BACKGROUND/RELATED STRATEGIC GOAL: The Green River Parkway project from Jensen Beach Boulevard south to Dixie Highway (SR707) is under construction. In order to obtain the required FDOT general use permit, FDOT requires that the County transfer ownership of approximately 1.10 acres of right-of-way to them; provide a 0.50 +/- acre Perpetual Easement for drainage and agree to terms of the attached Subordination of Utility Interests. The stated utilities are owned by the City of Stuart and run through the subject property. The City of Stuart has a valid utility easement within the subject property. FDOT wants to be assured that, if they need to have the City relocate any of the utilities, the County will pay the costs. ISSUES: Once approved by the County and FDOT, this three party Subordination of Utility Interests document, executed by the City of Stuart, requires the County to pay for the relocation of the City s facilities within the described property, if FDOT deems it necessary to relocate the City s utilities. RECOMMENDED ACTION: RECOMMENDATION Staff recommends that the Board adopts two Resolutions: 1) Approve the transfer of right-of-way at the intersection of Green River Parkway and NW Dixie Highway to the Florida Department of Transportation. 2) Approve the Perpetual Easement at the same location to the Florida Department of Transportation. Staff also recommends approval of a three-party Subordination of Utility Interests by the City of Stuart, the County, and FDOT over the same property and authorizes the Chair to execute any documents necessary to carry out these actions upon concurrence by the County Attorney. Grantor will maintain the drainage facilities which receive the FDOT s runoff at a maximum tail water of 6.02 ft. NGVD for a 10 year, 1 day event and at 6.15 ft. NGVD for a 25 year, 3 day event. This is based on maintenance of the weir elevation at 5.75 ft. NGVD as permitted by SFWMD under Permit No. 43-01439-P. 6. Grantor will maintain the drainage system and structures located within its property; however, if Grantee s drainage system within Grantor s property is not properly maintained, then Grantee shall have the right to enter the premises and maintain said system at the sole cost of Grantor. 7. Grantor will provide Grantee prior notice of any reconfiguration of the drainage pond, or agreements with other users that might cause an impact on Grantee s water flow or drainage system and Grantor will mitigate any impact as approved by Grantee. 8. In the event Grantor establishers a property owner s association or similar legal entity, (the Association ) for purposes of, among other things, maintaining the drainage system within the Grantor s property, and assigns to the Association. Grantor s rights and obligations under this Easement, the Association shall thereafter be bound by the terms and conditions of the Easement and Grantor shall have no further obligation or liability under this Easement, provided that the Association collects and maintains common assessments for the maintenance and repair of the surface water management system for the project, including the lands encumbered by this Easement. 9. Grantor acknowledges that this easement is intended to run with the land and that the grantees of any subsequent conveyances of the easement property shall be subject to and bound by the terms, conditions and obligations herein. TO HAVE AND TO HOLD the same unto said grantee, its successors and assigns forever.
