PROPERTY OWNER PETITION FOR DETACHMENT OF PROPERTY FROM A CITY IN THE MATTER OF THE PETITION FOR DETACHMENT OF CERTAIN LAND FROM THE CITY OF BALATON, MINNESOTA PURSUANT TO MINNESOTA STATUTES 414.06 TO: Office of Administrative Hearings Municipal Boundary Adjustment Unit P.O Box 64620 St. Paul, MN 55164-0620 PETITIONERS ST ATE: The number of petitioners required by Minnesota Statute 414.06, Subd. 1, to commence this proceeding is: all of the property owners if the area is less than 40 acres; or 75% or more of the property owners in number if the area is more than 40 acres. It is hereby requested by: all of the property owners, the area is less than 40 acres; or X 75% or more of the property owners, the area is more than 40 acres; to detach certain properties described herein from the City of Balaton and make a part of the Township of Rock Lake. 1. There are two (2) property owners in the area proposed for detachment. 2. All property owners have signed this petition. (If the land is owned by both the husband and wife, both must sign the petition to represent all owners.) 3. The property is situated within the City of Balaton and abuts the municipal boundary, and is located in the County of Lyon. The petitioned area abuts on the city's West boundary. 4. The property proposed for detachment is rural in character and not developed for urban residential, commercial, or industrial purposes. 5. The reason detachment is requested is to significantly reduce the tax burden on the detached land. 6. Summarize what efforts were taken prior to filing this petition to resolve the issues: Petitioners have contacted Rock Lake Township and it has agreed to accept the detached property as evidenced by the minutes attached hereto for a meeting of the Township Board on December 12. 2016. The City of Balaton opposes the Petition as indicated by the attached Resolution from the City of March 13. 2017.

7. The total number of acres in the property proposed for detachment is seventyeight (78) and is described as follows: The East Half of the Southwest Quarter of the Southeast Quarter (E½SW¼SE¼) and the East Half of the West Half of the Southwest Quarter of the Southeast Quarter (E½W½SW¼SE¼), all in Section Twenty-two (22), Township One Hundred Nine (109) North, Range Forty-two (42) West. AND The Southeast Quarter of the Southeast Quarter (SE¼SE¼) and the East Half of the East Half of the Northwest Quarter of the Southeast Quarter (E½E½NW¼SE¼) excepting a strip sixteen (16) rods wide off the North end, all in Section Twenty Two (22) Township One Hundred Nine (109), Range Forty Two (42). 8. The number and character of buildings on said property is: None. 9. The number of residents in the area proposed for detachment is: None. 0 Rock Lake Township Regular Meeting Minutes ' Rock Lake Township Board Meeting Monday, December 12, 2016@ 5:30 pm The regular meeting of the Rock Lake Township Board was brought to order at 5:30 p.m. by Chairperson Troy Wendland. In attendance were Supervisor Todd Davis, Supervisor LeRoy Johnson, Treasurer Mary Jo Henkel and Clerk Angela Johnson. GUEST Willis Wendland - looking to get some land out of city limits. No city streets surround areas ofrequest. It is about 30 + 40 acre parcel. M/S/P Johnson/Davis to accept three parcels into Rock Lake Township. Troy Wendland abstained from voting. (Attachment 2) Parcel # I - 21-022005-0 ( 40) Parcel #2 21-022004-1 (30) Parcel #3 21-022002-0 (7.2) MINUTES M/S/P Davis/Johnson to approve the minutes of the regular meeting of Monday, Novemberl4, 2016 at 7:00 p.m. TREASURER'S REPORT M/S/P Wendland/Davis to accept the Treasurer's repmt as given by Treasurer Mary Jo Henkel. All were in favor and the motion passed. Checking account balance of$13,797.63, savings account balance of$86, 861.01 (Attachment 1) is a complete report. ROAD REPORT Wendland bladed, Swenson was in hospital. Roads that are bladed look good, roads that are not bladed are not good and have ruts. OLD BUSINESS Culvert/Tile Outlet - John Greenfield: Culvert is cleaned out on both sides - done and fixed. Snow Plow Truck Repairs - Truck needs work with headlights. Truck went to Freightliner - they didn't fix anything. Differential lock, sensors, reverse lights need to get fixed, ABS lights, plow loose, front plow hydro hose leak and cruise/throttle need to be fixed. NEW BUSINESS Grader Operator - See road report above : ath of Office-Todd Davis and Angela Johnson took Oath of Office for term starting January 1, 2017 (Attachment 3) Signs- Hog Barn/Jeff Timmerman - Requesting signs that say NO Big Trucks will help roads. It is a minimum maintenance road, but doesn't stop the semi-trucks from going on the road. Plow - needs belting - Johnson will look into CORRESPOND AN CE None BILLS M/S/P Wendland/Johnson to pay the bills as presented. All were in favor and the motion passed. (Attachment 4) - is a complete report. Claims for 12/10/2016 were a total of $5,242.48. ADJOURN M/S/P Wendland/Johnson to adjourn the meeting at 6:20 p.m. All were in favor and the motion carried. The next Regular Meeting will be held Monday, January 9, 2017 @7:00 p.m.,emailed to all supervisors on Ill/2017

RESOLUTION WHEREAS, the Balaton City Council has received a copy of a petition for detachment of certain land from the City of Balaton, Minnesota pursuant to Minnesota Statutes 414.06 signed by Willis L. Wendland and Joan Wendland. NOW, THEREFORE, IT IS RESOLVED by the Balaton City Council as follows: That the City of Balaton opposes the petition of Willis L. Wendland and Joan Wendland to detach lands from the City of Balaton. Passed by the Balaton City Council this 13~ day of March, 2017.
