Waiver of arbitrator disclosure requirements.: By signing below, I expressly agree that all arbitrations pursuant to the California Code of Ethics and Arbitration Manual ( Manual ) shall be governed by the Manual, and I specifically agree to waive the arbitrator disclosure requirements of the provisions of the California Ethics Standards for Neutral Arbitrators in Contractual Arbitration in California and California Code of Civil Procedure Section 1281.9 (a)(2), (3), (4) and (b) 1281.85, which require disclosure by REALTOR arbitrator of information about prior arbitrations that is confidential under the rules of the California Association of REALTORS and National Association of REALTORS. NAR Variable Dues Formula Enforcement The National Association of REALTORS, California Association of REALTORS and the North San Diego County Association of REALTORS Variable Dues Formula Enforcement is a policy that all local associations are required to enforce per NAR, CAR, and NSDCAR bylaws. As the broker of record it can and will affect the REALTOR membership of your brokerage(s) and that of the salespersons/brokerassociates affiliated with your license(s). Here is a brief explanation of the Variable Dues Formula: A broker s dues are determined by a base amount multiplied by the number of licensees affiliated with his/her brokerage (per BRE records statewide) that are not REALTOR members, referred to as non-member salespersons (NMSPs). NSDCAR sends out a bi-weekly notice, via email, of the NMSPs, referred to as the DR Variable Dues Notices. This prompts you as the broker to do one of the following: A. Update your office roster by removing licensees from BRE records. B. Remind the agents to join or renew membership with an association. C. Submit the Limited Function Referral Office Certification to exempt referral only agents. D. Submit the Mortgage Loan Originator Certification to exempt MLO agents. E. Make payment of the Variable dues assessment. This formula remains the same for all licensees no matter how active or inactive they may be in the industry. A licensee affiliated with a brokerage, per BRE records, is considered Active. Licensed clerical assistants that access the MLS are not exempt from the Variable Dues Formula. Annual REALTOR dues renewals are due and payable by January 1 of each year and become delinquent as of February 1 for renewing members. These notices are sent to you from NSDCAR as CAR records are updated from the BRE. Disregarding the notices, sent via mail and email, and not meeting the membership requirements by the specified dates in those notices will result in the suspension of membership for you and all entities affiliated with your broker s license.
