Mudalappa S/o Thimmaiah through Sale Deed dated 17.04.1961, registered as document No.295/1961-62 of Book-I, Volume: 234 at Pages: 91 to 92 in the office of the Sub-Registrar, Bangalore South Taluk. 9. Subsequently, Sri. H. Ramaiah Reddy was registered as Khatedar of Sy. No.30/8B vide Mutation entry bearing No.9/90-91. 10. Sri. H. Guruva Reddy filed Original Suit No.208/1976 before the City Civil Judge, Bangalore for partition of joint family properties against Sri. Hanuma Reddy, Sri. H. Ramaiah Reddy, Sri. H. Srinivas Reddy, Sri. H. Raja Gopal Reddy, Sri. H. Jayarama Reddy and Smt. Puttamma. The parties in Original Suit bearing No.208/1976 filed Compromise Petition, according to the compromise petition Sri. H. Ramaiah Reddy was allotted Sy. No-30/8B, measuring 01 Acre 28 Guntas was converted from agricultural to nonagricultural residential purpose vide Official Memorandum bearing No.B.DIS.ALN(East)SR:282/01-02, dated 16.03.2002, issued by the Special Deputy Commissioner, Bangalore District. 12. Sri. H. R. Rajashekar S/o Sri. H. Ramaiah Reddy released all his right, title and interest in the various family properties including Sy. No.33/1, 33/2 & 30/8B in favour of his father Sri. H. Ramaiah Reddy, through Release Deed dated 29.10.2004, registered as document No-BAS- 1-19142/2004-05, of Book-I, in CD No.BASD106 in the office of the Sub-Registrar, Bangalore South Taluk as on 29.10.2004. 13.Sri. H. Ramaiah Reddy had executed Joint Development Agreement and further according to the JDA a GPA was also executed in favour of M/s Rohan Associates for construction and development of the property under reference. Subsequently, the Joint Development Agreement given to M/s Rohan Associates was cancelled by executing registered Agreement of Cancellation dated 18.03.2006. Boopesh Reddy, registered as document No-SHV-1-00784-2014-15, CD No-SHVD179 of Book-I dated 18.06.2014 in the office of the Senior Sub-Registrar, Shivajinagar, Bangalore, for construction of Multistoried Residential Apartment building in the subject property and subsequently they have executed a registered General Power of Attorney in favour of the Developer, registered as document No-SHV-4-00095- 2014-15, CD No-SHVD179 of Book-4 dated 16.06.2014 in the office of the Senior Sub- Registrar, Shivajinagar, Bangalore, authorizing to develop the subject property and have also authorized the Developer to dispose off 60% undivided right, title and interest in the subject property, which has fallen to the share of the Developer as per the terms of the Joint Development Agreement. 15. Registration Certificate of Establishment in Form C of M/s Corporation dated 12.01.2012 issued by the office of Senior Labour Inspector, Bangalore, certifying that the M/s Corporation has been registered as a commercial establishment. 16. M/s Corporation had obtained License Plan sanction from the Joint Director, (Town Planning North) Bruaht Bangalore Mahanagara Palike for the construction of multi-storied residential building over the Schedule Property. 17. That, M/s Corporation, has obtained the necessary NOC s from HAL Airport Authority of India, BESCOM, BWSSB, for implementation of the said project over the schedule-b property. 18. The property in question has fallen within the confines of Bruhat Bangalore Mahanagara Palike, and the said Sri. Rajashekar and others have obtained Katha in respect of the subject property and the said authority has assigned Katha No.89/33/2, 33/1, 30/8B to the subject property and the said owner have also paid taxes to the said authority. 19. The BBMP sanctioned Licence Plan for construction of Residential apartment building in the property under reference vide. L.P. No. 0094/2013-14 dated 18.05.2016. 20. The Assistant Director, Town Planning, BBMP, Bangalore has issued Commencement Certificate dated 18.05.2016 for construction of the multistoried building in Block A, B, C, D and E consisting of Basement Plus Ground Plus 13 upper floors by collecting necessary fees of Rs.18,15,500/-. The owner/builder should obtain completion certificate, when the project is completed, the BBMP inspects the premise on the basis of the building plan and awards the completion certificate. The owner/builder should obtain occupancy certificate, this will be issued after ensuring that all local laws are complied and is built on the basis of the approved plan.

21. The various encumbrance certificates issued for the period from 01.04.1950 to 06.10.2014 in respect of the survey number 30/8 and from 01.04.1964 to 06.10.2014 in respect of survey numbers 33/1 and 33/2, shows the registered transactions from time to time and respective owners of the property.
