GUARANTOR INFORMATION This guarantor agreement is creates a binding legal contract. If you do not fully understand the nature of the agreement, then it is recommended that you take independent legal advice before signing. : INSERT Dear guarantor and prospective tenant Ref: INSERT I am writing in connection with the recent application made for the above Property. It is my understanding that you wish to let this Property through 2C Properties Ltd. Please find enclosed all relevant paperwork for the tenancy. We require a Guarantor for this tenancy application who will guarantee any defaults in rent payments and damages exceeding the deposit. The Guarantor must reside in the UK and be in employment. I would be grateful if you could ask your Guarantor to complete the Guarantor Application and Agreement. Please note we require all original signed hard copies of the Guarantor forms sent to us within 10 working days of receipt. Otherwise, the Property may be put back on the market and any agency fees paid to us will not be refunded. Along with the Guarantor forms, we will also require Proof of UK address for the Guarantor. Declaration I/we hereby confirm that the information provided by me/us is, to the best of my/our knowledge, true and that the results of the findings will be forwarded to the appointed letting agent and/or the landlord and may be accessed again should I/we apply for a tenancy agreement in the future. I/we agree that 2c Properties Ltd referencing may search the files of a credit reference agency which will keep a record of that search. I/we also understand that no details of the search will be given to me/us by the letting agent and/or the landlord but I/we may request the name and address of the credit reference agency to whom I/we may apply for a copy of any information provided. I/we also confirm that in the event of my/our defaulting on the rental agreement that any such default may be recorded with the credit reference agency and may affect any future applications for credit I/we may make. As Guarantor(s) I/we agree to Guarantee the Tenant INSERT of the Full Rate Fix Term Rental Amount if he/she fails for any reasons to meet financial requirements arising from the Tenancy Agreement in respect of the Property 2. This Guarantor Agreement refers to the current tenancy being undertaken and any renewal / extension thereafter. All references to the Landlord herein shall be deemed to include the Landlord s Agent or any person authorised to act on the Landlords behalf. 3. The Guarantee is limited to the named person share of rent and their obligations, under the Tenancy Agreement. In any quarter the maximum liability shall not exceed INSERT and will revert to nil if paid by the named Tenant. If the Landlord allows the Tenant(s) further time or does not fully enforce the terms of the tenancy, this guarantee will remain in effect. 4. The Guarantor agrees to make payment within 10 days of receipt of written demand from the Landlord or Agent if the demand is not paid by the Tenant under the terms of the Tenancy Agreement. Should the Guarantor die during the period of this agreement, the Guarantor s estate will be liable as surety and co-principal debtor. 5. The Guarantor shall pay and make good to the Landlord on demand all reasonable losses and expenses of the Landlord incurred as a result of default by the Tenant in the performance or observance of the Tenant s covenants under the Tenancy Agreement. 6. If the tenancy is for a fixed term, then this guarantee applies for the whole of the term and is not revocable during that term. 7. Under the Consumer Protection (Distance Selling) Regulations 2000 the Guarantor may have rights to cancel. It is therefore agreed that the Guarantor will have no rights to cancel this agreement once the tenancy has commenced. 4
