These modifications, comments, and attachments are hereby made a part of the bid documents to the same extent as if bound therein. The due date for questions and bids remains the same. I. Changes, Additions, and Modifications to the RFP A. Replace all text and tables in Part I, Section 25. Metropolitan Washington Council of Governments Rider Clause with the language that appears in Attachment A. B. Appendix I, Section 07530 (page APP-7) EPDM Single Ply Membrane Roofing for System A specifies white EPDM. The color of the EPDM is to be removed from the specification. II. Pre-Bid Meeting Notes A. Introduction Good morning, and welcome to the pre-bid meeting for ITB 13-29, MATTAWOMAN WWTP SAND FILTER BUILDING ROOF REPLACEMENT. My name is Shanna Reese, and I am the Assistant Chief of Purchasing for Charles County Government. Also with us today is Mr. William Sandy, Construction Project Manager and project manager for this project, and Mr. Dave Defalco, Construction Superintendent, of the Department of Public Works, Buildings and Trades Division. The intent of this project is to perform roof replacement and piping services to the Mattawoman Waste Water Treatment Plant (WWTP) Sand Filter Building. The meeting will be conducted in three (3) parts. o I will first review selected portions of the Instructions To Bidders within the ITB. Items not reviewed should not be construed as being less important than those reviewed. No information will be presented that is not already contained within the ITB. I will then ask for any questions pertaining to the Instructions To Bidders. o The meeting will then be turned over to Mr. Sandy who will discuss technical aspects of the project, and entertain any technical questions. o A site visit will be conducted at the end of the technical discussion. 1
If you have not already done so, please sign-in on the attendance roster. B. Procurement Discussion / Questions All solicitation documents may be found on the County Bid Board. Ensure all required forms and any other information required is complete and in your proposal package. o Bidder s Experience Form on page I-14. o Bid Form on page I-10. o Addendum Certifications on page I-13 (there will be at least one addendum). Electronic versions of the specification diagrams will be available on the bid board with an addendum. Submit two (2) unbound original and two (2) copies of your bid. Questions concerning the procurement process should be directed to Shanna Reese, at the email address provided in the ITB. In accordance with the ITB, all technical questions should be directed to Mr. Sandy, in writing only, via the contact information provided. No information obtained from any source other than the Solicitation documents found on the County Bid Board, or from myself or Mr. Sandy, may be considered to be accurate. Important Dates: o The cutoff for questions is close of business (4:30 PM) on April 16, 2013. o The last date for issuing addendums to the ITB will be April 23, 2013. There have been no addendums issued to date. o Bids are due before 3:00 PM on April 30, 2013. No bids, modifications, or withdrawals will be accepted after that time. o A bid opening will occur immediately following 3:00PM on April 30, 2013 in the Room 121 located at the Charles County Government building, 200 Baltimore Street, La Plata, MD 20646. Bids must state that they are valid for one hundred and twenty (120) days from the due date. There is a 25% MBE goal for this solicitation. Firms are encouraged to meet that goal. This ITB is subject to the County s Small Local Business Enterprise Program. If the bidder is a Charles County registered SLBE, please complete the SLBE program forms located on page I-18 to I-20 of the solicitation. Insurance requirements and the protest policy may be found on page I-5. The County may reject any and all bids for any reason it deems necessary, and may waive any irregularities and/or informalities, and make award in any manner that is in the best interest of the County. Award will be to the lowest responsive, responsible bidder, provided it is in the County's best interest to do so. Project Term: The project is to be completed within 120 consecutive calendar days, from the Notice To Proceed date issued by the County. A 5% Bid Bond, certified check, or bank Cashier s/treasurer s Check shall accompany the bid or the bid will not be considered. A Performance Bond and Labor & Material Payment Bond in the amount of 100% of the contract price will be required for this project and contract. Liquidated damages are $500/day for this project. By submitting a bid/proposal in response to this solicitation, the bidder certifies that their firm is not debarred, suspended, or otherwise ineligible for participation in government procurement by the federal government, the State of Maryland, or any other state, county, or municipal government. Technical Discussion / Questions and Site Visit - William Sandy/David Defalco Section 07530 EPDM Single Ply Membrane Roofing for System A specifies white EPDM. The color of the EPDM is to be removed from the specification. Gravel from the build-up roof is to be disposed at a location to be determined on the WWTP site. The County will supply dumpsters for the disposal of the build-up roof and piping. The skylights may remain in place during the roof replacement. E. Technical Questions Received David Dallum, Metropolitan Exteriors Question: Can any other manufacturer than Carlisle be used for the membrane (pg. APP-7)? Answer: If using System A, only Carlisle; System B may use Carlisle or Genflex. Question: Can any other metal manufacturer than Metal Era or W.P. Hickman Co. be used (pg. APP-11)? Answer: Yes, an approved equal. Question: Do the copings need to be preformed by the manufacturer or within the contractor s shop prior to installation? Answer: This question was incorrectly answered during the meeting. The correct answer is yes, copings must be preformed. Arthur Ashe, DJB Contracting, Inc. Question: Do any barriers need to be installed to prevent dust from entering the filter building? Answer: No Joseph Mpamaugo, Dimensions Construction and Remodeling Inc. Question: How accurate are the measurements on the plans? Answer: Measurements shown are from the County as-built plans. The contractor is responsible to verify dimensions. George Rowe, Ruff Roofers Question: Is it possible to access the site again? Answer: Yes, contact Dave DeFalco by email at defalcod@charlescounty.org to coordinate. No questions will be taken during this visit. All questions must be directed in writing to the technical point of contact specified within the solicitation. Question: Can the County supply a dumpster for the gravel? Answer: The gravel removed can be dumped in the upper Line Maintenance parking lot located onsite. Contractors will be required to supply their own means to transport aggregate/gravel from roof to dump location. George Rowe, Ruff Roofers Question: Is the piping to be repaired or replaced? Answer: The piping is to be replaced. 3

Written Questions Received up to 4/10/2013 Jenny Kim, US Construction Group, LLC Question: Do we have to be prequalified to bid on this project? Response: No, you do not need to be prequalified to bid on this work. All requirements are available within the solicitation documents available online at www.charlescounty.org, click on "Procurement Opportunities" then "Bid Board" on the next page. Glenn Phillips, Cole Roofing Co., Inc. Question: I see on the ITB, this project has a SLBE provision. Response: The SLBE provision within the proposal does not preclude you from bidding on this project. All vendors are encouraged to bid on this work if they feel they are qualified to complete the services requested. Question: Are there electronic versions of the drawings available? The drawings in the ITB aren t legible. Response: Please refer to the electronic versions of the drawings available on the County Bid Board located at charlescounty.org. Click on Procurement Opportunities, then Bid Board under the documents for ITB 13-29. Eric Gandee, BMB Site Managers Question: Can a business use subcontractor references, if they are a general contractor? Response: Prime bidders must submit references for their own business. Question: Does the project require 25 percent MBE utilization and if so, do the MBEs need to be certified in the type of work being solicited (i.e. roofing and plumbing services)? Response: There is an aspirational MBE participation goal of 25 percent for all Charles County Government solicitations. MBEs are registered/certified based upon their MBE status, not upon their ability to perform tasks that require State of Maryland certification or licensure. Please refer to page I-4 in the ITB for MBE requirements. George Rowe, Ruff Roofers Question: During the meeting a question was posed regarding the existing roof composition. It was stated that there were as-built drawings available, but I do not see them here on the website. Could you please direct me to where they are in case I missed them or make them available to us if I didn t miss them? The purpose of my question is to determine what exactly we are to tear off, thickness wise. Answer: The as-built drawing of the sand filter building is available on the Charles County Bid Board under the ITB 13-29 documents. Question: Please confirm that we are to install an additional expansion joint that is not currently present on the sand filter bldg. roof. Presently there is only 1 that runs north to south and one that runs east to west, yet the new roof plans shows two expansion joints running east to west. Answer: No additional expansion joints are to be installed. 4

25. MID-ATLANTIC PURCHASING TEAM RIDER CLAUSE USE OF CONTRACT(S) BY MEMBERS COMPRISING Mid Atlantic Purchasing Team COMMITTEE Extension to Other Jurisdictions The Charles County Government extends the resultant contract(s), including pricing, terms and conditions to the members of the Mid-Atlantic Purchasing Team, as well as all other public entities under the jurisdiction of the United States and its territories. Inclusion of Governmental & Nonprofit Participants (Optional Clause) This shall include but not be limited to private schools, Parochial schools, non-public schools such as charter schools, special districts, intermediate units, non-profit agencies providing services on behalf of government, and/or state, community and/or private colleges/universities that required these good, commodities and/or services. Notification and Reporting The Contractor agrees to notify the issuing jurisdiction of those entities that wish to use any contract resulting from this solicitation and will also provide usage information, which may be requested. The Contractor will provide the copy of the solicitation and resultant contract documents to any requesting jurisdiction or entity. Contract Agreement Any jurisdiction or entity using the resultant contract(s) may enter into its own contract with the successful Contractor(s). There shall be no obligation on the party of any participating jurisdiction to use the resultant contract(s). Contracts entered into with a participating jurisdiction may contain general terms and conditions unique to that jurisdiction Including, by way of illustration and not limitation, clauses covering minority participation, nondiscrimination, indemnification, naming the jurisdiction as an additional insured under any required Comprehensive General Liability policies, and venue. 7
