Rogers, Office of the County Attorney PURPOSE: The purpose of this item is to authorize the conveyance of temporary construction easements to Dominion Transmission, Inc. (Natural Gas), over and across certain County property that is known as the Stone Ridge Proffered County Linear Park and Stone Ridge Park and Ride Lot. RECOMMENDATION: Staff recommends that the requested easements to Dominion Transmission, Inc., be granted. BACKGROUND: Dominion Transmission, Inc. ( Dominion ), a natural gas utility, has requested the grant of three (3) temporary construction easements over and across two (2) adjacent County properties, known as the Stone Ridge Proffered County Linear Park (PIN: 204-47-0343) and the Stone Ridge Park and Ride Lot (PIN: 204-35-4604) (together, the County Property ). The County Property is planned to be improved with a park and ride lot (PIN: 204-35-4604) pursuant to approved Site Plan (STPL) 2015-0015, and is located on the south side, and south, of John Mosby Highway (Route 50), on the north side, and north, of Tall Cedars Parkway (Route 2200), and along the north and south sides of Millstream Drive (Route 2626), at 24281 Millstream Drive, Aldie, Virginia, in the Dulles Election District. The temporary construction easements requested to be granted to Dominion ( Dominion Easement ) are approximately 30-feet wide, would be generally located along the common boundary between the Stone Ridge Proffered County Linear Park (PIN: 204-47-0343) and the Stone Ridge Park and Ride Lot (PIN: 204-35-4604), and are shown on the plat attached to this Staff Report as Attachment 1. The Dominion Easement would facilitate the repair, replacement, and upgrade of an existing underground natural gas transmission pipeline owned and operated by Dominion. Such repairs,

(Natural Gas), Over and Across County Property (Stone Ridge Proffered County Linear Park and Stone Ridge Park and Ride Lot)Board of Supervisors Public Hearing July 13, 2016 Page 2 replacement, and upgrades are necessary because of the construction of new multifamily dwelling units within the immediate area, which, for safety purposes, requires Dominion to use thicker pipes for its pipeline. The existing underground pipeline is located within existing natural gas transmission pipeline easements on the County Property that were granted to Dominion by deeds recorded in Deed Book 637, at Page 301, and in Deed Book 1139, at Page 1025, among the land records of Loudoun County, Virginia. Dominion represents that the additional temporary construction area would facilitate and speed up the repair and replacement of its underground pipeline because of the limitations that the boundaries of its existing easements place on the movement of heavy machinery and temporary storage of excavated soil. To meet its project timeline, Dominion wishes to begin the construction of the repair, replacement, and upgrade of its existing underground pipeline by late July 2016. ISSUES: This public hearing is being held to comply with 15.2-1800 of the Code of Virginia of 1950, as amended, which requires a public hearing prior to granting interests in property owned by the County. There are no issues known to Staff. FISCAL IMPACT: There is no fiscal impact in granting the easement. DRAFT MOTIONS: 1. I move that the Board of Supervisors forward Grant of Temporary Easements to Dominion Transmission, Inc. (Natural Gas), Over and Across County Property (Stone Ridge Proffered County Linear Park and Stone Ridge Park and Ride Lot) to the July 21, 2016, Board of Supervisors Business Meeting for action. OR 2a. I move that the Board suspend the rules. AND 2b. I move that the Board of Supervisors approve the requested grant of easement to Dominion Transmission, Inc., as shown on the plat entitled Proposed Temporary Construction Easement Loudoun County Board of Supervisors, provided as Attachment 1 to the July 13, 2016, Board of Supervisors Public Hearing Staff Report. OR I further move that the Chairman, the Vice Chairman, the County Administrator, or his duly authorized designee be authorized to execute the necessary Deed of Easement or other form of easement(s) acceptable in form to the County Attorney. 3.
