GLADES COUNTY, FLORIDA RESOLUTION NO. 2016 - _ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF GLADES COUNTY, FLORIDA, ORDERING AND CALLING AN ELECTION ON GLADES COUNTY S AUTHORIZATION TO GRANT ECONOMIC DEVELOPMENT AD VALOREM TAX EXEMPTIONS FOR NEW BUSINESSES AND EXPANSIONS OF EXISTING BUSINESSES; PROVIDING FOR SCRIVENER S ERRORS; PROVIDING FOR CONFLICTS: PROVIDING FOR LIBERAL CONSTRUCTION; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, 196.1995, Florida Statutes, authorizes the Board of County Commissioners of Glades County, Florida, to call a referendum within Glades County, Florida, to determine whether Glades County can grant economic development ad valorem tax exemptions for new businesses and expansions of existing businesses under Section 3, Article VII, of the State Constitution; and, WHEREAS, the Board of County Commissioners of Glades County, Florida, adopted Ordinance No. 2006-18 calling a referendum on whether economic development ad valorem tax exemptions could be granted by Glades under Section 3, Article VII, of the State Constitution; and, WHEREAS, the referendum on whether economic development ad valorem tax exemptions could be granted by Glades County passed in a properly called and held election in 2006; and, WHEREAS, 196.1995(7), Florida Statutes, states that Glades County s authority to grant economic development ad valorem tax exemptions expires ten (10) years after the date such authority was approved in an election and that such authority may be renewed for subsequent ten (10) year periods if each ten (10) year renewal period is approved in a referendum (election) that is called and held pursuant to 196.1995, Florida Statutes; and, GL1623 / 2016005 Page 1 of 5

WHEREAS, it is the desire of the Board of County Commissioners of Glades County, Florida, to call an election in the election held on, 2016, to renew Glades County s authority to grant economic development ad valorem tax exemptions for a subsequent ten (10) year period. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF GLADES COUNTY, FLORIDA, that: SECTION 1. AUTHORITY. The Board of County Commissioners of Glades County, Florida. is hereby authorized to adopt this Resolution and call for an election of the qualified electors within the boundaries of Glades County, Florida, by the State Constitution and Florida law, especially Section 3, Article VII, of the State Constitution and 196.1995, Florida Statutes. SECTION 2. INCORPORATION OF RECITALS. The recitals set forth above are true and correct and form a part of this Resolution. SECTION 3. CALLING OF THE REFERENDUM (ELECTION). A referendum (election) is hereby ordered and called to be held on 2016, for the purpose of submitting to the qualified electors of Glades County, Florida, the question of whether Glades County, Florida, may grant economic development ad valorem tax exemptions under Section 3, Article VII, of the State Constitution and 196.1995, Florida Statutes. SECTION 4. CONDUCT OF THE ELECTION. The election shall be conducted according to the requirements of law governing elections to authorize the Board of County Commissioners of Glades County, Florida, to grant economic development ad valorem tax exemptions pursuant to Section 3, Article VII, of the State Constitution and 196.1995, Florida Statutes, as a part of the election being held on, 2016. The election shall be held at the polling places as designated by the GL1623 / 2016005 Page 2 of 5

Supervisor of Elections of Glades County, Florida. The polls shall be opened and closed as provided by law. The official ballot to be used in the election shall be in the form as provided by law and shall contain a question to be voted upon which shall be substantially in the following form: Shall the Board of County Commissioners of Glades County, Florida, be authorized to grant, pursuant to Section 3, Article VII, of the State Constitution, property tax exemptions to new businesses and expansions of existing businesses that are expected to create new, full-time jobs in Glades County, Florida? YES - For authority to grant exemptions. NO - Against authority to grant exemptions. SECTION 5. AUTHORIZATION TO CONDUCT AN ELECTION. The Supervisor of Elections, the Chairman of the Board of County Commissioners, and the County Commissioners, officials, officers, legal counsel, employees, and agents of Glades County, Florida, are hereby directed and authorized to do all things necessary to prepare a final official ballot question and conduct an election of the qualified electors of Glades County, Florida, as described above. SECTION 6. SCRIVENER S ERRORS. Sections of this Resolution may be renumbered or re-lettered and corrections of typographical errors which do not affect the intent may be authorized by the County Manager, or the County Manager s designee, without need of further decision making action by the Board of Commissioners, by filing a corrected copy of same with the County Clerk. SECTION 7. CONFLICT. Any provision of any Glades County resolution or regulation which is in conflict with the provisions of this Resolution is repealed prospectively to the extent of such conflict. SECTION 8. LIBERAL CONSTRUCTION. This Resolution shall be liberally construed to effect the purposes hereof and shall take effect immediately upon its adoption. SECTION 9. SEVERABILITY. If any section, subsection, sentence, clause, or other provision of this Resolution is held invalid, unconstitutional, inoperative, or void by a court of competent jurisdiction, such portion will be deemed a separate provision, and such holding shall not affect the remainder of this Resolution. SECTION 10. EFFECTIVE DATE. This Resolution shall take effect upon the adoption of this Resolution by the Board of Commissioners of Glades County, Florida. The foregoing Resolution was offered by Commissioner, who moved its adoption. The motion was seconded by Commissioner, and being put to a vote, the vote was as follows: John Ahern Paul S.
