Regular Meeting Hayden Planning Commission October 12, 2017 The regular meeting of the Hayden Planning Commission was called to order by Vice-Chair Amy Williams at 7:20pm p.m. Other members present were John St Pierre, and Tim Frentress. Town Manager Mathew Mendisco was also in attendance. Moment of Silence and Pledge of Allegiance Consideration of Minutes Vice-Chair Williams asked for a moment of silence and led the Pledge of Allegiance. Commissioner John St Pierre moved to approve the minutes of the regular meeting held September 28, 2017 as written. Commissioner Frentress seconded, with the vote unanimously approved 3-0. Public Comments Old Business Staff Review and Work Session of Land Use Code Mr. Eric Heil reviewed the new proposed Development Code with the Board in detail going over each section. The new Development Code will be chapter 7 of the municipal code and has been consolidated from 365 pages to 264 pages. Major changes included changing public hearing time periods from 15 days to 10, appeals of PC decisions are to all go to the Town Council, and all references of administration interpretation are to be made by the Town Manager and or their designatee. Several comments were made in reference to things to add in the footnotes for 2018 phase two amendment considerations. New Business Review and Consideration for Recommendation the 41North Aquaponic Development in Industrial Park The 41North Aquaponic Development, Jay Hirschield, 2970 Columbine Dr #501 Steamboat Springs, CO 80487 presented their plans and business plan to the Planning Commission. Commissioner Frentress seconded, with the vote unanimously approved 3-0. Regular Meeting Hayden Planning Commission October 26, 2017 The regular meeting of the Hayden Planning Commission was called to order by Chair Angie Robinson at 7:00 p.m. Other members present were John St Pierre, Tim Frentress, Chris Rainwater and Vice-Chair Amy Williams. Town Manager Mathew Mendisco was also in attendance. Moment of Silence and Pledge of Allegiance Consideration of Minutes Chair Robinson asked for a moment of silence and led the Pledge of Allegiance. Minutes were tabled till the following meeting. Public Comments Old Business Public Hearing: Revision and re-write of Title 16 Land Use of the Hayden Municipal Code. A complete update, reorganization and replacement of Title 16 Land Use of the Hayden Municipal Code with a new Title 7 Development Code Review Consideration of Approval for Title 7 Development Code; Resolution 17-01; and Recommendation to Hayden Town Council for approval. The public hearing was opened by Chair Robinson at 7:05pm. No public comments were made. The public hearing was closed by Chair Robinson at 7:06pm. Mr. Mendisco reviewed the Title 7 Development Code with the Commission. Commissioner Rainwater motioned, Commissioner Frentress seconded, with the vote unanimously approved 5-0. New Business Staff and Commission Member Reports Adjournment Mr. Mendisco reviewed the development update with the Commission. Town of Hayden Planning Commission Staff Report Project: Address/Location: Applicant(s): Prepared by: Aspen Alley Replat/Minor Subdivision Plat, Lots 1R & 2R 408 E. Washington Avenue/ Northeast corner of Washington Avenue and Aspen Street Ms. Kristy Stinnett Ross Culbertson, Hayden Consulting Planner Hearing Date: December 14, 2017 Background The applicant has submitted a Replat to be reviewed under the Minor Plat process to reconfigure original Lots 1, 2, 3, and west 15 feet of Lot 4, Block 2 of Martin P. Walker s 3 rd Addition to Hayden into two (2) separate lots under one ownership. The property is zoned Residential Low Density (RLD). The owner is refinancing the property which contains a primary single-family home with detached garage facing Washington Avenue, in addition to a separate accessory dwelling unit (a 1-story/1-room cottage structure) and a second shed/garage facing Aspen Street. The original structures will remain on the property as legal non-conforming structures, yet be separated between the two new lots for financing purposes. No new residential structures are planned. Lot 1 indicates a 10-foot alley right-of-way for drainage ditch purposes was abandoned and vacated by Ordinance No. 610 in 2008 and recorded with Routt County by Reception No. 677957 in 2017. The area is no longer an encumbrance to the property and is acquired through this platting process by the owner as additional square footage to aid in meeting RLD lot area requirements. Compliance with Review Criteria The Town s Land Use Code, Section 16.04.080.C.1 lists the Minor Subdivision Plat review criteria to which staff used to evaluate the applicant s request; which states the following:

1. The Minor Subdivision Plat is in compliance with this Code and Comprehensive Plan. Staff finds the technical requirements of the plat have been met, and the plat is in order as submitted. Both Lots 1R and 2R comply with the 6,000-square foot minimum lot area requirement under RLD zoning. The lots are identified as Medium Density Residential land uses within the Town s Future Land Use Map and comply with the land use intent. The Replat/Minor Plat of Lots 1R & 2R will supersede the original lot subdivision when recorded with Routt County. Referral Agency and Department Comments The Replat/Minor Plat was referred to the following agencies for a development review: Planning Building Inspections Hayden Fire District Public Works (Water/Sewer/Streets) Engineering Yampa Valley Electric Association No major comments were made by referral agencies during the plat s review. Public Input As required by Land Use Code 16.04.080.B.7, a notice was sent to property owners within 150 feet of the property, a sign was posted on the property and a public notice was placed in the newspaper at least 15 days prior to this Planning Commission Public Hearing date. Planning Staff has not received any public input regarding this plat to date. Staff Recommandation Based on the above observations and findings of compliance with the Hayden Town Codes, staff recommends Approval of the Replat/Minor Plat as submitted. Planning Commission Recommending Options The Planning Commission may choose to take the following action after the Public Hearing: 1. Recommend to the Town Council approval as submitted. 2. Recommend to the Town Council approval subject to additional Planning Commission Conditions. 3. Recommend to the Town Council project denial.
