This includes the buyout of some properties, partial acquisition from others and the potential for other temporary or permanent land use agreements to complete the works. The City owns all of the land it requires on the east side. Of the eight properties identified in the EA on the west side, one was purchased by the City in 2013 after the City was approached by the property owner. In order to deliver the property required in the timeframe set out by the Third Crossing project, staff is recommending that Council approve the delegated authorities outlined in this report. Notwithstanding the engagement of property owners throughout the EA and public consultation process, the City was not in a position to advance property acquisition discussions until the final project funding component was announced in February 2018. Staff reached out to all impacted property owners immediately after the federal funding announcement to commence negotiations. Staff will continue to work diligently with all impacted property owners to negotiate settlements; however, the recommendations in this report will also allow staff to initiate a parallel process of expropriation, if necessary, to guarantee that required properties are in the City s possession in time for the start of construction in 2019. Delegated authority will also allow staff to continue to work expeditiously and efficiently should Council become lame duck in the months surrounding the upcoming municipal election. Recommendation: That Council delegate, through the Chief Administrative Officer to staff, the following administrative and contractual authority with respect to property acquisition for the Third Crossing and for the lease of the office work space for the Integrated Project Delivery (IPD) team (the related works ), as further described in Report Number 18-132: a. Authority to the Director of Real Estate & Environmental Initiatives to proceed with the acquisition of the property interests required to facilitate the construction, use and maintenance of the Third Crossing and related works, as described in said report; b. Authority to the Deputy Commissioner of Transportation & Infrastructure Services, Engineering and Major Projects Office and the Director of Legal Services to place any bylaws required pursuant to the Expropriations Act for the purposes of authorizing the making of applications for approval to expropriate property and approving the expropriation of property rights, on a Council agenda, if necessary, to facilitate the construction, use and maintenance of the Third Crossing and related works as described in this report; c. Authority to the Deputy Commissioner of Transportation & Infrastructure Services, Engineering and Major Projects Office and the Director of Legal Services to approve any real estate transaction over $100,000 recognizing that the properties to be acquired will be of varying property values and that such negotiations need to be completed so that the project timelines are achieved; said authority to include the acquisition or disposition of any interest in, or right to use, real property for the purposes of the Third Crossing, as well as any offer of compensation payable under the Expropriations Act, and the execution of documentation as required and any amendments thereto provided it is in accordance with appraisal requirements of the Acquisition of Real Property Policy or the Disposition of Real Property Policy and is within the project budget for the Third Crossing; d. Authority to the Director of Legal Services to execute undertakings, certificates, statements, declarations and such other documents as required for the completion of any real estate transaction involving the acquisition of any interest in, or right to use, real property for the purposes of the Third Crossing and related works; and e. Authority to staff to report the details of the real estate transactions related to the Third Crossing and approved under delegated authority, including expropriations, to City Council after all property interests required for the Third Crossing and required works have been acquired by the City and all claims for compensation have been settled. Options/Discussion: The Environmental Assessment (EA) process for the Third Crossing identified properties to be impacted by the construction of a third crossing (Exhibit A) and as further delineated in the Preliminary Design (Exhibit B). The City owns the lands its needs on the east side of the bridge, but the improvements to John Counter Boulevard and the bridge structure itself identified eight (8) land owners whose property rights are to be impacted on the west side of the bridge. This includes the buyout of some properties, partial acquisition from others and the potential for other temporary or permanent land use agreements and acquisitions to complete the works. Property owners were invited to be engaged throughout the public EA process; however, with the exception of one (1) property at 603 John Counter Boulevard, the authority for staff to initiate formal negotiations to acquire property had to wait until the funding was secured from senior levels of government. The former owner of 603 John Counter Boulevard was ready to sell and approached the City in 2013 with the first opportunity to purchase. Council approved the purchase in late 2013 and the property acquisition closed in 2014. In 2007, other lands on the north side of John Counter Boulevard were acquired by the City in conjunction with the construction of the River Park housing development. Real Estate & Environmental Initiatives staff reached out to all property owners immediately after the announcement of the federal funding on February 21, 2018 to initiate discussions. Staff remains committed to negotiating agreements. However, given the timelines for the Third Crossing project it may be necessary to initiate and/or proceed with a parallel process of expropriation to assemble the property interests required. A parallel process was used successfully by the City of Kingston recently to acquire the final properties for the John Counter Boulevard widening project. Staff negotiated the acquisition of the first 33 properties over a series of years and phases of the project; however, to accommodate the final stage, Council authorized the commencement of expropriation for the last nine properties. In the end, only one of the properties required expropriation. The timelines are much shorter with the Third Crossing project, requiring staff to develop alternative strategies, including delegated authority to commence the expropriation process, to acquire property rights while respecting the interests of private land owners. An accelerated parallel process as described in this report has been successfully used by other municipalities such as Ottawa and York Region when faced with similar timelines guided by senior level government funding programs and the design build process. Regardless of negotiation or expropriation, the City of Kingston s Acquisition of Real Property Policy still applies to the process which directs that fair market value be paid for property and owners be fairly compensated for other losses and costs. If expropriation is necessary before negotiations can be completed, the expropriation process also ensures that property owner interests are protected while allowing the municipality to assemble the lands needed to support the project. Pursuant to the Expropriations Act (the Act) Council approvals are required at two stages of the expropriation process: Council Meeting 13 May 1, 2018 34

Approval to Initiate Expropriation: Council must authorize, by By-Law, the making of an application for approval to expropriate specific parcels of land, following which staff prepare Notices of Application to Expropriate in accordance with the Act, including service by registered mail to all owners and by publication; and Approval to Expropriate: After the above relevant formal and procedural requirements of the Act have been fulfilled, Council must authorize, by By-Law, the actual expropriation. Acknowledging that there are statutory timelines associated with the requirements of the Act that must be followed, this report recommends that staff be delegated the authority to place the necessary authorization by-laws described above directly onto future Council agendas for Council s approval. Staff will inform Council of upcoming by-laws by referring to them in the Weekly Council Updates as appropriate. Delegated authority is also being sought for the Deputy Commissioner, Transportation & Infrastructure Services, Engineering and Major Projects Office and the Director of Legal Services to complete acquisitions and settle all offers at fair market value, without expropriation. The Consolidated Delegated Authority By-Law, By-Law Number 2016-189, provides the Commissioner of Community Services with delegated authority to acquire property up to $100,000. The delegated authority recommended in this report is required to address the acquisition of properties above this figure, recognizing that the properties to be acquired will be of varying values and that such negotiations need to be completed so that the project timelines are achieved. The acquisition of property will be within the project budget for the Third Crossing In addition, delegated authority will allow staff to continue to work expeditiously and efficiently should Council become lame duck in the months surrounding the upcoming municipal election. Pursuant to section 275 of the Municipal Act, 2001, Council may be restricted during the nomination period (July 27, 2018) to the day of the election (October 22, 2018); and again potentially from the date of the election to the end of the current term of Council (November 30, 2018). Specifically, in section 275(3), the making of expenditures or incurring of any other liability, which exceeds $50,000 is prohibited during lame duck periods. This does not apply, however, if the expenditure was included in a budget approved by Council prior to the nomination day. The budget for property acquisition for the Third Crossing has been approved as part of the overall project budget. The Municipal Act, 2001 also provides that nothing in section 275 prevents city staff from exercising any delegated authority that is delegated prior to nomination day. The recommendations in this report give staff delegated authority to approve purchases, make applications for expropriations as required under the Expropriations Act by way of a by-law(s) which staff will place directly on to the Council agenda. Staff will report the details of the financial transactions made under this delegated authority when all properties have been acquired, and all related claims for compensation have been settled. This method of reporting will protect the City s financial interest in ongoing negotiations with property owners and potential expropriation proceedings. In some cases, it will also protect the owners of expropriated property whose interests may be compromised if the release of compensation details complicates their efforts to obtain new properties to replace the expropriated property. The delegated authority in this report will also provide staff with the ability to make advance plans to ensure that office work space for the Integrated Project Delivery (IPD) team, to be selected from the Detailed Design and Construction Request for Proposal (RFP) currently out in market circulation, is secured upon award of contract. Staff may enter into an Offer to Lease, and subsequently a Lease, for office space which can be assigned directly to the successful proponent of the IPD team. Notice as required under the Expropriations Act will be undertaken if expropriation is commenced on any property and will be completed as required by the legislation.
