Giaschi-Pacini called the meeting to order at 7:00 p.m. Municipal Planner, Kim Horrigan, confirmed Notice was issued in accordance with the Planning Act, R.S.O. 1990 and Municipal Planner, Matt Holmes, presented the Statement of Purpose & Effect of the proposed rezoning and advised how the proposed By-law will accomplish the purpose required. Opening Comments: Statement of Purpose & Effect of the Proposed Zoning By-law: 1. The subject property is currently zoned Residential Type 1 (R1) according to Comprehensive Zoning By-law 2006-120 as amended. The original proposed zoning by-law would amend By-law 2006-120 by rezoning the subject lands from Residential Type 1 (R1) to Residential Type 4 (R4) in part. The Residential Type 4 (R4) would permit the following dwelling types; Row, Triplex, Fourplex, Apartment and Group Housing. 2. Based on Town staff s review of the application and comments received to date, Town Staff would recommend that the proposed By-law be amended to rezone the subject lands from Residential Type 1 (R1) to Residential Type 4 Holding (R4-H) in part and Environmental Protection One (EP1) in part. 23

DEVELOPMENT SERVICES COMMITTEE MINUTES Wednesday January 25, 2012-7:00 p.m. Town Council Chambers Page 2 3. The Residential Type 4 Holding (R4-H) would limit the uses to the existing uses until the Holding H Symbol is removed by Council, at which time the permitted uses would be all those uses permitted in the R4 Zone. The Holding H Symbol could be removed once a Site Plan Agreement has been entered into with the Town. 4. The Environmental Protection One (EP1) is recommended to be applied to lands containing the creek up to the top of bank. These lands should be identified by an Ontario Land Surveyor. Mr. Matt Holmes, Municipal Planner, presented the following documents, and/or correspondence. 5. Comments received from the Town of Bracebridge Chief Building Official indicates demolition permits will be required for any structure on the retained parcel to be removed. 6. Comments received from the Town of Bracebridge Public Works Department indicate no concerns with the application and recommend that the applicants enter into a site plan agreement with the Town of Bracebridge to address future servicing, stormwater management, site access, construction mitigation and grading of the subject lands. 7. Comments received from the District of Muskoka indicate that staff would not be opposed to the proposed zoning by-law provided the by-law is amended to include a Holding H Symbol. In accordance with Section H.19 of the Muskoka Official Plan a Holding H Symbol should be included on the lands in order to ensure proper allocation of servicing capacity. Removal of the Holding H Symbol would be considered once confirmation has been obtained from the District that adequate capacity is available in order to ensure the appropriate allocation of services for the proposal at the time a site plan is entered into with the Town. 8. Comments received from the District of Muskoka also indicate that the property has frontage on a District Road and therefore an entrance permit will be required from the District prior to the construction of an access onto the District Road. 9. Letter received from Mike and Barb Spicer, neighbouring property owner, indicating their opposition to the proposed rezoning. Feel oversized development for the lot, concern with the entrance, sidewalks, where the children would play and that they feel a privacy fence should be erected around the entire lot due to the elevation being much higher than their lot. The applicant s agent, Patrick Mason, of Wayne Simpson & Associates, addressed the Committee. Advised that the owner had hired a surveyor to conduct a typographical survey and the top of the bank will be well defined. In agreement with the zoning of the Environmental Protection zone and the Holding Symbol as a requirement of the District of Muskoka. Barb Spicer, neighbouring property owner, addressed the Committee and advised she felt the mapping was wrong and reiterated her letter and the privacy fence request. 24

Opening Comments: Statement of Purpose & Effect of the Proposed Zoning By-law: The subject property is currently zoned Residential Type 1 (R1) according to Comprehensive Zoning By-law 2006-120 as amended. The proposed zoning by-law would amend By-law 2006-120 by rezoning the subject lands from Residential Type 1 (R1) to Residential Type 1 Special - 54 (R1-54). The Residential Type 1 Special - 54 (R1-54) Zone would permit all uses in the R1 Zone including one accessory apartment dwelling unit with each unit having a separate outdoor privacy area of 23 square metres with a minimum lot frontage of 15 metres. Mr. Matt Holmes, Municipal Planner, presented the following documents, and/or correspondence. 1. Comments received from the Town of Bracebridge Chief Building Official indicate no concerns with the proposal. 2. Comments received from the Town of Bracebridge Public Works Department indicate no concerns with the proposal. 3. Comments received from the District of Muskoka indicate no concerns with the proposal. The Muskoka Official Plan and the Provincial Policy Statement encourage intensification, efficient use of infrastructure and the provision of a broad range of dwelling types. As accessory apartments can provide an attainable housing option, the District of Muskoka would be supportive of the intent of the proposal. 4. Comments received from the District of Muskoka also indicate that limits for curbside waste collection for a single family dwelling will apply to the property. 25
