RURAL MUNICIPALITY OF WOODLANDS COUNCIL MINUTES The regular meeting of Council of the Rural Municipality of Woodlands was held in the Municipal Office on Tuesday, November 8, 2011 at 9:30 a.m. C.S.T. with Reeve Don Walsh in the chair, and the following Councillors present: Ila Buchanan, Carl Fleury, Gavin Jones, Trevor King, Doug Oliver and Garry Peltz. Also present: Lynn Kauppila, Chief Administrative Officer, as recording secretary. Councillor King was excused at 12:40 p.m. and returned at 1:40 p.m. with reason. COUNCIL MINUTES -4- NOVEMBER 8, 2011 Resolution No. 545/11 Agreement 361/11 Jones-King Guenther Permit Encroachment of dwelling WHEREAS subsection 250(2)(d)(i) of The Municipal Act authorizes a municipality to enter into an agreement with a person; Onto Municipal THEREFORE BE IT RESOLVED THAT Council of the R.M. of Woodlands Property enter into an agreement with Albert John, Lois Lorraine, Christopher Matthew and 10-5-1456 Danelle Catherine Guenther, as set out in Agreement 361/11, to permit the encroachment of a dwelling located on Lot 10, Block 5, Plan 1456 on to municipal property; and FURTHER BE IT RESOLVED THAT the Reeve and Chief Administrative Officer be authorized to execute the agreement. PLANNING Subdivision Rudy Bergen SE 22-13-2W Resolution No. 546/11 Fleury-Jones WHEREAS the owner, Rudy Bergen, has applied for a subdivision of the parcel legally described in CT 1328244 as part of the SE ¼ 22-13-2 WPM; and WHEREAS the owner holds title to the 147.45 acre parcel located approximately 4 miles west of the community of Warren; and WHEREAS the intent of the subdivision is to subdivide a 13.71 acre yardsite to be retained by the retiring farmer, from the 147.45 acre parcel; and WHEREAS section 3.4.1.7 of the Development Plan allows for the subdivision of a yardsite for a retiring farmer who wishes to retain the farm residence for retirement purposes; and WHEREAS the Development Plan suggests that 10 acres be considered the maximum area for residential sites however, this proposal of 13.71 acres in size does conform with the existing yardsite boundaries; and WHEREAS the proposed lot size does meet minimum site requirements of Table 6.1-2 of the Zoning By-law; and WHEREAS Community Planning Services File #4206-10-5037 suggests that there are no concerns with the proposed subdivision but notes that the applicant must make appropriate application to Manitoba Conservation for the continued use of the existing sewage ejector system; THEREFORE BE IT RESOLVED THAT final approval be granted. BY-LAWS Resolution No. 547/11 By-law 2604/11 Peltz-Jones Operation & BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands gives Mgmt of Wastewater first reading to By-law No. 2604/11, to provide for the operation and management of Systems Wdlds the wastewater system within the Hamlet of Woodlands, the appointment of a utilities supervisor and the administration and enforcement of the permit system.

COUNCIL MINUTES -5- NOVEMBER 8, 2011 FINANCE Report of Finance Committee Resolution No. 548/11 Peltz-Jones BE IT RESOLVED THAT the report of the Finance Committee be received, that the following accounts be paid: General cheque numbers 20320 through 20346 in the amount of $96,440.06 and that payments made after the October 25, 2011 meeting, cheque numbers 20209 through 20319 in the amount of $607,008.51 be approved with the exception of the following: Council and L.U.D. of Warren Committee Members, Fire Chief retainer and Deputy Fire Chief retainer cheque number 20300 to cheque number 20311 and cheque number 20312 to cheque number 20319. 4 For 2 Abstained Ila Buchanan Doug Oliver Resolution No. 549/11 Report of Finance Jones-Fleury Committee BE IT RESOLVED THAT the Council of the Rural Municipality of Woodlands authorize the payments to members of Council and L.U.D. of Warren Committee Members, Fire Chief retainer and Deputy Fire Chief retainer cheque number 20300 to cheque number 20311 in the amount of $9,737.33 and cheque number 20312 to cheque number 20319 in the amount of $1,998.34. 4 For 2 Abstained Ila Buchanan Doug Oliver Resolution No. 550/11 2012 Grass Buchanan-Peltz Cutting at Office BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands authorizes Dan Langrell to complete the 2012 grass cutting and maintenance at the municipal office in the amount of $30.00 per cut. Resolution No. 551/11 Easypay Payroll Oliver-Buchanan 2012 Update BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands authorize the purchase of the Easypay payroll 2012 update, in the amount of $294.00 plus applicable taxes. Resolution No. 552/11 O/S A/R Added to Oliver-Fleury Tax Roll WHEREAS The Municipal Act subsection 250(2)(e) states a municipality may for municipal purposes do the following: (e) use municipal equipment, materials and labour to carry out private works on private property ; and WHEREAS The Municipal Act, subsection 252(1)(a) provides for setting fees for services, charging and collecting them; and WHEREAS The Municipal Act, subsection 252(2) provides that a charge referred to in clause 1(a) may be collected by the municipality in the same manner as a tax may be collected or enforced under this Act; and

WHEREAS the various charges and debts owing to the municipality as listed in Schedule C have not been paid; THEREFORE BE IT RESOLVED THAT Council of the R.M. of Woodlands authorize that the charges for services left unpaid as per attached Schedule C be COUNCIL MINUTES -6- NOVEMBER 8, 2011 added to the tax rolls and charged against the land and shall be collected in the same manner in which ordinary taxes upon the land are collectable and with like remedies. GENERAL List of Properties Requesting Tax Relief Resolution No. 553/11 Jones-Peltz WHEREAS the Province of Manitoba has introduced a special provincial Property Tax Relief Program recognizing the loss in value of properties significantly damaged by the 2011 record flooding; and WHEREAS the Municipality has set a budget based on receipt of the tax revenue and the Property Tax Relief Program ensures municipal revenues are maintained; and WHEREAS the Province requested the Municipality to prepare a list of properties complete with date damage occurred and submit the list to Manitoba Local Government; and WHEREAS, upon receipt of the list of affected properties, Manitoba Local Government will calculate the amount of relief to be received and provide the Municipality with Property Tax Relief Statements for the affected property owners and Manitoba Finance will remit the total amount of tax relief to the Municipality; CAO Report Reschedule Council Meeting THEREFORE BE IT RESOLVED THAT Council adopts the attached Schedule A listing of properties with the date the damage occurred and list to be forwarded to the Province for their consideration in the administration of the Property Tax Relief Program. Resolution No. 559/11 Accept Quote to Oliver-Buchanan Build Up Approx. BE IT RESOLVED THAT Council of the R.M. of Woodlands approves the quote ½ Mile Road 5 from A.P.E. Construction dated October 26, 2011 in the amount of $28,800.00 plus applicable taxes to build up approximately ½ mile of Road 5 between Roads 85N and 86N. Resolution No. 560/11 2011 MB Oliver-Fleury Conservation BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands Districts authorizes the attendance of Council members, citizen representatives Henry Rosing Convention and Bill Fleury at the 2011 Manitoba Conservation Districts Convention being held in Brandon on December 12 th to 14 th, 2011. Resolution No. 561/11 Purchase King-Fleury Culverts BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands approves the purchase of culverts from Canada Culvert as per quote dated October 31, 2011 at a total cost of $4,260.00 plus all applicable taxes. Resolution No. 562/11 Twin Lakes Beach Jones-Buchanan Assoc. AGM BE IT RESOLVED THAT Council of the R.M. of Woodlands authorizes one member of Council, Chief Administrative Officer, Municipal Emergency Coordinator and Recovery Manager to attend the Twin Lakes Beach Association Annual General Meeting being held on Tuesday, November 8, 2011 at 7:00 p.m. at Sisler High School in Winnipeg. Request MIT Install Culvert Along PR 227 Btwn Rd 22 & 23 Fleury-Oliver BE IT RESOLVED THAT Council of the Rural Municipality of Woodlands requests and authorizes Manitoba Infrastructure & Transportation to open the blocked crossing by installing a culvert along PR 227 between Roads 22 and 23 to reduce the water flow going south on Road 23.
