206. (1) Establishment of Districts. (A) R-1 Single Family: For the purpose of this Code the City of the Village of Minnetonka Beach is zoned in its entirety R-l Single Family Residential District. (B) Telecommunications Overlay Zoning District: The Council may create a Telecommunications Overlay Zoning District on any lot of record in the R-1 Single Family Residential District provided the provisions of this Code related to Telecommunications have been satisfied. (C) The Council may create a Residential Planned Unit Development (PUD) Overlay District on any area greater than 15 acres in the R-1 Single Family Residential District provided the provisions of this code have been satisfied. (D) Public Facilities, Parks and Public Open Space Zoning District P-1 (2) Zoning Map. The boundaries of the district established by this Ordinance are delineated on the Zoning Map; said Map and all notations, references, and data shown thereon are hereby adopted and made part of this Ordinance and will be on permanent file for public inspection at the City Hall. It shall be the responsibility of the City Clerk and City Staff to maintain said Map, and amendments thereto shall be recorded thereon within thirty (30) days after official publication of amendments. (3) (A) District Boundaries. The boundaries between districts are, unless otherwise indicated, either the centerlines of highways, roads, streets, alleys, or railroad rights-of-way, or such lines extended or lines parallel or perpendicular thereto or section or fractional section lines. Where boundaries are shown on the Zoning Map between a road or street, the district boundary line runs parallel to the centerline of the road or street at a distance therefrom equivalent to the number of feet stated, unless otherwise indicated. (B) P-1 Zoning District Boundaries. Public Facilities, Parks and Public Open Space Zoning District P-1 shall include all land, air above and ground below as described in and identified as PID No.1611723420032 and as described in the attached legal description Exhibit A which includes all land owned by the Hennepin County Regional Rail Authority located in the City of the Village of Minnetonka Beach. The Zoning District shall be inscribed on the City Zoning Page 1 of 5
Map conforming to Exhibit A as Zoning District P-1. (4) Determination of Use. Any landowner may request a determination of the use classification (permitted, not permitted, conditional) for a use not expressly listed as permitted or conditional or which involves more than one type of permitted use. An application for a determination shall be submitted to the City Clerk and referred to the Planning Commission for recommendation and the Council for decision. Use determinations shall be based on substantial similarity to existing use classifications, become of future binding force and effect, and be maintained on file by the City Clerk. (5) (A) Principal Uses: R-l Single-Family Residential District. (1) Single-family detached dwellings. (2) Local public administrative and safety buildings and facilities. (3) Accessory Land Uses subordinate to the Principle Use. It is necessary to have an allowed Principal Use on the same lot in order to have one or more of the listed Accessory Uses on the lot. (4) Permanent Existing Accessory Land Uses deemed conforming. Permanent existing Accessory Uses or existing Permanent Accessory Structures including the location, height and other characteristics of the accessory land use are deemed conforming if they existed before the adoption of this ordinance and may be repaired or replaced by the same use in the same location without regard to Table I Permitted Accessory Uses and Table II Accessory Use Performance Standards. (B) Principal Land Uses: P-1 Allowed Land and Recreational Uses The following uses are allowed in the zoning district P-1: (1) Regional Trail for non-motorized vehicles, except wheel chairs or similar devices for the handicapped; (2) Recreational use of the Regional Trail shall include: bicycles, tricycles, roller blades, roller skates, small wagons, non-motorized scooters, strollers, handicapped transportation such as wheel chairs and other pedestrian uses such as walking, running or similar recreational uses. (3) Accessory land uses Minnetonka Beach City Code Sec. 206 (4) Natural open space and landscaping The Following Accessory Uses are Permitted 1 : (6) Permitted Accessory Uses The following Table I Permitted Accessory Uses lists permitted accessory land uses. Accessory uses not listed in this table are not allowed in the setbacks or in the buildable area of any lot; provided that any accessory use determined by the City Council to be incidental to the residential occupancy and not detrimental to the adjoining property in accord with Section 206 (4) either by general description or pursuant to a specific request by a resident, shall be permitted in the zoning district. Table I Permitted Accessory Use Table includes the setback areas that the accessory land use is permitted in designated with a Y and the setback areas that they are prohibited from designated with an N.
