RIVER MEADOW CONDOMINIUM ASSOCIATION RULES AND REGULATIONS ADOPTED BY THE BOARD OF DIRECTORS ON April 1, 2013 To assist the Condominium Association in providing for the safe and congenial occupancy and the protection of the value of the Units, it is necessary that the Board of Directors have the right and authority to exercise reasonable controls over the use and appearance of the Units and the Common Areas (including Limited Common Areas). Violation of the following rules shall not be permitted, and the Board of Directors is authorized to take the steps necessary to prevent or discontinue any violations, all at the expense of the violator: PAYMENT OF MONTHLY FEES Due Date The monthly Condominium fee of $300 per Unit is due by the first of each month. Payments received after the tenth of the month will be assessed a late payment fee. TRASH Dumpster Use The dumpster is provided for disposing of trash and is for the sole use of residents of River Meadow Condominiums. Trash items that cannot be broken down and placed within the dumpster are not to be left adjacent to the dumpster. No refuse or trash shall be permitted to remain in public view. Contractors who have been hired by individual Unit Owners are not permitted to use the dumpster for construction debris. VEHICLES Speed Limit The speed limit in the River Meadow parking lot and driveway is 5 miles per hour. Parking Each Unit has two assigned parking spaces in front of the Unit. Units having more than two vehicles may park in the nearest Visitor parking area. Unit Owners, tenants or guests may not occupy the entire Visitor parking area near the Unit. Vehicles shall not obstruct the walks and roadways, for any purpose, except as shall be necessary when moving furniture or appliances into or out of a building. Auto Repairs No automotive repairs shall be made on Condominium property. Only currently registered, private motor vehicles in operable condition shall be parked at the Condominium. Vehicles which are not in operable condition or which are unregistered are subject to being towed at the owner s expense without notice. RVs, Boats, Etc. No recreational vehicles, including but not limited to motor homes, campers, travel trailers, boats, trail bikes, ATVs, snowmobiles, and oversize trucks shall be parked or stored outside the Unit without written consent from the Board of Directors. 1

Winter Parking Wintertime parking rules, in effect from November 1 through the following April 1, are to provide maximum convenience for residents without obstructing emergency vehicles, winter maintenance work or other residents. So that the Visitor parking areas are kept sufficiently clear for the contractor to plow, residents are requested to leave cars parked overnight in Unit parking spaces when snow is expected. After the contractor has cleared the Visitor parking areas and roadways, residents must move cars to the cleared area. Bicycles and Scooters Racks are provided for the storage of bicycles and scooters beginning in the spring. Bicycles and scooters must be removed from the racks by November 15 th. COMMON AND LIMITED COMMON AREA USAGE Everything outside of the interior of the Condominium Unit is considered to be Common Area or Limited Common Area. Unit Owners and renters have access and the right to use the Common Area. Limited Common Areas, which consist of decks and porches, are solely for use by residents and guests of the Units to which they are adjacent. Proper Use All parts of the Common Area shall be used for the purposes for which they are by their nature intended, or as may be permitted by the Board of Directors. Unobstructed Access There shall be no obstruction of the Common Area. Outside Storage Unit Owners may not have outside storage bags, containers, cabinets, shelves or sheds on their porches or decks or on any Common Area. Decks The only items that may be kept on decks without written approval from the Board are porch/deck furniture and outdoor grills. Porches The only items that may be kept on porches are outdoor chairs (up to 2) and well-maintained plants or flowers in pots located on the porch itself. Damage There shall be no use of the Common Area that injures or scars the Common Area or the plantings thereon, increases the cost of maintenance, or causes unreasonable embarrassment, disturbance or annoyance to Unit Owners, their lessees, or guests. Condominium Employees No Owner, tenant, or guest shall direct or engage any employee of the Condominium on any private business, nor shall he or she direct, supervise, or in any manner attempt to assert control over any such employee. Nuisance and Annoyance No nuisance shall be allowed nor shall any use or practice be allowed which is a source of annoyance or which 2

interferes with the peaceful possession or proper use of the Condominium by others. Lawful Usage In the use of Units and the Common Area of the Condominium, residents shall obey and abide by all valid laws, ordinances, and zoning and other governmental regulations affecting the same and all applicable Rules and Regulations adopted by the Board of Directors. Pond and Brook Use of the pond and beach is restricted to residents of the Condominium and a limited number of their guests. Children under the age of 13 must be accompanied by an adult when swimming or using the beach. Nothing should be done which would interrupt the flow of water in the brook or into or out of the pond. Personal Property Personal property shall not be left in the Common Area (excluding Limited Common Area), and when in use outside, shall be used in the appropriate manner. Solicitation and Canvasing No person, including any Unit Owner, shall canvas the residents, sell merchandise, solicit orders for any merchandise of any kind, or distribute any handbills, pamphlets or advertising matter except with the prior written consent of the Board of Directors. EXTERIOR CHANGES TO UNITS Additions or Modifications Nothing shall be done in any Unit or in, on, or to the Common Area which might impair the structural integrity of the Condominium, or which would structurally change a building. Nothing shall be altered or constructed in or removed from the Common Area or Limited Common Area (decks, porches) without the prior written consent of the Board of Directors. Air Conditioners Air conditioners may only be installed on the back and sides of buildings (not the front) and must be installed through the wall and not in windows. Unit Owners must obtain written consent from the Board of Directors prior to installing an air conditioner. Satellite Dishes, Telephone Cables, Lighting No owner, tenant, or guest shall allow the installation of wiring for electrical or telephone use, television antennas, satellite dishes, air conditioning unit or other machine or equipment, which protrudes through the walls or the roof of the building or is otherwise visible on the exterior of the building except as presently installed, or as authorized by the Board. Lighting Fixtures No exterior lighting fixtures shall be attached to any Unit or Limited Common Area without the prior written consent of the Board of Directors. COMMON AREA UNIFORM APPEARANCE Curtains, Laundry, Rugs, Etc. No clothing, laundry, rugs or other objects shall be hung, shaken or thrown from any window or exterior portion of a Unit or otherwise left or placed in such a way as to be exposed to public view. All drapes and curtains or 3

exterior windows shall be white or white lined so that the white backer or white curtain is visible to those viewing a Unit from the outside. Lawn Ornaments No lawn ornaments of any kind will be permitted anywhere in the Condominium except with the prior written approval of the Board of Directors. Lawn Furniture Any and all lawn furniture must be kept on the deck or in the Unit at all times. Grills and Barbecues Grills and barbecues must be used on decks only and should be pulled away from the building when in use. Holiday Decorations Holiday decorations may be displayed on the front doors of Units between December 1 and January 30 and shall consist only of wreaths and swags on doors. All other decorations must be kept within the boundaries of the Unit. Only white, non-blinking lights are permitted in public view. Other Decorations Any decoration which in the determination of the Board of Directors is found to cause annoyance to and reasonable objection from another Unit Owner or Lessee shall be removed by the Unit Owner immediately upon receipt of written notification from the Board of Directors. Signs and Advertisements No advertisements, signs, or posters of any kind shall be posted in or on the Units or the Condominium except as authorized in writing by the Board. Flags Any Unit Owner may hang or otherwise display the flag of the United States from a wall mounted bracket on the exterior of the Unit, provided such flag shall be in good condition and shall be displayed in a manner which is in accordance with recommendations of civil authorities. No flag of any other kind shall be displayed upon any building without prior written consent of the Board of Directors. The Unit Owners so displaying a flag shall be liable to the Unit Owners' Association for the cost of repair of any damage caused to any part of the Common Area by such display. PET RULES Household Pets No animal, other than common household pets with the consent of the Board, shall be kept or maintained on the Property, nor shall common household pets be kept, bred or maintained for commercial purposes on the Property. Number of Pets Unit Owners are allowed a maximum of two (2) household pets unless otherwise approved by the Board. Renters are not permitted to have pets. Control Pets shall not be permitted outside of Units unless they are on a leash or carried. No pet shall be tied to any part 4

of the Common Area or Limited Common Area at any time. Registration No pet shall be kept in the Condominium unless and until the Board of Directors shall have granted prior written permission and the pet shall have been registered with the Board of Directors. The registration form is available online at the R.M.C.A. website or from a member of the Board. Vaccination and Licensing All pets shall have current certificates of vaccination for rabies and distemper. Each Unit Owner will deliver a copy of such certificates to the Board of Directors upon request. Each pet shall have a current license if so required by the Town of Henniker. Clean-up No dog or cat shall be allowed to defecate on the Common Area (including the Limited Common Area) with the exception of the unused wooded areas. Any stool discharged on the Common Area (including the Limited Common Area) must be immediately removed therefrom and disposed of properly. Damage Any damage to the Common Area (including Limited Common Area) caused by a pet, including but not limited to staining grass or shrubs, may be repaired by the Unit Owners' Association to its reasonable satisfaction, and the owner of the pet shall be assessed the cost of the repair. Removal of Pets The Board of Directors shall have the right to levy assessments for violations of pet rules as follows: 1) for the first violation a verbal or written warning is given; 2) for the second violation of the same rule a $40 fine is assessed; 3) for the third violation of the same rule the Board of Directors has the right to order the pet's removal from the Condominium. If the pet shall not be so removed per order of the Board, the Board shall have the right to levy an assessment against the owner in the sum of $500.00 plus any costs incurred by the Owners Association. The levy and collection shall not constitute a waiver of the Board of Directors right to have the pet removed. SAFETY/INSURANCE ISSUES Activities That Might Increase Insurance No activity shall be done or maintained in any Unit or in any Common Area which might increase the rate of insurance on any Unit or the Common Area or result in the cancellation of insurance thereon. Such activities include but are not limited to the burning of tiki torches and candles and the use of chimineas. Flammables and Combustibles No Unit Owner nor occupant of any Unit, nor any of his/her agents, employees, licensees, or guest, shall have at any time any flammable, combustible or explosive fluid, chemical, or other material or substance, except ordinary cigarette lighter fluid and such cleaning fluids as are customary for residential use. Grills and Barbecues Grills and barbecues must be used on decks only and should be pulled away from the building when in use. Weapons No Unit Owner nor any of his/her agents, employees, guests, licensees, or lessees shall have the right to discharge a firearm or bow and arrow, nor to throw a knife, nor to use any other weapon in any part of the 5

Condominium. Any firearm in the Condominium shall be unloaded and the safety on. Snow/Ice Removal Unit Owners must keep their decks, porches and walkways free and clear of snow and ice and debris. Cleaning and Inspection Important dates: Turn Off Outdoor Faucets Clean Dryer Vents Furnace Cleaning Chimney Cleaning Homeowner s Insurance Bikes Removed from Racks Turned off by November 15 th Proof of cleaning due November 1, 2013, 2015, 2017, etc. Proof of cleaning due November 1, 2013, 2015, 2017, etc. Proof of cleaning due November 1, 2013, 2015, 2017, etc. Proof of coverage (minimum of $25,000) due on policy renewal date All bikes and scooters removed by November 15 th All Units with fireplaces must have the chimney commercially inspected and cleaned, as required, at least every other year in the odd- numbered year (2011, 2013, 2015, etc.) All furnaces and dryer vents must be serviced and cleaned every other year in the odd-numbered year. A copy of proof of cleaning and service must be given to the Board of Directors by November 1 in the same year and must have been performed anytime during the 6 months prior to November 1 of that year. Sillcocks All Units with sillcocks (outside faucets) must turn the shut-off valve off by November 15 th each year to avoid frozen and bursting pipes. If needed a member of the Board of Directors can help locate the shut off valve within the Unit. Mandatory Homeowner s Insurance Unit Owners must purchase homeowners insurance in an amount greater than or equal to $25,000 which is equivalent to the current deductible amount of the Condominium master insurance policy; Owners must provide proof coverage to the Board of Directors annually on the renewal date of the policy. OCCUPANCY AND LEASING OF UNITS Lease Length All leases or rental agreements for any Unit shall be in writing, shall be specified subject to the constituent documents, and shall be for a period not less than one year. Timeshares No Owner shall sell timesharing interests or quarter sharing interests in his or her Condominium Unit. Subletting There shall be no subletting of leased Units. Rules to Lessee Prior to the signing of the lease the Unit Owner shall provide the lessee with a copy of these Rules and Regulations. Pets and Renters Renters are not allowed to have pets. 6

Tenant Rule Awareness and Pledge The Unit Owner shall obtain a signed copy of the Rules and Regulations Receipt Form (which can be obtained from the Board of Directors or on the R.M.C.A. website) from the lessee and shall give a signed copy of said release form and a copy of the signed lease or rental agreement to the Board of Directors. Three Unrelated People No more than three (3) unrelated persons may reside in a Unit. ENFORCEMENT OF RULES Board Authority The Board of Directors has the authority to assess any fine or penalty for any violation of the Bylaws or these Rules and Regulations which remains uncorrected. First Notice of Violation Any offense which must be corrected will be communicated in writing to the Unit Owner by a member of the Board of Directors. Five Days to Cure Violation The first notice above shall serve as a warning and, with the exception of a violation which in the judgment of the Board poses an immediate threat to safety or health, all notices shall provide at least five (5) days to cure the violation. Second Notice of Violation and Fine of $40 If the violation remains uncorrected after five (5) days a second notice will be sent to the Unit Owner noting the date and violation; this letter will also cite the Rule or Bylaw which has been violated and will show the fee of $40.00 for a first offense. Further non-compliance will result in an increase in fines. The Owner shall in addition be liable for all costs incurred by the Unit Owners Association in removing the violation. All fines are due immediately from the Unit Owner upon receipt of this second notice. Lien Filing Any unpaid fines shall be totaled and a lien filed against the Unit Owner by the Board of Directors. 7
