Quail Hollow On The Ocean South, Condominium Association, Inc. RULES AND REGULATIONS Updated August 22, 2015 Pursuant to the authority vested in the Board of Directors of Quail Hollow, the following rules and regulations have been adopted by the Board of Directors to promote the health, welfare and safety of all occupants and to govern the use of the common and limited property as defined in the Declaration of Condominium. A.GENERAL These rules and regulations apply to all unit owners and their immediate families, lessees and guests. The objectives of these rules are to insure the equal rights of all unit residents to use and enjoy their respective units and the common areas. The rules are designed to promote the safety, comfort and convenience of residents and the preservation and maintenance of the property. Unit owners and tenants are responsible for the conduct of all occupants of a unit, their guests, visitors and employees while on the premises. No immoral, improper, offensive or unlawful use shall be made of any unit or of the condominium property. When a unit is rented/leased, a tenant shall have all use rights of the Association property and those common elements otherwise readily available for use generally by unit owners, and the unit owner shall not have such rights except as a guest. B. OCCUPANCY The total number of overnight occupants is limited to four (4) people per one bedroom unit, six (6) persons per two-bedroom unit and eight (8) people per three-bedroom unit, or a lesser number per unit if required by law. C. GUESTS Owners must insure that their tenants/guest register with the office at the earliest possible time, to sign in and receive their valid parking pass and acknowledge the receipt of the current rules and regulations. Cars without valid parking permits will be towed. D. DWELLING UNITS Loud and disturbing noises are prohibited. All radios, televisions, tape machines, stereos, singing or playing of musical instruments shall be regulated to sound levels that will not disturb others. Voice levels of those walking on site shall be such that they will not disturb others. Nothing shall be dropped, thrown, swept or otherwise expelled from any window, door, balcony or terrace. No plants, pots, receptacles attachments or other articles shall be hung from the ceiling or wall of any balcony or terrace or placed on the balcony railings. Further, no towels, linens, bedding or clothing shall be hung from the balcony or window of any unit. E. FIRE SAFETY A. Clothes Dryers: Dryers are a major cause of home fires: adhere to the following for safety in the use of clothes dryers: 1) Never leave dryers running while you are away from home. 2) Clean out the lint traps regularly. 3) Vacuum lint from duct work and under and behind your dryer at least twice a year. 4) Replace any plastic duct work at the back of your dryer with metal duct connecting it to the wall.
F. PETS 5) Every dryer s duct should be vented through a container of water that must be checked and refilled on a regular basis. B. Smoke Detectors, Fire Extinguishers and flammable Products: 1) Each unit must have a working smoke detector and working extinguisher 2) Do not store any flammable products in the storage areas, on balconies or in your unit. A. No pets are permitted in leased or rented units. B. The owner of each unit may keep up to two pets, of a normal domesticated household type (such as a dog or a cat) in the unit. No reptiles, rodents, amphibians, poultry or livestock may be permitted in the Condominium. Pets that are vicious, noisy or otherwise unpleasant will not be permitted on the premises. The ability to keep a pet is a privilege, not a right, and the Board of Directors is empowered to order and enforce the removal of any pet, which becomes a source of unreasonable annoyance to other residents of the condominium. C. Pets are not permitted in the pool area. D. Pets must be walked in designated dog walk areas only and must be leashed at all times when outside the unit. E. Messes made by pets must be removed immediately, including the dog walk area. Use a scooper and plastic bag and follow your pet(s). F. Bird feeding is not permitted on porches or anywhere on the premises as the feed attracts rodents. G. GARBAGE AND REFUSE 1. Household garbage ONLY shall be placed in dumpsters, and must be secured in plastic bags. Appliances, carpet remnants and construction debris are PROHIBITED. Management will assist owners in the proper removal of such items. 2. Recycle bins are available for aluminum cans, newspapers and glass. H. CLEANLINESS AND MAINTENANCE Owners and tenants are responsible for keeping the patios, balconies and stairways of the building, in which their unit is located, clean and in orderly condition. Toys, rafts, bicycles, and surfboards, etc shall be kept in the unit. Lawn chairs and other personal effects are not to be left on the grass or in the pool or when not in use. There shall be no obstructions or cluttering of the condominium property. Nothing shall be left in the stairwells. The Board of Directors or Management shall be permitted entry to a unit for the purpose of maintenance, inspection, repair or replacement of common elements or limited common elements or to determine compliance with the Declaration of Condominium, Articles of Incorporation, Bylaws and/or Rules and Regulations, and/or local or state laws. No items shall be stored in the electrical/tv signal stairwell closets. I. SUPERVISION OF CHILDREN Children shall be properly supervised and will be expected to observe the Rules and Regulations. J. PARKING AND VEHICLES Motor vehicles must be parked in assigned parking spaces or in designated visitor spaces. Parking in an area marked fire lane, no parking or parking in another units assigned space or parking without a valid parking permit is considered a parking violation and the vehicle can be towed without notice at the vehicle owners expense. All guests must obtain parking permits from the office and it must be visible on the driver s side of the dashboard.
Each unit is entitled to one assigned parking space. Visitor and overflow parking is limited to space available. Tenants may receive two temporary parking permits for the dates of their stay. All parking permits and stickers must be displayed on dashboard or front mirror where easily visible. No vehicle of any type may be parked on the property without a current license tag. No vehicle repairs or servicing, except of minor nature, are permitted on the property. Un-kept or unsightly vehicles are not permitted. Vehicles must be muffled against noise. Commercial motor vehicles are not permitted, except vendors while working in a unit or around the complex. No parking of trailers, boats, RV s, Skidoos, etc will be permitted. No motor vehicle or any type shall display unsightly signage, nor contain on it or in it visible material considered unsightly, such as, but not limited to, construction material, refuse, equipment, etc. A visitor MUST have a valid permit. No vehicle with more than two (2) axles or twenty-five (25) feet in length is permitted without permission from Quail Hollow Management. The Association assumes no responsibility for motor vehicles on the property or on the strip of land between the Associations property and Highway A1A. Absentee owners who choose to leave their vehicle on site must park the vehicle in their reserved parking space. Specific parking spaces are not conveyed with a unit when the unit sells or transfers to a new unit. The space is available for reassignment to another owner provided that a request for that specific space has been submitted in writing to management by owner. Any owner who wishes to swap their designated parking space with any visitor space may do so by notifying the QH office. K. BARBECUE AND GRILLING Barbequing and grilling of ANY type is NOT allowed anywhere on the property except the authorized grilling area next to the pool house and the south end of the pool grilling area. Grills or cookers are not allowed in storage closets porches or balconies. Any found by management or reported by owners will be confiscated. This rule is to protect your property and to comply with county fire codes. L. OTHER USE RESTRICTIONS Bicycles are not permitted in the pool area. Use of skateboards or roller blades is not permitted on the property. No person may post or display a For Sale, For Rent, Open House or other similar signs within the condominium or on the condominium property without approval from the Association.
No auctions sales, yard sales or other such activity shall be permitted on the property. M. RENTAL UNITS No lease shall be less than one (1) week or more than one (1) year. All leases/ rentals must be in writing. The lessee must be an adult person, age 21 years of age. No one but the lessee, his family members within the first degree of relationship by blood, adoption or marriage, and their spouses and guests may occupy the unit. Minors, under age 21, are not permitted to occupy a unit during any period of the lease without the lessee being in residence at the unit. Further, owner s children under the age of 21 are not permitted to occupy the unit without the owner being in the unit. N. STORM PREPAREDNESS During hurricane season (06/01-10/31), if you will be away from your unit for more than 48 hours, you must bring all furniture inside your unit. You can be liable for any damage caused by your personal property. O. ENTRY AND EXIT GATES The north gate is entry only except for large commercial vehicles. The south gate is exit only. All residents and guests must use the south gate to exit the property P. GATE CODES Each owner is assigned a personal gate code. This code is meant to be for the exclusive use by the owner(s) and should not be given out to renters, contractors etc. All entities such as mail and package deliveries, fire and safety and other operations which have a need to enter the property will have codes issued and maintained by the Association. All renters including those secured by owners must notify the office with information such as name, unit, length of stay. A temporary code will be issued for these individuals. Q. SWIMMING POOL Hours of operation are 9 am until 10 pm daily Pool usage is for owners, their renters and owners guests only A maximum of 24 people are allowed in the pool at any one time A shower is provided in order to remove sand, sun tan oil etc prior to entering the pool Children Children under the age of 14 must be accompanied by an adult Children who are not toilet trained must wear swimming diapers Changing of diapers is not permitted in the pool area Flotation devices Flotation devices such as rafts, boogie boards, surf boards, lounge chair floats are not permitted in the pool.
Personal flotation devices such as life jackets, angel wings, noodles etc are permitted in the pool Diving is not permitted No offensive, abusive or profane language is permitted in the pool area Running, rough play etc are not permitted in the pool area The use or tossing of hard balls of any kind to include, but not limited to lacrosse balls, baseballs, footballs, basketballs, tennis balls, or any other object which has the possibility of injuring others is prohibited in the pool area Food and drinks No glass containers of any kind are permitted in the pool area. Food and drinks are not allowed in the pool itself or on the side of the pool. Food and drinks are permitted on the pool deck area. Any trash must be disposed in the available receptacles Fencing and Gates Gates must remain closed when not being used for entering or exiting Climbing or sitting on fences or gates is prohibited Pets No pets are permitted in the pool area Smoking Smoking is prohibited in the pool or on the side of the pool We ask adults who wish to smoke to do so outside of the fenced area of the pool. Please dispose of cigarette butts properly. Pool furniture is not to be removed from the pool deck area R. BALCONY ENCLOSURES This section relates to Quail Hollow on the Ocean, South condominium documents Section 8.1 (D) and Section 11.4 The Board, at its discretion, may or may not approve a balcony enclosure depending on the type of request. The Board may, but is not required to, approve balcony enclosures provided that the request conforms to the requirements below: 1. No enclosure of any type extends an existing roof 2. No enclosure can increase the roof surface area of any building Only permanent enclosures may be approved. This means the enclosure must become part of the existing façade of the building. Construction must be compatible with existing siding and paint. Window configuration should be
comparable with other enclosed bedroom balconies in the complex. Window frame color must be white. Windows installation must comply with the building code at the time of the request. All internal modifications of floor, ceilings or walls as the result of a balcony enclosure approval or prior installation are the sole responsibility of the unit owner and subsequent owners Any roof addition relating to a previously approved enclosure prior to 8/22/2015 is the responsibility of the unit owner and this responsibility is conveyed to subsequent owners. Second floor enclosures, without roof extensions, can be approved at any time. First floor enclosures can only be approved if the balcony above has been enclosed. Enclosures such as a screened in balcony (aluminum, wood, etc.) are not considered permanent and are not permitted. Enclosure requests must be accompanied by detailed construction plans. Only Florida licensed contractors can be used to perform the work. Any required permits are the responsibility of the owner
