEGOTIABLE STATEMENT OF OWNERSHIP CERTIFICATE is a Kansas certificate which is issued to: A foreign owner (of a gray market vehicle), or A Kansas resident leasing a, semi-trailer and/or truck registered >16M or truck-tractor needing a Kansas registration to operate in Kansas. A non-negotiable statement of ownership certificate is nontransferable and cannot be used as proof of ownership or to assign ownership to a new buyer. A non-negotiable statement of ownership certificate is issued for registration purposes only. NOTE: The non-negotiable statement of ownership certificate is replacing the non-negotiable title. Vehicles previously issued a non-negotiable title DO NOT need to replace the non-negotiable title with a certificate. WHEN IS A NON-NEGOTIABLE STATEMENT OF OWNERSHIP NEEDED A Non-Negotiable Statement of Ownership certificate will be used when a vehicle is required to display a Kansas registration but cannot be titled in Kansas for one of the following reasons: A foreign* owner brings their personal vehicle with them into the United States and the vehicle CANNOT be sold in this country (AKA: gray market vehicle), or A Kansas resident is leasing a heavy truck or semitrailer and operating same in Kansas for 30 days or more is required to display a Kansas registration in his
or her name or business name. * The owner is not a citizen of the United States, i.e. foreign college student, foreign military member stationed at a U.S. military base in Kansas. MAKING APPLICATION AND ISSUING OF A NON- NEGOTIABLE STATEMENT OF OWNERSHIP CERTIFICATE /REGISTRATION Application for a Non-Negotiable Statement of Ownership certificate is made in the County Treasurer s Motor Vehicle Office of the county in which the vehicle is garaged/maintained. The County Treasurer s Motor Vehicle Office will also issue the non-negotiable certificate. NOTE: Vehicles being brought into the United States by a foreign owner will need to provide the required import documents. Refer to Foreign Titled Vehicle in the Titling Instructions. LEASING A HEAVY TRUCK OR SEMI-TRAILER BY A KANSAS RESIDENT A Negotiable title from another state and Non-Negotiable Statement of Ownership certificate will be required when a Kansas resident or business is leasing a truck registered for 16M or more, or a trailer and will be operating same in Kansas for over 30 days with county registration (nonprorate registration) is required. Application for the nonnegotiable certificate and registration is to be made in the county in which the lessee resides or in which the truck or trailer is garaged. LESSOR/OWNER - NEGOTIABLE TITLE The foreign (out-of-state) title is to be returned to the outof-state owner/lessor due to interstate operations, a Foreign Title Approval for Non-Negotiable Statement of Ownership Title, form TR-52, is to be completed and signed by the County Treasurer as well as imaging a copy of the front and back of the foreign title. LESSEE/OPERATOR - NON-NEGOTIABLE STATEMENT OF OWNERSHIP CERTIFICATE The lessee will be applying for a Non-Negotiable Statement of Ownership certificate and registration. A copy of the lease agreement, signed by both the lessor and the lessee must be presented and attached to the non-negotiable title application. Proof of negotiable title. One of the following: Copy of the front and back of the title in the name of the lessor listed on the lease agreement. The Foreign Title Approval for Non-Negotiable Statement of Ownership Title, form TR-52. The lessee will be responsible for all fees and taxes for the trailer or truck registered >16M or truck-tractor. OUT-OF-STATE OWNER OPERATING IN KANSAS A non-resident truck registered 16M or more, or a trailer which is currently titled in another state and is in Kansas temporarily (30 days or longer) for a job assignment must apply for a Kansas Non-Negotiable Statement of Ownership certificate and registration. A Kansas negotiable title will not be applied for as long as the vehicle is currently titled and registered in the owner s name in another state. The purpose of the non-negotiable certificate is for a nonresident owner to secure a Kansas registration to operate within Kansas. The applicant is required to provide a copy of the negotiable out-of-state title and a current year out of state registration receipt. N0N- TRANSFERABLE REGISTRATION JULY 2013; NEW PROCEDURE LAUNCH AND SIGN INTO THE MOVRS SYSTEM Click on VRT. Click on Registration Transactions. Click on Non-Transferable Registration. Back NON-TRANSFERABLE REGISTRATION PREQUALIFIER SCREEN Enter the Purchased Date. Enter the VIN number. Enter the Customer ID number or the Customer Drivers License number for the owner, if known. Otherwise the Customer information can be added through the Relate Customer Tab. Click Continue. SEARCH RESULTS SCREEN Search window will open with no results if this is a gray market vehicle and may have a result if this is a truck owned by a non-kansas owner with no nexus in Kansas other than a current job site. If the Customer and VIN number already exists in the system you will select them from the listed results. If the Customer and/or VIN number do not exist in the system you will add them at this point. Click Add Vehicle. NON-TRANSFERABLE REGISTRATION SCREEN The Non-Transferable Registration screen will appear. APPLICATION TAB Enter the odometer reading (mileage) if vehicle is less than 10 years old See Odometer Policy. Select the Odometer Unit (Miles or Kilometers) if the vehicle is less than 10 years old. Select the usage applicable to the transaction Enter the Declared (Gross) weight if the vehicle type is truck, truck tractor or bus Verify or Select the Registration County as the County processing the transaction At the bottom of the screen you will select the Lessee as the Renewal Customer. A customer must have been entered on the pre-qualifier screen or entered through the Relate Customers tab in order to be selected here. VEHICLE STATUS TAB If the vehicle existed in the system prior to this current transaction you should also see the previous Kansas owner(s) information on this tab. FEE DETAIL TAB This tab will give a breakdown of registration fees for this transaction. TAXES TAB If applicable, the class code assigned to the vehicle as well as the current mill levy rate. You will not be able to make changes to these fields they are for review only. You will see a drop down for Property Tax Exemptions, if your customer qualifies for a Property Tax Exemption you will select the reason for the exemption from the list provided. It is likely that this transaction will be except from sales tax as the ownership does not change during a Non-Transferrable Registration transaction You will also see the Seller and the Buyer name and address displayed in the sales tax portion of the screen. If the vehicle falls inside the scope of sales tax due, enter the Gross Purchase Price. Not applicable would be any Trade In, and any Sales Tax paid to the dealer as a dealer cannot sell a vehicle with a grey market title and an owner with no nexus in Kansas will have tax due in their other state. If your customer qualifies for a Sales Tax Exemption you will need to select the exemption reason from the MOVRS Policy & Procedures 5 Kansas Division of Vehicles
list provided in the drop down menu. Click the Update Tax Rates button at the bottom of the screen. REGISTRATION DETAIL TAB This will be an overview of the registration transaction you are performing. You will see the plate type and plate number that will be assigned to the vehicle. If your customer is requesting a Special Plate you will click the Get Plate button and select the plate type the customer is requesting. The customer MUST qualify for the plate and in some cases you will need to add a Characteristic to the customer record prior to assigning the plate in the transaction. Select the customer(s) preferred method of receiving the renewal notice from the drop down. RELATED CUSTOMERS TAB The owner information will be displayed. If you failed to enter the customer in the pre-qualifier screen they will not auto populate here, however you will have the ability to add customers by clicking the add button. You will also have the ability to remove a customer by clicking the (X). A signature is required for this transaction you will click the Capture Signature at the bottom of the screen or collect the signature through a document on the Documents Tab. INSURANCE TAB Enter the customer s current insurance information. MAILING TAB Review your current customer s information for mailing address renewal notices. If correction/updates need to be made to the customer s address you will need to make them in the Customer Maintenance record. In a registration transaction customer address changes do not typically update if you link out in the transaction. transaction or exit from the transaction make the address update necessary for the customer record and then re-launch the Non-Transferrable Registration transaction. DOCUMENTS TAB Collect and scan the documents required by policy for this transaction. Return original ownership documents to the customer. EXCEPTION TAB Will display any designations. COMPLETE APPLICATION Click PAY NOW. Process through Payment Manager Collect fees. Finalize transaction and generate credentials. Customer receives the license plate, registration credential, financial receipt, and Non-Negotiable Statement of Ownership certificate.
