I understand that the Old Seale Courthouse is an older building and although every effort has been made to provide a good rental venue, there may certain things that come with being an older building. I understand that the rental fee is due 3 weeks prior to my event. After my event, return of the key and after authorized inspection: If the building and property is free of damage and has been cleaned to the condition in which it was found, I will receive my security deposit. I also understand that if there is anything wrong with the building or property upon arriving at the location, I will notify the number provided and that if I choose to wait until the rental is over, it will be assumed that the damage occurred during the rental period. You will have 24 (business) hours to pay the balance before your reservation is cancelled. If WE must cancel your reservation: Your deposit will not be refunded. If YOU must make a change to your rental arrangements: YOU must come in person to the Russell County Courthouse to make those changes (Ex:Cancel rental, change venue, or change date). Your changes can be made up to 3 weeks prior to your event in order to receive a refund. Emergency cancellations will be decided on a case by case basis. CONDITIONS OF RENTAL continued. All tables and chairs must be put back in the position where they were at the Lessee acknowledges that the premises has been examined and found to be in good, safe and clean condition. There shall be no repairs or alterations to any portion of the premises or equipment located thereon without the prior written consent of the Lessor. Failure of Lessee to take possession of the premises shall not relieve the Lessee from the obligation to pay rent. In the event Lessor is unable to deliver possession of the premises to Lessee for any reason not within Lessor's control, including but not limited to failure of prior occupants to vacate as agreed, or destruction of the premises, Lessor shall not be liable to Lessee, except for the return of all sums previously paid by Lessee to Lessor. Lessee agrees to accept financial responsibility for any damage done to the premises by Lessee or its invitees, licensees or other guests. Lessee will also be responsible for any plumbing stoppages resulting from Lessee's negligence or misuse of the premises during the rental period, cost of all use, cleaning supplies, and lost or damaged utensils and cookware. The obligations under this Agreement are joint and severable, and if more than one Lessee contracts for the premises then each shall be totally responsible for all obligations hereunder. This agreement is to be construed according to the laws of the State of Alabama. If any legal action or legal proceeding in order to enforce any part of this Agreement is initiated, the prevailing party shall recover reasonable attorneys fees and costs from the other party, in addition to any other relief that may be awarded by a Court. Neither Lessor nor Lessee is required to perform any term or covenant of this Agreement so long as performance is delayed or prevented by force majeure, i.e. acts of God, civil riot, flood, hurricane, tornado, or other similar calamity. This document constitutes the entire Agreement between the parties, and all other oral or written promises or representations not contained herein are void and unenforceable. Should Lessor determine that Lessee has violated any of the terms of this Lease, Lessor shall have the right, in addition to other remedies noted in this Agreement and is allowed by law, to deny the Lessee the use of the premises in the future. The Old Russell County Historical Commission began refurbishing the building and grounds two generations ago. The Labor Day Fair is, once again, an annual event and the inside has been restored for any and all public and private special occasions. CONDITIONS OF RENTAL There shall be no illegal substances brought to or consumed on the premises during the rental period. There shall be no smoking on the premises. Lessees shall not put tape or any other nails or attachments on the wall. Attached hereto and incorporated herein by reference is a Check List which must be completed by Lessee at the end of the rental period and returned to the County representative and Facility Director during business hours following the day of the rental, properly executed and signed by the Lessee. All debris, trash and garbage must be removed. All restrooms must be cleaned. All food items must be removed and counters wiped down. All tables and chairs must be put back in the position where they were at the time of the rental. Premises must be left clean. No animal or other pet ;except service animals for the disabled/ handicapped; shall enter the premises without the prior written consent of Lessor. The premises shall not be used in any way to violate any law or ordinance, commit waste or nuisance, or disturbance of the peace. Lessee agrees to comply with all applicable laws, ordinances and governmental rules and 1st Floor: Beautiful Entryway, Meeting Room, Restrooms, Elevator, Dressing/Prep room 2nd Floor: Kitchen, Ballroom Dressing/Beverage Room. Reservations are not confirmed until deposit is received. The following is a minimum checklist provided for the renter. Compliance with the rules and tasks to follow are necessary for the security deposit to be returned. All of the tasks below are required and must be done before the return of the Courthouse keys after the event. The person signing for and receiving keys will be responsible for cleaning the area after each use the security deposit will not be returned until building has been inspected. Please allow 5 days after inspection for deposit return. ABSOLUTELY NO TAPE OR STICKY SUBSTANCES MAY BE APPLIED TO ANY SURFACES. NO SMOKING INSIDE THE BUILDING PLEASE DO NOT THROW RICE INSIDE OF THE BUILDING. ALL ELECTRICAL APPLIANCES, AIR CONDITIONERS/HEATERS, LIGHTS ETC. MUST BE TURNED OFF. IF ANY OF THESE THINGS ARE LEFT ON, DEPOSIT WILL BE FORFEITED. CHECKLIST Bathrooms must be checked. PLEASE do not leave the water or toilets running. Any problems with water or faulty plumbing must be reported immediately. All floors must be clear of water and debris All tables, chairs and other furnishings must be wiped clean. Chairs must be placed in the racks provided by the Courthouse. Tables must be folded and placed in the proper rooms. Floors must be swept and lightly mopped with plain water to remove any spills from beverages and food. It is your responsibility to remove all trash from inside and outside the Courthouse. If garbage is left on the grounds of the Courthouse or inside the Courthouse, your deposit will be forfeited. The Russell County Courthouse does not provide garbage pickup. Trash must be removed from premises. A dumpster is located behind the school. ALL TRASH BARRELS MUST BE LEFT CLEAN. Kitchen area must be checked and cleaned accordingly. If the appliances are used, it is the responsibility of the person renting the facility to clean, after each use. All counters must be cleared and wiped clean. Hot water heater under the sink should be turned off before leaving. Stairs are frequently overlooked, they should be wiped clean, swept and mopped, if necessary. Windows must be closed and cleaned. Outside area must be clear of trash, cigarette butts, etc. Date AGREEMENT Valid picture ID must be presented upon application Parties This Agreement is made and entered into this day of, 20, is between The Old Russell County Courthouse Association/Russell County Commission, hereinafter referred to as "Lessor," and, hereinafter referred to as "Lessee". The person who has executed this Agreement as "Lessee" shall remain on premises during the entire time of the rental period as set out herein. PREMISES Subject to the terms and conditions herein, Lessor rents to Lessee, and Lessee rents from Lessor, the premises known as THE OLD RUSSELL COUNTY COURTHOUSE located at 91 Longview Street, Seale, Alabama 36875. USE OF PREMISES The parties acknowledge that the Old Russell County Courthouse is primarily for family activities, wedding receptions, civic meetings, reunions and church functions. In keeping with the proper use and the limitations of the facility, the following activities are strictly prohibited or limited as follows: The Lessee is strictly prohibited from charging any admission fees to any function at the facility. The person who executes this Lease must be on premises during the entire time of the lease and is the person solely responsible for enforcing the terms of this Lease, including securing the property at the end of the lease. Lessor shall, at its sole discretion, shall have the authority to require Lessee, to have a uniform security guard on the premises during the lease period at the expense of Lessee. The maximum number of people allowed to attend any function at the facility is two hundred (200) people. RENTAL PERIOD RENT Rental of the OLD RUSSELL COUNTY COURTHOUSE shall not exceed the following:7:00 a.m. to 12:00 am Weekdays; 7:00 am to 12:00 am Weekends (Saturday and Sunday), not to exceed 48 hours to any Lessee. Lessee acknowledges that the hours stated above includes preparation time for any activity and clean up time. It is the responsibility of the person signing this Agreement as "Lessee" to be totally responsible for cleaning up the facility during the rental period, make sure the facility is properly secured and closed up at the end of the rental period. Upon execution of this agreement the Lessee agrees to pay:one Hundred ($100.00) Dollars security deposit and Five Hundred ($500.00) Dollars as rent, payable in advance, for the period specified above. In the event any check offered by Lessee to Lessor in payment of rent or any other amount due under this Agreement is returned for lack of sufficient funds or a closed or non-existent account, Lessee shall pay to the Lessor a check return charge in the sum of :Twenty-Five ($25.00) Dollars.
