ORDINANCE NO. 2012-04-1447 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, APPROVING ZONING ORDINANCE AMENDMENT 12-02, AMENDING SIGNAL HILL MUNICIPAL CODE SECTION 20.39.060 SETBACKS FOR AREAS 3 AND 4 OF THE SP-19, GENERAL INDUSTRIAL SPECIFIC PLAN, BY REDUCING THE SETBACK STANDARDS ALONG CALIFORNIA AVENUE FROM 20 FEET TO 15 FEET WHEREAS, the City s General Plan Land Use Element Update designated the portion of the Atlantic/Spring neighborhood area generally bounded by Olive and California Avenues and 27 th and 29 th Streets as 4.2, General Industrial and recommended the establishment of a General Industrial Specific Plan; and WHEREAS, in 2006, the City Council approved Zoning Ordinance Amendments and required environmental documents for map changes to establish the SP-19, General Industrial Specific Plan and create Area 1 for the relocation of A&A Ready Mixed Concrete plant at 900 Patterson Street; and WHEREAS, in 2007, the City Council approved Zoning Ordinance Amendments and required environmental documents for map changes to establish Area 2 of the SP-19, General Industrial Specific Plan and allow the development of General Industrial warehouse use at 935 27 th Street; and WHEREAS, in 2009, the City Council adopted an Environmental Impact Report for the EDCO Recycling and Transfer Facility (State Clearinghouse No. 2008081009) relative to the transfer facility application and which analyzed the potential impacts associated with the establishment of development standards for Area 3 of the SP-19, General Industrial Specific Plan in satisfaction of requirements of the California Environmental Quality Act; and WHEREAS, in 2009, the City Council approved the entitlements to construct a recycling and solid waste transfer station for EDCO Transport Services, LLC doing business as Signal Hill Disposal ( EDCO ) at 2755 California Avenue to assist in meeting the City s obligations under the California Integrated Waste Management Act of

1989 (Public Resources Code Sections 40000 et. seq. (the Act )) and to serve the needs of Signal Hill and other jurisdictions in the region; and WHEREAS, the project entitlements included a Zoning Ordinance Amendment to establish development standards for Area 3 of the SP-19, General Industrial Specific Plan, including a 20 foot setback for frontages along California Avenue; and WHEREAS, in 2010, the City Council adopted a Mitigated Negative Declaration for the EDCO truck terminal/administrative offices which analyzed the potential impacts associated with the facility and related entitlements in satisfaction of requirements of the California Environmental Quality Act; and WHEREAS, in 2010, the City Council approved the entitlements for the construction of the EDCO truck terminal/administrative office facility at 950 27 th Street; and WHEREAS, the entitlements included a Zoning Ordinance Amendment to rezone the area from CG, Commercial General to Area 4 of the SP-19, General Industrial Specific Plan, including a 20 feet landscaped setback along California Avenue; and WHEREAS, the EDCO transfer station and truck terminal/administrative office buildings are currently under construction; and WHEREAS, in February 2012, EDCO requested a zoning amendment to adjust the zoning standards for setbacks from 20 feet to 15 feet along California Avenue within Area 3 and Area 4 of the SP-19, General Industrial Specific Plan for the two facilities; and WHEREAS, pursuant to Signal Hill Municipal Code, Chapter 20.86, entitled Amendments, the subject is properly a matter for Planning Commission review and recommendation for City Council adoption; and

WHEREAS, on March 13, 2012, the Planning Commission held a duly noticed public hearing and recommended City Council adoption of Zoning Ordinance Amendment 12-02; and WHEREAS, on March 20, 2012, the City Council held a duly noticed public hearing regarding the Zoning Ordinance Amendment 12-02 and all interested parties were given an opportunity to be heard; and WHEREAS, on March 20, 2012, the City Council continued the public hearing to April 3, 2012; and WHEREAS, on April 3, 2012 the continued public hearing regarding the amendment to reduce the setbacks from 20 feet to 15 feet along California Avenue for Areas 3 and 4 was held before the City Council and all interested parties were given an opportunity to be heard. NOW, THEREFORE, BE IT ORDAINED, THAT THE CITY COUNCIL OF THE CITY OF SIGNAL HILL, CALIFORNIA, DOES HEREBY FIND AS FOLLOWS: 1. The Zoning Ordinance Amendment 12-02 is consistent with applicable State law and promotes the Signal Hill General Plan Land Use Element Goals and Policies as described below: GOAL 1-Manage growth to achieve a well-balanced land use pattern that accommodates existing and future needs for housing, commercial and industrial land, open space, and community facilities and services, while maintaining a healthy, diversified economy adequate to provide future City revenues. Policy 1.5 - The distribution and intensity of land uses shall be consistent with the land use map and descriptions for each of the land use categories in Section VI of the Land Use Element. Finding regarding Policy 1.5 The proposed amendment is consistent with the existing land uses and maintains a wellbalanced land use pattern with adequate setbacks from the street and sidewalk. GOAL 3 - Assure a safe, healthy, and aesthetically pleasing community for residents and businesses.

Policy 3.3 Ensure sensitive transition between commercial or industrial uses and residential uses by means of such techniques as buffering, landscaping, and setbacks. Policy 3.12 Encourage and promote high quality design and physical appearance in all development projects. Findings regarding Policies 3.3 and 3.12 - The proposed amendment is in compliance with the existing policies and will have minimal impact along California Avenue. It will maintain proposed architecture and high quality design features consisting of complimentary perimeter block wall and landscape buffer. GOAL 4 Ensure that future land use decisions are the result of sound and comprehensive planning. Policy 4.1 Consider all general plan goals and policies, including those in other general plan elements, in evaluating proposed development projects for general plan consistency. Policy 4.2 Maintain consistency between the Land Use Element, the other elements of the general plan, the zoning ordinance, and the Municipal Codes regulations and standards. Findings regarding Policies 4.1 and 4.2 The proposed project was evaluated for general plan consistency as indicated above. 2. The amendment is consistent with applicable State law in that the State law and Signal Hill Municipal Code provide a process for amending the zoning ordinance and specific plans. NOW, THEREFORE, BE IT FURTHER ORDAINED, that the City Council of the City of Signal Hill, California, does hereby approve Zoning Ordinance Amendment 12-02 as follows: Section 1. That section 20.39.060 (E.) Setbacks is amended as follows: E. Setbacks for Area 3 shall be measured from the property line after any required dedication of street right-of-way as follows: fifteen twenty feet for frontage along California Avenue; ten feet at the western property line (along frontage to the vacated segment of Olive Avenue); and five feet along frontage on Patterson Street and none on 28 th Street.

Section 2. That section 20.39.060 (F.) Setbacks is amended as follows: F. Setbacks for Area 4 shall be measured from property line after any required dedication of street right-of-way as follows: 10 20 feet for frontage along California Avenue and 10 feet along Myrtle Avenue and 27 th Street.
