Written permissin granting use f an existing restrm facility n r nearby the prperty (must be within 500 FT) 8. A site plan, drawn t scale, shwing the prperty and its existing features (i.e. buildings, parking stalls, drive aisles, sidewalks, fire hydrants); the exact lcatin f the vendr in relatin t buildings, sidewalks, radways, driveways, fire hydrants and ther imprtant features n the prperty; all cmpnents f the business with sizes/dimensins (i.e. temprary structures, display area, fences, trash receptacle, parking stalls). Phtgraphs and/r illustratins shwing all cmpnents f the business (i.e. temprary structures, display area, fences, trash receptacle, signage). The site plan and phtgraphs/illustratins need t include all infrmatin necessary t shw cmpliance with the applicable zning requirements listed belw. 9. An electrical plan, if pwer is required fr the business. Plan needs t shw the pwer surce, hw it is cnnected t the temprary structures, hw it is prtected frm the elements, wire size and lcatin. ZONING REQUIREMENTS The city shall nt issue a business license fr a vending cart unless all f the fllwing requirements can be demnstrated as part f the business license applicatin: The business must be lcated in the State Street Cmmercial (SSC), Transit Oriented Develpment (TOD), Histric Cmmercial (HC) r Reginal Cmmercial (RC) zne district. Lcatin n Private Prperty. The business and any activity assciated therewith must be lcated n private prperty and nly as a secndary use t anther primary cmmercial use. The business shall nt be lcated n public prperty (including public sidewalks, public streets, public parking areas r ther public places as defined by the city) r n vacant r residentially used prperty, regardless f the zning district. Impervius Surface. The business must be lcated n a hard surface with n prtin f the business lcated in a landscaped r nn-imprved area. Setbacks. The business must be lcated a minimum f ten feet behind the inside edge f the public sidewalk (r 15 feet frm the edge f the rad right-f-way if n sidewalk exists); five feet frm cmbustible walls, rf eave lines, awnings, etc.; ten feet frm any building penings (i.e. drs, windws, vents, etc.); and five feet frm a fire hydrant, driveway, handicapped parking space and lading area. Traffic Safety. The business lcatin shall nt impede aut and/r pedestrian traffic r create aut/pedestrian cnflicts. Private sidewalk clear widths shall nt be reduced belw five feet and the itinerant business shall nt interfere with the internal parking lt circulatin. Parking. The site must have adequate parking t accmmdate the primary uses(s) n site as well as any area used by the itinerant business. N part f the itinerant merchant business shall ccupy required parking stalls fr the primary use(s). Pwer. All electrical wiring must be in cmpliance with the Natinal Electrical Cde and apprved by the Midvale City Building Department. Extensin crds and generatrs are prhibited. Temprary Only. All aspects f the business shall be temprary in nature with n permanent facilities cnstructed n site, with the exceptin f the required permanent pwer surce. Maintenance. The area arund the business shall be kept clean and rderly. A trash receptacle shall be prvided fr patrns. The merchant is respnsible t cleanup all trash, litter, spills, etc. within a minimum 20-ft radius f the business. Business Cnduct. The business may nt slicit r cnduct business with persns in mtr vehicles r use any flashing lights, nise, sund r ther mtin prducing devices t attract attentin t its peratin. Regulatry Cmpliance. All applicable lcal and state regulatins (i.e., fd permit, tax numbers, registratin, etc.) shall be met. Business License. All requirements f Title 5, Chapter 5.14 f the Midvale Municipal Cde shall be met. * * * There shall be a minimum separatin f 1320 feet between all vending cart lcatins in the State Street Cmmercial (SSC), Reginal Cmmercial (RC) and Transit Oriented Develpment (TOD) zne districts. There shall be a minimum separatin f 200 feet between all vending cart lcatins in the Histric Cmmercial (HC) zne district. This separatin shall be measured as a radius in all directins, with the vending cart lcatin being the center pint. The vending cart must be lcated n clser than thirty feet frm a single family residential zne. Any vending cart selling fd items shall nt be lcated within 200 feet f the primary public entrance f an existing restaurant use. The exceptin t this is an existing restaurant is allwed t perate a vending cart within this area, prvided all ther prvisins f this sectin are satisfied. A minimum f tw n-site parking stalls are required fr the vending cart use. One f these stalls shall be dedicated fr the use f the itinerant merchant s patrns; the ther fr a business emplyee. The vending cart shall be cnstructed f surface materials that are primarily stainless steel and in accrdance with the Salt Lake Valley Health Department regulatins. The vending cart shall nt exceed a width f three feet and a length f six feet (a hitch may extend a maximum f tw feet beynd the length f the cart). The maximum
height f the vending cart, excluding canpies r umbrellas, shall be five feet. A vending cart may include a builtin canpy nt exceeding the dimensins f the cart. This canpy shall be an earth tne clr. The vendr shall be limited t three stacked clers (each cler shall nt exceed 3.75 square feet in size), ne trash receptacle, ne chair, and a freestanding umbrella (nt t exceed a six-ft diameter) external t the vending cart. All ther freestanding devices, i.e. signs, prpane tanks, tables, racks, custmer seating, verhead structures (i.e. tarps, enclsures, canpy extensins), etc. are prhibited. The freestanding umbrella shall be an earth tne clr, and, if extending beynd the frnt and side edges f the cart, must be a minimum f seven feet abve the parking lt surface. Signage shall be attached t the vending cart and ccupy n mre than fur square feet n the street facing side f the cart. Signs shall nt be internally illuminated r make use f flashing r intermittent lighting r animatin devices. Pennants, streamers, lawn banners and ther temprary signs are prhibited. A prtable fire extinguisher, Type 2A-10 BC minimum, must be munted within easy reach n the vending cart. All aspects f the business shall be mved n and ff the premises each day f peratin. N vernight parking r utdr strage is allwed. Any vending cart selling fd items must be cleaned and stred at a cmmissary apprved by the Salt Lake Valley Health Department.
