Property Conference - 7th October 2015 Your presenters Joanne Wicks QC Wilberforce Chambers Recognised by Legal 500 as Undoubtedly one of the leading property silks, who is destined for the top and ranked in Band 1 of Chambers and Partners list of Leading Silks for Real Estate Litigation, Joanne specialises in property and professional negligence disputes and in advising on complex real estate transactions. She is described as a powerful, talented but approachable advocate who can really get to the guts of a problem, no matter how complicated and is recognised for the quality of her courtroom skills and her ability to deliver advice on the most difficult of problems in a clear and client-friendly manner. Mark Newton Fisher German Mark Newton heads up the Fisher German renewable energy sector team. Fisher German were one of the first firms of Chartered Surveyors to specialise in Renewable Energy since 2001. Mark is leading expert on wind turbines and renewable energy. Mark has been selected by most of the major banks to help formulate their renewable lending policy and train their managers. He has helped write the CLA Advisory Booklet on wind farms, spoken on Radio 4 and appeared on BBC1 Countryfile. Mark speaks regularly at renewable energy conferences and has written many renewable farming press articles. Involved in around 300 wind farm projects, hundreds of single wind turbine projects and over 60 solar park projects. His team have been involved with over 50 AD plants, numerous RHI projects, and hydro schemes. Mark is also involved in valuations of renewable projects for banks and landowners. He was selected by the RICS in 2014 to deliver the lectures on Valuation of Renewable Assets across the UK. He also specialising in Expert Witness work for solicitors in renewables disputes. Tom Weekes Landmark Chambers Tom is a property litigation specialist with a court-based practice. He represents a wide variety of types of clients at hearings at every level. Recent cases of note have included Cusack v Harrow [2013] 1 WLR 2022 (with a leader) (a Supreme Court decision about frontagers rights of access to the highway), Freetown v Assethold [2013] 1 WLR 7012 (an important Court of Appeal decision about the service of documents by post), Shebelle v Hampstead Garden Suburb Trust [2014] 2 P&CR 6 (a Court of Appeal decision about whether the covenant for quiet Leslie Blohm QC, Call 1982 (QC 2006) St John s Chambers Leslie is one of the Western Circuit s leading commercial and chancery practitioners, both in advisory work and in litigation in all Courts from the most local up to and including the House of Lords and the Supreme Court. He deals with commercial disputes and problems, and in particular those with a property element including contracts for the sale of land, development and overage agreements, commercial landlord and tenant disputes and Town and Village Green applications. Leslie has been ranked in the Chambers 100 UK Bar, marking him out amongst the top 100 silks in the country and the very best in his field. A specialist property lawyer with a tremendous reputation among both peers and instructing solicitors. Chambers UK (2014)

Oliver Radley-Gardner Falcon Chambers Oliver specialises in property and landlord and tenant related litigation and advisory work. His cases cover all aspects of this work, including related insolvency and negligence issues, and he has recently acted in cases concerning adverse possession, proprietary estoppel, easements, mortgages, the rectification of leases, development agreements, partnership disputes, compulsory purchase, and an arbitration appeal. He also has experience of judicial review. He regularly advises on, and acts in cases under, the Electronic Communications Code and advises on agreements with operators under the Code. He appears in Courts and tribunals at all levels, and is the co-author (with Stephen Jourdan QC) of Adverse Possession (2nd ed). Greville Healey Falcon Chambers Greville is an experienced property litigation specialist and trial advocate. He has been described in the legal press as an acclaimed junior, a rising star at the property bar and a powerful courtroom advocate with a great client manner, who is very clever, very quick and very client friendly and has talent above his seniority of call. He is a persuasive advocate and effective cross-examiner, and is equally at home arguing difficult and technical questions of law, and fighting his client s corner in disputes of fact which turn on the credibility of witnesses. He has considerable courtroom experience both at first instance and on appeal. He gives clear and practical advice. His practice encompasses all areas of real property and landlord and tenant litigation, including adverse possession, agricultural tenancies, beneficial ownership, break clauses, business tenancies, charges and charging orders, competition law as it applies to land agreements, compulsory purchase, contracts for the sale and purchase of land, conveyancing disputes, development agreements, dilapidations, easements, enfranchisement, guarantees, highways and waterways, the interpretation of leases and other property contracts, land registration, mortgages, options, overage, proprietary estoppel, rights of light, rights of way, both public and private, rent review, residential tenancies, restrictive covenants, the telecommunications code, trusts of land, both private and charitable, and property valuation disputes. Adam Rosenthal Falcon Chambers Adam Rosenthal s practice encompasses all aspects of real property and landlord and tenant-related litigation and advice. Real property-related cases in which he has been involved cover a broad spectrum, from easements and restrictive covenants to conveyancing and development contracts. He also undertakes mortgage-related work and is a co-editor of the leading work on land options, advising regularly in relation to both freehold and leasehold options. Adam is regularly instructed in relation to most aspects of landlord and tenant litigation, including rent review, service charge disputes, business tenancies and possession claims. His practice also extends to related professional negligence and insolvency issues. He has appeared as an advocate in the County Court, High Court and Court of Appeal and both the Leasehold Valuation Tribunal and the Lands Tribunal. Joseph Ollech Falcon Chambers Joe has a busy junior practice specialising in real estate litigation. He is regularly instructed in relation to commercial, residential and agricultural matters, and has experience of a wide variety of disputes arising under the 1954 Act, the Rent Acts, the Housing Acts, agricultural and enfranchisement legislation. His practice encompasses cases with all land law related issues including restrictive covenants, easements, adverse possession, land registration, boundary disputes, trusts, and mortgages. He also has significant experience in advisory and litigation work relating to riverine and coastal land, and the rights of riparian owners. Joe s practice also encompasses areas of company and insolvency law which are related to property interests and disputes, and he appears regularly on such matters. In addition Joseph often deals with professional negligence matters that arise in connection with his area of expertise.

Jay Jagasia Guildhall Chambers Jay is a member of Guildhall Chambers property team where he advises on all aspects of real and personal property. His property practice is closely related to his growing practice in environmental and planning law. He has experience in a wide-range of tribunals and speaks regularly at industry events and conferences. Recent cases of interest include Fielding v Reynolds (a case which involved, amongst other things, a dispute as to the meaning to be given to a restrictive covenant which prevented a landowner from tipping waste on his land) and North Yorkshire County Council v Wharfbank Ltd (a 2.5 week footpath inquiry where he juniored Rajinder Sahonte). Jay is the acting co-chair of the southwest branch of the UK Environmental Law Association. Prior to transferring to the Bar, Jay trained and qualified as a solicitor in a nationally leading environmental and energy practice. Peter Wadsley, Call 1984 St John s Chambers As a senior practitioner in the Local Government field, Peter has considerable experience in all aspects of planning and environmental work, including public inquiries, appeals to the High Court and Court of Appeal and in judicial review of local authority decisions. He advises in all these areas assisting local authorities, developers and including interest groups and other public bodies. Particular areas of interest and expertise include renewable energy (particularly wind farms and biomass); major housing inquiries (including a number where viability and housing land supply were major issues); retail inquiries; all aspects of enforcement appeals; and listed building and conservation area issues (and appeals). Peter has also acted for highway authorities and others in relation to the creation and extinction of public rights of way and consequent appeals to the High Court. Renewable Energy inquiries have included: thirteen Wind Turbine Inquiries: some of the more recent inquiries included two major inquiries in South Wales, one involving a wind farm and the other a major biomass plant. Sonny Masero Demand Logic Chairman of Demand Logic, a rapidly growing start-up serving the commercial real estate market. Demand Logic's big data analysis software technology pinpoints maintenance issues and energy wastage in real time to improve occupant satisfaction and save money. This uses building performance data streamed from the Heating, Ventilation & Air Conditioning (HVAC) equipment through the Building Management System (BMS) via the Demand Logic Data Acquisition Device. Sonny has a history of working on various sustainability projects with a particular focus on working with successful companies to bring to market scalable technology that addresses energy, environmental and climate change challenges in a commercial environment. Sonny has worked with a range of software companies and other technologies businesses to advise on strategy, investment, new business development, EMEA sales, software industry, innovation and how to have an impact in the market. Sonny was International Green Technology Advisor to Bristol 2015 European Green Capital and directed the Green Capital Digital Challenge and Venturefest Bristol & Bath 2015. Brian Dillon, Strategic Account Manager Groundsure Brian originally started his career in Finance working in Timeshare Property Holiday Exchange Industry. In 2000 he started working in Estate Agency progressing from a junior Negotiator to Branch Manager for various Estate Agency brands in the East Anglia and the South East of the country. Has since then developed his career in Residential Freehold Ground Rent Property Acquisition Investment. With over 15 years of expertise dealing with property surveyors/agents/solicitors/house builders and local planning authorities, Brian brings with him a wealth of knowledge. As part of his current role, he provides lectures and training nationally covering various environmental risk issues and is also an accredited member of IEMA and NAEA. Simon Price Alder King Simon heads up Alder King's award-winning agency team. Working with national and regional property owning and property occupying clients, Simon has been instrumental in securing some of the most high profile office transactions of recent years, including the sale of 100 Temple Street to Bristol City Council. Simon is the current chairman of the Great Western branch of the Forum for the Built Environment. Conrad Davies, Partner Osborne Clarke Conrad is a Partner in Osborne Clarke's corporate practice and head of the firm s Real Estate and Infrastructure sector. His work includes acting on domestic flotations, public and private equity fundraisings, private acquisitions and disposals, projects and joint ventures, with a particular focus on real estate lenders, investors and developers, and UK infrastructure clients. He also has significant experience of work in the digital business sector. His recent work includes advising on a complex corporate acquisition of a significant UK ground rents portfolio for Pramerica and acting for Ultra Electronics on its US$75m acquisition of AEP Networks. Before qualifying as a lawyer in 2002, Conrad spent five years working in business. He joined Osborne Clarke in 2004 from the London office of US law firm Jones Day and has been a Partner since 2011. Conrad has co-authored "Keep your eyes peeled: Parties entering into joint venture agreements should do so with care since pitfalls lie in wait along the way" for Estates Gazette (April 16, 2011) and is a regular speaker on matters involving corporate law in the real estate sector. Neil Bromwich, Partner Osborne Clarke Neil is a Partner in OC's planning team, and also a chartered surveyor (RICS). His specialism is in advising on planning and environmental matters on strategic development projects for a wide range of commercial development. His expertise is particularly strong in the renewable energy and infrastructure sectors and in residential development. He has acted for several energy companies at planning appeals and in the High Court on aviation development. Having worked in development roles for Biffa Waste Services and Tarmac before qualifying as a solicitor, Neil continues to advise a number of major mineral and waste clients. He has also acted for major retail, leisure and residential developers on planning projects. Matthew Germain, Associate Director Osborne Clarke Matthew is an Associate Director in the Environment group. He is ranked in the leading UK legal directories for environmental law and acts for a broad range of clients across a number of sectors, including waste and recycling, real estate, renewables, utilities, digital business, banking, private equity and retail. Matthew s core areas of expertise include environmental liability in complex corporate and real estate transactions, environmental crime, waste and bioenergy projects, infrastructure projects, climate change and sustainability regulation and waste producer responsibility law. On environmental crime, he has acted on significant Environment Agency prosecutions in the UK courts and on waste producer responsibility he regularly advises US corporates on European and UK law. His work in the waste and bioenergy sector focuses on long-term waste contracts, including RDF export, landfill disposal and fuel supply for biomass, AD and energy from waste projects.
