REGISTRATION OF SHORT-TERM RENTALS Sec. 13-103. - Purpse. The City Cuncil f the City f Destin recgnizes that the unregulated rental f single-family detached dwelling units by seasnal residents uniquely impacts certain neighbrhds within the City f Destin. Therefre, it is necessary and in the interest f the public health, safety, and welfare t mnitr and prvide reasnable means fr citizens f the City f Destin t mitigate impacts created by such rental f single-family detached dwelling units within the City f Destin as set frth by this article. (Ord. N. 151.23, 3, 6-3-02) Sec. 13-104. - Definitins. Fr the purpse f this article, the fllwing terms, phrases, wrds, abbreviatins and their derivatins shall have the meaning given herein. When nt incnsistent with the cntext, wrds used in the present tense include the future tense, wrds in the plural number include the singular number and wrds in the singular number include the plural number. The wrd "shall" is always mandatry and nt merely directry. Wrds nt defined shall be given their meaning as prvided in sectin 1-2, Definitins and rules f cnstructin, f the City f Destin Cde f Ordinances. Cndminium shall mean the frm f wnership f real prperty, created pursuant t Chapter 718.103 f the Flrida State Statutes, which is cmprised entirely f units that may be wned by ne r mre persns, and in which there is, appurtenant t each unit, an undivided share in cmmn elements. Dwelling, single-family shall mean fr the purpses f this article a residential structure that may either be detached frm any ther residential structure r be attached t a wall f anther residential structure such as twnhmes, duplexes, and triplexes. Garbage shall mean every accumulatin f waste (animal, vegetable and/r ther matter) that results frm the preparatin, prcessing, cnsumptin, dealing in, handling, packing, canning, strage, transprtatin, decay r decmpsitin f meats, fish, fwl, birds, fruits, grains r ther animal r vegetable matter (including, but nt by way f limitatin, used tin cans and ther fd cntainers); and all ther putrescible r easily decmpsed animal r vegetable waste matter which is likely t attract flies r rdents. Owner shall mean the persn in whm is vested the wnership, dminin, r title f prperty. Respnsible party shall mean fr the purpses f this article, the wner r the persn designated by the wner f the prperty t be called upn t answer fr the maintenance f the prperty and the cnduct and acts f seasnal residents f single-family dwelling units. Seasnal resident shall mean peple, guests, turists, lessees, vacatiners, r thers wh lease r rent a single-family dwelling unit fr valuable cnsideratin fr a perid f time between ne (1) day t n mre than six (6) mnths. Shrt-term rental shall mean fr the purpses f this article, any ccupancy f a single-family dwelling unit fr a perid f time between ne (1) day t n mre than six (6) mnths. (Ord. It shall be unlawful fr any persn t allw anther persn t ccupy any single-family detached dwelling unit as a seasnal resident within the City f Destin, r ffer such rental services within the City f Destin, unless the persn has been registered with the City f Destin in accrdance with the prvisins f this article. Sec. 13-106. - Frmal applicatin required. Every persn required t prcure a registratin under the prvisins f this article shall submit a frmal new applicatin fr such registratin each year t the City Manager r his designee. Submissin f an incmplete registratin applicatin frm shall result in rejectin f the applicatin. (Ord. N. 151.23, 3, 6-3-02; Ord. N. 15-15-CC, 4, 12-21-15) Sec. 13-107. - Applicatin fr registratin. Applicatins fr registratin shall set frth and/r include at a minimum: (1) Address, lt, blck and subdivisin name f single-family dwelling unit ffered fr rental; (2) Name, address, and phne number f wner f said single-family dwelling unit; (3) Email f wner f said single-family dwelling unit; (4) Name, address, and emergency cntact phne number f respnsible party fr said single-family dwelling unit, which shall be a twenty-fur-hur, seven (7) days a week cntact number; (5) That the phne number fr the Emergency cntact phne number fr a Respnsible Party, which will be answered twenty-fur (24) hurs a day, seven (7) days a week, by a party with authrity t address r crdinate and crrect prblems vilatins assciated with the single-family dwelling unit; (6) Acknwledgement by wner adherence t all applicable regulatins attributed t shrt term rentals; Acknwledgement signed by the Owner r Agent f the Owner, understanding and agreeing t the initial and n-ging cmpliance with the City f Destin s shrt term rental regulatins and standards cntained herein and all ther applicable lcal, state, and federal laws, regulatins, and standards t include, but nt limited t F.S. Ch. 509, and Rules, Chapter 61C and 69A, f the Flrida Administrative Cde. (7) Prf f wner's current wnership f the single-family dwelling unit; Valid and current City f Destin Business Tax Receipt. (8) Prvide, at time f applicatin r within sixty (60) days f issuance f city registratin, a Valid and current Flrida Department f Revenue Annual Resale Certificate sales tax identificatin number under F.S. Ch. 212, and a valid current Department f Business and Prfessinal Regulatin Vacatin Rental Dwelling License under F.S. Ch. 509. (9) Signage must be displayed in accrdance with City f Destin Cde f Ordinances, Chapter 13, Article 6, Sectin 13-116, prir t apprval. (10) Applicatin fee is required at the time f applicatin and is nn-refundable. Applicatins submitted withut an Applicatin Fee will be deemed incmplete. (11) Applicatins deemed incmplete will be rejected/returned t the wner/applicant and are subject t a Reapplicatin Fee and Late Fees. (12) Applicatins in a paper frmat may be subject t an additinal Administrative Fee. (Ord. N. 151.23, 3, 6-3-02; Ord. N. 15-15-CC, 5, 12-21-15) Sec. 13-108. Respnsible party required. Whenever any prperty is required t be registered under this article, the wner shall appint a persn t serve as the lcal respnsible party fr service f ntices as are specified herein, and ntices given t the respnsible party shall be sufficient t satisfy any requirement f ntice t the wner. The wner shall ntify the City Manager r his designee in writing f the appintment within five (5) days f being required t make such appintment, and shall thereafter ntify the City Manager r his designee f any change f respnsible party within fifteen (15) days f such change. Further, it is hereby made the affirmative duty f the respnsible party t: (1) Infrm all seasnal residents prir t ccupancy f the single-family detached dwelling unit f applicable City f Destin rdinances cncerning nise, vehicle parking, garbage, and cmmn area usage; (2) Maintain all prperties under their cntrl in cmpliance with the ccupancy limits, as specified in the City f Destin Cde f Ordinances; (3) See the prvisins f this article are cmplied with and prmptly address any vilatins f this article r any vilatins f law, which may cme t the attentin f the respnsible party; 6 f 9 Applicatin Shrt-Term Rental Feb 2017

(4) Be available with authrity t address and crrect vilatins with the rental f the single-family detached dwelling unit twenty-fur (24) hurs a day, seven (7) days a week; (5) Be situated clse enugh t the single-family dwelling unit as t be able t, and shall, service emergency calls within ne (1) hur f ntificatin; (6) Maintain the entire prperty f the single-family dwelling unit free f garbage and litter. Prvide hwever, that this sectin shall nt prhibit the strage f garbage and litter in authrized private receptacles fr cllectin. Sec. 13-1089. - General regulatins/standards. (1) All vehicles shall nly be parked in the imprved accessway/vehicle use area as defined per Land Develpment Cde, Sectin 3.00.01 and/r within the garage area f the single-family dwelling unit. Garage area parking shall nly be cunted as prvided parking if the area is pen and free frm bstructins. Vehicles shall nt be within the right-f-way, including the grassy/unimprved areas and sidewalk sectins fr pedestrian traffic pursuant t City f Destin Cde f Ordinances, Chapter 19.5, Traffic and Mtr Vehicles and Land Develpment Cde, Sectin 8.01.00.6. Additinally, by 5:00 p.m. the day after the last day f the cntracted shrt-term rental perid, all garbage shall be remved. The wner shall be required t btain additinal garbage cntainers and t acquire special valet garbage service frm the city's slid waste remval prvider in rder t ensure all garbage is prperly cntained and remved. The wner, in lieu f acquiring valet garbage service frm the city's slid waste remval prvided, may utilize a third party valet garbage service remval prvider, but such private service shall nt excuse cntinuing t accept and pay fr regular services f the city slid waste service prvider; (5) Whever, withut being authrized, licensed, r invited, willfully enters r remains in any structure r cnveyance f a single-family dwelling unit, r, having been authrized, licensed, r invited is warned by the wner r lessee, t depart the single-family dwelling unit and refuses t d s, cmmits the ffense f trespass in a structure r cnveyance; (6) Recreatinal amenities, such as exercise facilities, ht tubs and swimming pls, may nt be jintly shared cmmdities and shuld nt be cnsidered available fr use unless the right t use such facilities is clearly stated in the rental agreement fr the dwelling unit; (Ord. N registratin issued under the prvisins f this article shall be transferred, r assigned, r used by any persn, wner, r agent f the wner ther than the ne t whm it is issued, r at any lcatin ther than the ne fr which it is issued. Renewal applicatins must meet the requirements f the City f Destin s Cde f Ordinances, Chapter 13, Article 6, Sectin 13-107. Shrt-Term Rental Registratin renewals may be renewed between January 1 and March 1 f each year. Shrt-Term Rental Registratins are due March 1 f each year; any such renewal registratin received after March 1 f each year is cnsidered late and is subject t a Late Fee f fifty ($50) and must be paid in additin t any ther applicable fees prir t a renewal apprval, except as therwise apprved by the City Manager r their designee. It shall be unlawful fr any persn t give any false r misleading infrmatin in cnnectin with the applicatin fr registratin required by this article. Sec. 13-113. - Territry embraced. Prir t the wner f the single-family dwelling unit allwing anther persn t ccupy the single-family dwelling unit as a seasnal resident, wner shall pst a sign n the prperty meeting the fllwing requirements: (a) The sign must be prminently placed n the prperty f the single family dwelling unit s that the required cntent f the sign shall be legible as viewed frm the public right-f-way; hwever, signage shall nt be placed in the public right-f-way; (b) Such sign shall be nt larger than eighteen (18) inches by twelve (12) inches and nt smaller than sixteen (16) inches by ten (10) inches in size; (c) The sign must clearly indicate the name, and twenty-fur (24) hurs a day, seven (7) days a week emergency cntact phne number f the respnsible party fr said single-family dwelling unit. If the respnsible party phne number and the rental cntact phne number are different, the sign shall clearly indicate bth phne numbers; (d) The sign must be cntinuusly n the prperty f the single-family dwelling unit during any perid a lcal business tax r registratin has nt expired; and. All regulatins regarding the psting f a sign n the prperty f the single-family detached dwelling unit shall preempt any hmewner s assciatin restrictins n the psting f signs t the extent that any such hmewner s assciatin restrictins r regulatins cnflict with this Article. (2) Civil citatin: The Cde Enfrcement Divisin, r ther duly authrized fficer r authrity, may enfrce the terms f this article thrugh issuance f civil citatin as prvided in Chapter 14, Offenses and Miscellaneus Prvisins, Article III, Cde f Enfrcement Citatin Prgram and Prcedures, f the Cde f Ordinances f the City f Destin and F.S. (3) Denial/Suspensin/Revcatin: Any registratin issued pursuant t this article may be administratively denied, revked, r suspended by the city fr failure t satisfy the requirements fr registratin r fr vilatin by the wner f this article, any City f Destin Ordinance, r state law. Such denial, revcatin r suspensin is in additin t any penalty prvided herein. Any appeal f administrative actin taken pursuant t this subsectin shall be as prvided in City f Destin Land Develpment Cde Sectin 2.22.00, Appeals. (4) Criminal penalties: A vilatin f this article shall be punishable as a misdemeanr by a fine f up t five hundred dllars ($500.00) per vilatin and a definite term f imprisnment f nt mre than sixty (60) days as prvided in F.S. 162.22. It is the legislative intent f the City Cuncil in enacting this article t prvide an additinal r supplemental means f btaining cmpliance with the requirements stated herein.
