DISTRICT OF NORTH SAANICH BYLAW NO. 1306 A BYLAW TO AMEND "DISTRICT OF NORTH SAANICH ZONING BYLAW NO. 1255 (2011)" The Council of the District of North Saanich, in open meeting assembled, ENACTS AS FOLLOWS: MAP AMENDMENTS 1. The Official Zoning Map of the District of North Saanich attached as Schedule "A" to the "District of North Saanich Zoning Bylaw No. 1255, 2011" is hereby amended to rezone the following lands, Lot 1, Section 7, Range 2 East, North Saanich District, Plan 9443 as denoted in blue shading on the map below, from RA-4 Rural Agricultural 4 to CD-3 Comprehensive Development 3; 2. The Official Secondary Suites Permitted Area Map of the District of North Saanich attached as Schedule "B" to the "District of North Saanich Zoning Bylaw No. 1255, 2011" is hereby amended to indicate in yellow the following lands, Lot 1, Section 7, Range 2 East, North Saanich District, Plan 9443 as denoted in blue shading on the map above. TEXT AMENDMENTS 1. The "District of North Saanich Zoning Bylaw No. 1255, 2011" is hereby amended to:

Bylaw No. 1306 Page 2 a) Include a new "CD-3 Comprehensive Development 3" zone numbered as "508.4" attached to and forming part of this bylaw as Schedule A; b) Include a new "Laneway House" Section to be numbered as "208." attached to and forming part of this bylaw as Schedule B; c) Insert in the table in Section 105.1 "Comprehensive Development 3" in the first column and "CD-3" in the second column after the entry for Comprehensive Development 2; d) Add to the list of zones at the end of Division 500 "508.4 CD-3 Comprehensive Development 3"; e) Add the following definition in alphabetical order to Section 102.1, ""laneway house" means a detached dwelling unit accessory to a principal single family residential dwelling on a lot that abuts two streets or a street and a lane that is open to traffic; f) Add to the definition for "lot line, rear" in Section 102.1 at the end of the existing definition, "; for clarity, the lot line abutting a lane is the rear lot line;"; g) Add to the definition for "single family residential" in Section 102.1 after (a): "(b) a laneway house lawfully established in accordance with Section 208"; and renumber the subsequent sections accordingly; h) Replace in Section 102.1 in the definition for "zone" in (d) "and includes the CD-I and CD-2 zones;" with "and includes the CD-I, CD-2, and CD-3 zones"; i) Replace 107.1.1.(b) with the following: "more than one dwelling unit in a single family residential dwelling, except as provided for in the R-l and R-2 Zones in accordance with Section 206; or except as provided for in the CD-3 Zone in accordance with Section 208"; j) Add the following to Section 110.1.2.(a), "(hi) for lots zoned CD-3, such projections are limited to 0.30 m (1.0 ft.)"; k) Replace Section 112.2. with the following, "The minimum highway frontage for lots in the rounded cul de sac portion of a subdivision may be less than 10% of the perimeter of the lot, provided that: (a) the minimum highway frontage is not less than 10 metres (32.8 ft.), unless in the CD-3 zone, and (b) the lot width is not less than 20 metres (65.6 ft.), unless the lot is in the CD-3 zone." 1) Replace Section 206.1.1.(b) with the following, "have a minimum lot size of 800 m 2 (8611 ft. 2 ), or 300 m 2 (3229 ft 2 ) in the CD-3 zone"; m) Add, "laneway house" after "secondary suite" in Section 206.1.1.(d); n) Add the following to Section 206.1.2 after (b): "(c) 60 m 2 (649 ft 2 ) in the CD-3 zone."; o) Add, "except in the CD-3 zone, and" at the end of Section 206.1.4.(a); p) Add, "302.5. For lots abutting lanes, all lot access and parking shall be accessed only from the lane" to Section 302. OFF-STREET PARKING AND OFF- STREET LOADING REQUIREMENTS; q) Add the following to Section 303. USE after 303.1: "303.2 In all Residential zones, all off-street parking spaces located in a carport or a garage (detached and

This Bylaw may be cited for all purposes as "North Saanich Zoning Bylaw No. 1255, (2011), Amendment Bylaw No. 1306 (2012)". LANEWAY HOUSE 208.X Where a zone permits laneway house use, the following conditions must be satisfied for the construction and occupancy of a laneway house: 208.1.1 The lot on which a laneway house is situated must: (a) be at least 10.0 m (32.8 ft.) in width; (b) have a minimum area of 300 m 2 (3229.2 ft 2 ) (c) be used for not more than one single family residential dwelling and one laneway house; (d) not be used for any dwelling unit other than the dwelling unit in the single family residential dwelling and the laneway house; (e) not be used for any bed and breakfast accommodation or use, home occupation use, or boarding or lodging use in more than one room in either the single family dwelling or the laneway house. 208.1.2 The gross floor area of the laneway house must not exceed the lesser of: (a) 60 m 2 (649 ft 2 ); or (b) 18% of the lot area. 208.1.3 The height of a laneway house must not exceed: (a) 7.6 m (25 ft.) 208.1.4 A laneway house must be sited as follows: (a) Maximum rear setback 7.6 m (24.9 ft.); (b) Minimum rear setback 0.6 m (1.96 ft.); (c) A separation distance of at least 4.5 m (14.76 ft.) from the principal single family residential dwelling; (d) Minimum interior side setback 1.2 m (4 ft.) or 0.8 m (2.6 ft) on corner lots; and (e) Minimum exterior side setback 3 m (9.8 ft).
